OVERVIEW:
The Maryland State Lottery Agency (Lottery) is giving Lottery players two second chances - one to win a Deal or No Deal™ Experience Grand Prize trip to Hollywood/Los Angeles and one to win a Cash Prize of up to $2,500,000 simply by mailing in non-winning Deal or No Deal™ Scratch-off tickets (Game #742) for entry into the two 2nd Chance Drawings. A “drawing” is any random selection event. Deal or No Deal™ Experience Grand Prize Drawing (“Trip Prize”): Seven (7) entrants will be selected to win a Grand Prize trip to Hollywood/Los Angeles, California and a chance to play Deal or No Deal™ with Howie Mandel. Each of the seven (7) Grand Prizes includes a trip for the winner (“Trip Prizewinner”) and a guest with 5-day, 4-night hotel accommodations, round trip coach airfare from a U.S. International airport to Los Angeles, scheduled ground transfers between the airport and the hotel and studio, and a $5,000 cash prize. One Trip Prizewinner will be randomly selected from among the seven (7) Trip Prizewinners to participate in the non-broadcast (non-televised) produced show. Each of the seven (7) Trip Prizewinners will receive a recorded DVD of the non-broadcast (non-televised) produced show. In Hollywood/Los Angeles, one or more of the seven winners will also be selected to participate in the daily version of the broadcast Deal or No Deal™ television show along with contestants selected from other state lotteries for a chance to win up to $500,000. Entries for the Grand Prize drawing must be received by 10 a.m. March 13, 2009. The drawing date may be subject to change. This is a bonus game. Expected dates of travel will be announced when they are available.
THE LOTTERY IS NOT RESPONSIBLE FOR, AND HAS NO ROLE IN THE DETERMINATION OF WHO WILL BE A CONTESTANT ON ANY DEAL OR NO Deal™ SHOW AND/OR WHO MAY WIN A PRIZE ON ANY DEAL OR NO Deal™ SHOW.
$2,500,000 Cash Prize Drawing (“Cash Prize”): Entries not selected for the Grand Prize, and entries received after the deadline for the Trip Prize and prior to the Cash Prize Drawing deadline will be entered into a Cash Prize 2nd chance drawing where seven (7) names will be randomly selected to receive a $500 cash prize from the Maryland Lottery and to be included in a national drawing for a chance to win an additional cash prize of up to $2,500,000. Entries for the Cash Prize 2nd chance drawing must be received by 10 a.m. September 3, 2009. The drawing date may be subject to change. This is a bonus game and these are bonus prizes. For the Trip Prize: The Lottery will provide winners’ information to MDI Entertainment, LLC (“MDI”) and MDI will provide and pay for: The Trip, including any transportation provided and accommodations and attendance at, and any participation in run-through or broadcast game; run-through (“non-broadcast”) game prize; and prize for attendance at the non-broadcast game. NBC and Endemol USA, Inc. will pay for any broadcast game prizes. For the Cash Prize: The Lottery will pay the $500 cash prize for being selected as one of the seven (7) contestants for the national drawing, but THE LOTTERY IS NOT RESPONSIBLE FOR, AND HAS NO ROLE IN THE DETERMINATION OF WHO WILL WIN the national drawing with winners from other state lotteries for a Cash Prize of $250,000 up to $2,500,000, expected to be held on or about September 15, 2009. MDI will provide the Cash Prize for the national drawing.
HOW TO ENTER:
To enter the 2nd Chance drawings, send any non-winning Deal or No Deal™ non-winning Scratch-off ticket (Game #742) with your name, address (and optionally, phone number and/or email address) on the back to:

Entries may be mailed by placing appropriate postage on the upper right hand corner of the back of the ticket or by mailing the ticket in an envelope no larger than 4-1/2” x 9-1/2” in any direction. All entries must contain a Maryland postmark. No other ticket other than Deal or No Deal™ #742 may be used to enter this drawing. Entries submitted should list one name only or the Lottery will choose which name is the semi-finalist. Each mailing will be considered as one entry, even if more than one Deal or No Deal™ (#742) Scratch-off ticket is enclosed. To enter this second chance contest you must be 18 years or older, and you must be a legal resident of the United States. You may enter as often as you like; however, for all 14 prizes, (the seven (7) Trip Prizes and the seven (7) Cash Prizes): 1) you may only win once, 2) only one winner per household (anyone living at the same address) may be selected as a winner, and 3) no other members of a winner’s immediate family (spouse, child, parent or sibling) may be selected as a winner. These second chance contests are governed by these Official Rules and Conditions of Eligibility. The Lottery reserves the right to reschedule any times and dates regarding this second chance contest, if necessary, without advance notice. In the event the Lottery receives an excessive number of entries for these 2nd Chance Drawings, the Lottery reserves the right to conduct one or more prepromotion random drawing(s) to determine the final entries for the drawings.
