Dear Senator Fitch and Committee Members:

This report is being issued in response to numerous inquiries concerning
Regional Solid Waste Management Districts. These inquiries have primarily
concerned the districts’ organization and functions, sources of funds, and uses of
funds.

In order to establish a perspective in this matter, we contacted Arkansas’ border
states to determine how solid waste was managed in those states. Varying
organizational structures and fees were found. For example, Mississippi, Missouri,
and Tennessee have provisions for regional solid waste management, but unlike
Arkansas, membership by counties is optional. A brief profile of solid waste
management in bordering states is presented at Schedule 4.

Unless otherwise noted, comparisons of revenue and expenditure amounts
contained in this report were derived from the latest audit report available from
each district. Financial data from these audit reports is summarized at Schedule 1.

                      ORGANIZATION AND FUNCTIONS

Act 870 of 1989, as amended, created Regional Solid Waste Management
Districts (RSWMD) to assess and plan for solid waste needs in Arkansas. A
Regional Solid Waste Management Board governs each district. Each board is
charged with continuously evaluating the solid waste needs of their district and
formulating plans for providing adequate solid waste management.

Currently there are sixteen (16) RSWMD. The boards are given broad authority
and powers in providing facilities for solid waste disposal including the power of
eminent domain and the authority to incur debt for the construction and purchase
of landfill facilities. Some of the boards have chosen to have their programs
administered by other governmental or quasi-governmental entities, while other
districts operate as independent entities.
                               SOURCES OF FUNDS

The districts are primarily funded through grants and fees. Regional Solid Waste
Management Boards have the authority to set their own fees, and therefore, fees
vary greatly from district to district. The fees can be generally categorized as
hauling fees, solid waste disposal fees, and waste tire fees. A listing of fees
charged by district is presented at Schedule 2. The only fee type charged by all
districts is a licensing fee for any person(s) engaging in the business of hauling
solid waste; however, even these fees are not comparable from district to district.
Some districts license haulers based on hauling capacities expressed in cubic
yards and some license by hauling capacities expressed by tonnage. Others
license on a per vehicle basis without regard to hauling capacity.

During the year ended June 30, 1999, the Arkansas Department of
Environmental Quality (ADEQ) distributed $6,980,024.20 of state grant funds to
the districts. Also, ADEQ distributed $156,902.35 to Four-County RSWMD,
Northwest RSWMD, and Pulaski County RSWMD from fees collected in those
districts on the sale of large truck tires for total distributions of $7,136,926.55.
These distributions by category are presented at Schedule 3.

                                  USES OF FUNDS

Regional solid waste management districts are authorized to employ any
individuals deemed necessary. They may maintain offices and enter into
contracts and agreements with private entities. They are also authorized to own
and operate landfill facilities. Only three (3) districts have elected to acquire and
operate their own landfill facilities: Northeast RSWMD, Saline County RSWMD,
and Upper-Southwest RSWMD. All were financed through a bond issue as
authorized by Ark. Code Ann. 8-6-801 et seq. State law requires districts to
adopt county purchasing procedures and secure an annual financial audit.

                   CONCLUSIONS AND RECOMMENDATIONS

State law gives regional solid waste management boards broad guidelines for
operation. They may be organizationally independent or operate under the
umbrella of another entity. They may set and collect fees as they see fit. They
can incur debt and acquire or construct facilities. Therefore, comparisons among
districts are difficult. A table identifying certain characteristics of the districts is
provided at Schedule 5.

The Arkansas Department of Environmental Quality has limited oversight
authority for the RSWMD. Each district is required to submit a regional needs
assessment to ADEQ for approval by the Director. These assessments must be
updated every four (4) years if the district contains an active landfill or annually if
the district does not contain an active landfill. Further oversight is provided by
ADEQ through the monitoring of compliance requirements applicable to grant
funds distributed by ADEQ to the RSWMD.
As previously noted, a financial audit is required to be submitted after the end of
the RSWMD’ fiscal year. However, time requirements for submission of these
audits has not been set. We recommend ADEQ set a reasonable time limit for
submission of the required audits and closely monitor their receipt to insure all
districts are audited in a timely manner.

The Mississippi Co. RSWMD’ financial transactions were not included in the audit
of Mississippi County, the fiscal administrator for the District, or in a separate
audit of the District. We recommend that the District’s fiscal administrator
segregate all revenues and expenditures of the District and that the District
contract for an audit of their financial position and operations. The District
reported that a separate audit of the district has been contracted for, beginning
with the 1998 calendar year.

I. BACKGROUND

  In 1989, some areas of the State were facing solid waste capacity shortages
  with others experiencing a surplus of capacity. A proposal by a private
  company to import out-of-state waste for disposal in Arkansas further
  inflamed an issue that had been smoldering for quite some time. As a result,
  Act 870 of 1989 created Regional Solid Waste Planning Districts to assess
  and plan for solid waste needs in Arkansas. These districts corresponded
  with the boundaries of the eight (8) Planning and Development Districts
  established pursuant to Ark. Code Ann. 14-166-202. The Regional Solid
  Waste Planning Districts were renamed Regional Solid Waste Management
  Districts by Act 752 of 1991. This act also provided for the creation of new
  districts by the Arkansas Pollution Control and Ecology Commission.
  Currently, there are sixteen (16) Regional Solid Waste Management Districts
  as shown in Exhibit I.

