Stallion Breeding Contract Shipped Semen Breeding This contract is made on the ____ of __________, 2010 and is by and between Allison Carpenter of Cornerstone Drums, hereinafter referred to as Stallion Owner, and _______________________________________, hereinafter referred to as Mare Owner. The Gypsy Vanner stallion BSG Traven will be bred to the following mare: Mare Name: _________________________________________ Registration Number: ________________________________ Registered Color: ____________________________________ Traven’s stud fee is $800.00 Canadian, includes a Live Foal Guarantee as defined in #9 below, and is subject to the following conditions: 1. Stallion Fee includes a non-refundable Booking Fee of $250.00, payable with this contract, the balance of which must be paid with all other expenses when the Mare is picked up (unless alternative payment schedule has been approved by Stallion Owner). Our Insemination Fee is $25.00, per insemination. 2. The cost of semen collection will be charged to the Mare Owner. The fee for each collection is as charged by the University of Saskatoon – usually around $180 - plus the round trip cost of shipping the container, usually around $150. There is also a $300 security deposit for the shipping container. If the shipping container survives unscathed, the $300 will be applied towards the remainder of the shipping costs or refunded. We strongly suggest that you insure the container for $300 when returning it to the collection facility to avoid having to be responsible for its damage or loss during shipment. 3. The Breeder will charge a courier/handling charge for transporting the semen to Federal Express offices. This fee is $20 per shipment, and will be split between Mare Owners if multiple shipments are sent on the same day. If the semen arrives damaged or is lost in transit, the Mare Owner will not be charged for the collection or the shipment as long as Federal Express is the carrier. Stallion Owner cannot take responsibility for losses on airlines or UPS as there is no easy way to recover costs, other than through Fed Ex. Also, please understand that any of the shipping services, including Fed Ex, require the shipper to handle any damage or insurance claims. Therefore, if the container is damaged or lost during the return, Stallion Owner will notify the Mare Owner and bill their account. It will be the responsibility of the Mare Owner to deal with the shipping agency 4. The Mare Owner is responsible for the return of the semen shipment container to the collection facility within 48 hours of use. Please be considerate of this time frame as there are other mare owners who also wish to receive their semen in a timely manner. We may not always have an abundance of containers on hand to meet everyone‛s needs so we hope all parties will work together responsibly and courteously for the benefit of all. Again, we strongly recommend that the container be returned FED EX, as they are the most reliable and accountable for damage and loss. Stallion Owner will NOT be responsible to track down and collect insurance on lost or damaged containers and items in the containers when containers are being returned to us. That will be the responsibility of the Mare Owner. During the height of breeding season, we may ask you to return the container Fed Ex priority overnight. Please help us during this time to insure a steady flow of semen to all of you. 5. Breeder and collection facility must receive reasonable notice of desired collection and shipment dates. Mare Owner is to advise Breeder upon start of the mare‛s cycle and contact breeder again the day prior to desired collection and shipment. Breeder cannot guarantee shipment on the desired date without this information 6. BSG Traven will be available for collection on Monday, Wednesday, and Friday of each week. This schedule may alter later in the season. Clients who have sent us contracts will be notified of any changes. There will be no semen collected and shipped on holidays, as Fed Ex does not pick up or deliver on holidays. 7. Mare Owner agrees to have the Mare examined by an ultrasound scan between the 14th and 16th day from the last day inseminated and notify Stallion Owner of Mare’s pregnancy status. It is highly advised that Mare be pregnancy checked again between 35 and 55 days. This additional check, not only gives Stallion Owner time to prepare in the event Mare has not settled, but it may save Mare Owner much time and expense in missed heat(s). 8. Mare shall be of healthy and sound breeding condition. A veterinarian health certificate and uterine culture are highly recommended prior to shipping semen. If the mare fails to settle in foal after two cycles, breeder may require the Mare Owner to obtain a current reproductive exam/uterine culture prior to any further shipments. 9. This contract contains a "Live Foal Guarantee". A live foal is defined as a newborn foal that stands and nurses without assistance. If foal is born dead or dies within 24 hours of foaling, there are return breeding privileges only if Stallion Owner is notified within fourteen (14) days in writing, by a licensed DVM’s statement, confirming the cause and death of foal. Additionally, if the Mare absorbs, miscarries, aborts, or proves barren after being pronounced in foal, the Mare Owner has the right to return breeding privileges provided that a licensed DVM can verify that all appropriate care was given to Mare at the proper intervals during her pregnancy. Mare Owner also agrees that said Mare will be kept “toxin-free” for the first 90 days of pregnancy (no vaccinations, wormers, etc. during this time period). Return breeding privileges will be provided during the current breeding season, or the following year breeding season only. Mare Owner has the choice of a rebreed on said Mare or a substitute Mare. Excluding Stallion and Booking Fee, customary fees will apply and must be paid in full before any Mare leaves premises. The Live Foal Guarantee will be null and void if all monies owed the Stallion Owner are not paid by end of the calendar year, unless there is prior agreement between the Mare Owner and Stallion Owner. 10. A Breeder's Certificate will be issued upon completion of this contract, and only after photographic or visual proof has been provided to Stallion Owner of live foal at the side of Mare bred. Mare Owner will be solely responsible for seeking registration of resulting foal in the appropriate breed registry(ies) and will pay all associated fees or expenses. 11. Both parties agree that the Stallion Owner or any person/entity associated with the Stallion Owner is not liable for death, sickness and/or accident including consequential damages caused to the mare and/or foal; and that the Mare Owner is not liable for death, sickness, and/or accident including consequential damages to the stallion. It shall be the Mare Owner's responsibility to maintain mortality/medical insurance on mare and foal if desired. 12. It is agreed that should the above named stallion die or become unfit for service, that the Stud Fee only, will be refunded, thereby cancelling this entire contract. Furthermore, if the above named stallion should die or become unfit for service; frozen semen will not be made available to fulfil this contract. If the Mare dies or becomes unfit to breed before being announced safe in foal, the Stallion Owner will accept another Mare, provided she meets the above-mentioned requirements, according to #3, as a replacement. If Mare Owner fails to deliver a Mare for re-breed, any and all fees paid shall be non-refundable and the contract terminated. 13. This contract is non-assignable and non-transferable. In the event that the Mare is sold or otherwise disposed of prior to the birth of the foal, the "Live Foal Guarantee" (#9) will no longer be valid. 14. Signer represents s/he is owner/lessee of the above named Mare and agrees to indemnify, defend and hold harmless the Stallion Owner in the event the ownership or authorization of the below signed customer is disputed. This contract, with the attached Addendum, represents the entire agreement between the parties. No other agreement or promises, verbal or implied, are involved unless specifically stated in this written contract or another written agreement between parties. In the event that Stallion Owner incurs attorney’s fees and/or legal costs in securing or protecting any right available to Stallion Owner under this contract, or under the laws of the Province of Saskatchewan, Mare Owner hereby agrees to pay said attorney’s fees and legal costs. This agreement shall be governed by the laws of the Province of Saskatchewan and venue shall be in Saskatoon, Saskatchewan.