CLAIMING:
All winners will be notified by the Lottery following the drawings via telephone and/or certified mail to confirm eligibility. In the event a winner cannot be confirmed or qualified or has not submitted required claiming documentation by March 23, 2009 for the Trip Prize, or September 12, 2009 for the Cash Prize, the Lottery may select an alternate winner. Drawings may be televised. Winners, at the time they are notified, will be advised of claiming procedures and deadlines. All winners of the Trip Prize and Cash Prize Drawings must claim their prize in person at the Maryland Lottery Baltimore Customer Resource Center, Montgomery Park Business Center, 1800 Washington Boulevard, Suite 330, Baltimore, MD 21230. Winners must complete a Lottery Claim Form, including Social Security number (SSN), and must provide proof of their SSN and must furnish photo I.D. proof of being at least 18 years of age. The Lottery will withhold applicable child support arrearages, criminal restitution owed and other outstanding debts from the $500 cash prize awarded by the Lottery in the Cash Prize Drawing. Any prizes, including prizes won during games on the Trip Prize, may be subject to federal and appropriate state income tax withholding and any other required withholdings. Further amounts may be owed. The payment of tax withholdings by an entity other than the winner could result in additional Federal and State tax liability being due from the winner. Winners are responsible for all taxes, including income taxes. The entities responsible for providing the various prizes will provide appropriate tax forms. You may receive multiple W-2G or other tax forms. Trip Prize: Once Trip Prizewinners have claimed their prize and been verified, the information will be provided to MDI. MDI will contact the seven (7) Prizewinners and provide them with tickets, an itinerary for the trip and other necessary information. The Trip Prize is not transferable or assignable without the express written consent of the Lottery. The Trip includes one double occupancy room at a first-class or best accommodations hotel in Hollywood/Los Angeles, California for four (4) nights during the specified Deal or No Deal™ daily show tapings. To check into the hotel, each Trip Prizewinner, designee(s), proxy or guest must have a valid credit card or shall be required to post a cash deposit for incidentals.
If air travel is required for the Trip Prizewinner and guest, airfare for two (1) round trip coach class tickets from any U.S. International airport to Los Angeles, California shall be booked on a major airline, as defined by the Federal Aviation Administration. The Trip Prize does not include: Mileage, insurance, gratuities, meals, parking fees, departure fees, excess baggage fees, alcoholic beverages (other than those served without charge at any reception and/or party), any items not expressly specified, and personal expenses such as telephone calls, valet service, laundry and the like, as well as (unless incurred by an act or omission of MDI, NBC or Endemol) revision or cancellation fees which may be charged by the hotel or other suppliers. Trip Prizewinners are responsible for payment of these amounts. In the event that a Trip Prizewinner is unable to attend the Trip due to unforeseen and reasonable circumstances, the Lottery or MDI may appoint a proxy to play in any event for him or her. The Trip Prizewinner shall receive any cash prize won by the proxy. Unless otherwise specified by the Lottery, if the Trip Prizewinner is traveling via air and fails to arrive at the designated time of departure (excluding flight delay), the Prizewinner is responsible for being present at the designated non-broadcast show location at his/her own expense, or the balance of the Trip Prize shall be forfeited. Unless otherwise specified by the Lottery, if the Trip Prizewinner fails to check in to the hotel, the balance of the Trip Prize shall be forfeited. The non-broadcast games are not scheduled for television broadcast, but a network may choose to broadcast the non-broadcast shows or portions thereof. Trip Prizewinners hereby indemnify and hold harmless the Lottery for either eventuality and agree to sign any and all waivers required by the Lottery, MDI, Endemol, NBC, or any other network. Shows taped for the broadcast Deal or No Deal™ television show will be scheduled for television broadcast. Players should understand that air travel and television show taping dates, production, and airing, as well as recording equipment, are subject to forces beyond the control of the Lottery and MDI and therefore the Lottery and MDI shall not be subject to any liability as a result of the inability to fulfill the prizes or any portion thereof, including broadcast of any show that includes an image of or reference to any Trip Prizewinner. Players further understand and agree that the Lottery reserves the right in its sole discretion a) to substitute a prize of equivalent value for the Trip Prize in the event that circumstances warrant this change (estimated cash value of the Trip Prize is twelve thousand five hundred dollars [$12,500]), or b) to reschedule the fulfillment of the Trip Prize. Winners may not request a substitute or equivalent prize. Cash Prize: Similarly, forces beyond the control of the Lottery govern MDI, and therefore the Lottery shall not be liable if the national drawing portion of the Cash Prize is not fulfilled. Cash Prize is not transferable or assignable. Trip and Cash Prize: All winners and guests a) agree to release and hold harmless the Maryland State Lottery Agency, Maryland State Lottery Commission, the State of Maryland and their agents, employees, representatives, successors, and assigns from any liability arising out of participation in this second chance contest or drawings, and/or out of the use, misuse, and/or acceptance of a prize, from any breach of any obligation(s) by any third party(s), and/or from any injury, death, or damage resulting from participation in this second chance contest, its drawings, and/or prizes; and b) must accept and be bound by the terms and conditions of these Official Rules and Conditions of Eligibility and all other applicable rules, regulations and statutes and must sign waivers and releases of all liability. Trip Prizewinners must retain both their Claim form and instructions for obtaining their tickets, and follow the instructions to confirm their airline travel and any submissions deadlines. Travelers (Trip Prizewinners and guests) will be bound by and agree to abide by terms and conditions on the airplane ticket and ticket jacket, airline rules, and all laws governing the relevant travel. Trip Prizewinners should understand that air travel is subject to forces beyond the control of the Lottery. All rules, terms, and conditions on the Deal or No Deal™ lottery ticket apply. Except as provided above, Winner is responsible for payment of all taxes including income taxes. The Maryland Lottery reserves the right to change any dates and times as necessary without advance notice. The Lottery Director reserves the right to modify any rule contained herein when circumstances warrant, and when it is in the best interests of the Lottery to do so.
OTHER OFFICIAL GAME RULES:
By submitting an entry for these second chance drawings, you consent and agree to the following: a) to publicity, b) giving your permission to appear on air in the broadcast version of Deal or No Deal™, and even with regard to Deal or No Deal™ games not scheduled to be broadcast, c) to have your name, photo, and/or hometown aired on TV, radio, and other media and in other publicity, as well as used in Lottery or Deal or no Deal™ publications and advertisements, Lottery mailings, and/or other Lottery-related activities including mailing lists, d) to participate in a check presentation ceremony as determined by the Lottery, e) to sign news and press release forms, and f) to sign waivers and releases of all liability. Employees of the Lottery’s vendors, including its advertising agencies, their subcontractors, or the Lottery’s broadcast station, WBAL-TV, and all vendors related to this contest and/or any member of their immediate family living in the same residence are prohibited from participating in these second chance drawings. Maryland law prohibits an officer or employee of the Maryland State Lottery Agency, or any individual who is a spouse, child, parent, or sibling of an officer or employee of the Maryland State Lottery Agency who resides in the same household as the officer or employee, from participating in these second chance drawings. Receipt of an entry will not be confirmed or returned. Once submitted, all entries become the property of the Lottery. At the conclusion of each drawing, all non-selected entries may be destroyed or used by the Lottery. Participants release and hold harmless the Maryland State Lottery Agency, the Maryland State Lottery Commission, the State of Maryland and their members, agents, employees, and representatives (“MSLA”), from any liability arising out of participation in these second chance contests, or out of the use, misuse, or acceptance of a prize. MSLA is not responsible for any negligence of any person, or any claim, liability, injury, property loss, or other damage of or to participants, players, contestants, travelers, winners and/or their family members or guests arising from or in connection with either the use or misuse of prizes awarded or with participation in these second chance drawings or the contest ,or in any event or occurrence related to these second chance drawings or the contest. The Lottery does not support or endorse any company by providing prizes from or about them in this contest or these drawings. The probability of winning any Deal or No Deal™ 2nd Chance Drawing will be determined by the number of valid entries received. The Lottery is not responsible for names announced or published in error. By participating in these 2nd Chance Drawings, you agree to be bound by these Official Rules and Conditions of Eligibility, in addition to any applicable laws and regulations including the Maryland State Lottery Law and Regulations. The Lottery will make all determinations concerning the validity of entries, winners, and other decisions required under this second chance contest. The decision of the Lottery shall be final. The Lottery reserves the right to modify, without notice, any rule and any times and dates when circumstances warrant, and when it is in the best interest of the Lottery to do so. Prizes cannot be transferred or assigned.