II. ORGANIZATION AND FUNCTIONS

  A regional solid waste management board governs each regional solid waste
  management district. Each board must have a minimum of five (5) members.
  The county judge of each county and the mayor of each city with a population
  in excess of 2,000 within the district boundaries will be included in the board
  membership. If the number of members serving due to their positions as
  county judge or mayor does not meet the minimum number of five (5)
  members required, additional members necessary shall be appointed by
  mutual agreement of the other board members and shall represent the
  general public within the district. The Arkansas Code requires the boards to
  adopt rules and regulation pursuant to the Arkansas Administrative
  Procedures Act, which are reasonably necessary to assure public notice and
  participation in any findings or rulings of the boards and to administer the
  duties of the boards. Some of the boards have chosen to have their
  programs administered by other governmental or quasi-governmental entities
  while other districts operate as independent entities.

  The districts are primarily responsible for providing solid waste management
  systems for their districts. Each regional solid waste management board is
  charged with evaluating on a continuous basis the solid waste needs of their
  district and formulating plans for providing adequate solid waste
  management. A regional needs assessment must be filed with the Arkansas
  Department of Environmental Quality for approval by the Department’s
  Director. These assessments must be updated every four (4) years if the
  district contains an active landfill or annually if the district does not contain an
  active landfill. Southwest Central RSWMD is currently the only district without
  an active landfill within its borders. While ADEQ permits all landfill facilities,
  the districts issue or deny certificates of need for all applicants except for
  permits for private industry landfills. Districts must also authorize the receipt
  of solid waste from or the disposal of solid waste in another district.

III. FEES AND REVENUES

  All districts receive distributions from the Arkansas Department of
  Environmental Quality (ADEQ) in the form of grants. There are four (4) grant
  types: waste tire abatement grants, waste tire management grants, illegal
  dump grants, and solid waste management and recycling grants. Three (3)
  districts (Four-County RSWMD, Northwest Arkansas RSWMD, and Pulaski
  County RSWMD) also receive a distribution from ADEQ for additional fees
  charged within those districts for collection of large truck tire waste. During
  the year ended June 30, 1999, ADEQ made distributions to the districts of
  $6,980,024.20 in state grant funds and $156,902.35 in fees collected on the
  sale of large truck tires, for total distributions of $7,136,926.55. The
  percentage of total distributions to each district is reflected in Exhibit II.

The districts may fix, charge, and collect fees, rents, and charges for the
handling of solid waste. Although a service fee may be levied on each
residence or business for which the board makes collection or disposal
services available, no such fees were noted. While different fee types are
collected from district to district, most can be generally categorized as solid
waste hauling fees, solid waste disposal fees, and waste tire disposal fees.
One exception is a $.50 per capita fee assessed by Four-County RSWMD on
each governmental entity with representation on the Board. Fees charged by
all districts are presented at Schedule 2.

The only fee type charged by all districts is a licensing fee for any person who
engages in the business of hauling solid waste. Even though all solid waste
haulers must obtain a license from their respective regional solid waste
management board, these fees are not comparable from district to district.
Ark. Code Ann. 8-6-721(c) requires the Arkansas Pollution Control and
Ecology Commission to set classifications of haulers based on the size and
nature of the loads transported. However, the Commission only differentiates
between haulers of nonhazardous solid waste (Type I) and haulers of process
and special materials waste (Type II), with no reference to load size in the
Commission’s regulations. Only Type I hauler fees were reported by the
districts. Some boards set license fees based on vehicle capacity, while
others charge a per vehicle fee. These fees vary greatly from district to

  district even when applied on the same basis. For example: Craighead
  County RSWMD charges an annual fee of $25 for each vehicle with a
  capacity greater than or equal to 5 cubic yards. Pulaski County charges $100
  per vehicle with the same capacity for the first 2 vehicles and $50 per vehicle
  thereafter with a maximum of $1,000 per company.

  Northeast RSWMD, Saline County RSWMD, and Upper-Southwest RSWMD
  own and operate their own landfills and receive the majority of their funds
  from tipping fees. Pulaski County RSWMD also relies heavily on fee
  revenues. The percentage of revenue by type received by each district
  according to their latest audit report is illustrated in Exhibit III. An audit of
  Mississippi County RSWMD was not available and that District has been
  excluded from this exhibit.

IV. USES OF FUNDS

  Regional Solid Waste Management Districts are authorized to own, acquire,
  construct, reconstruct, extend, equip, improve, operate, maintain, sell, lease,
  contract concerning, or otherwise deal in facilities of any nature necessary or
  desirable for the handling of solid waste. Except as expressly stated, Ark.
  Code Ann. 8-6-802 provides that districts are not required to comply with any

other law pertaining to the acquisition and construction of public works or
facilities including those regarding public bidding, payment of prevailing
wages, and the transfer or exchange of title to real or personal property. Any
district is authorized to acquire needed lands by condemnation proceedings
under the power of eminent domain. However, while a district may elect to
acquire solid waste management systems owned or controlled by
municipalities, counties, improvement districts, or sanitation authorities, it is
not required by law. If a local government authority continues to provide
services related to solid waste management, the authority to levy and collect
fees and charges is retained. The provision of these services must conform
to the district solid waste management plan. Only three (3) districts have
elected to acquire and operate their own landfill facilities: Northeast RSWMD,
Saline County RSWMD, and Upper-Southwest RSWMD. All were financed
through a bond issue as authorized by Ark. Code Ann. 8-6-801 et seq. The
districts are also authorized to obtain loans from the Arkansas Soil and Water
Conservation Commission (ASWCC).             However, according to ASWCC
representatives, no RSWMD has received such financing to date.

An annual financial audit is required for each district with copies of such audit
reports being filed with ADEQ and the Division of Legislative Audit. Separate
audits are not required for those solid waste management funds audited in
conjunction with a single audit consistent with Governmental Auditing and
Reporting Standards. The Central Arkansas RSWMD and the East Arkansas
RSWMD are included in the audits of their respective planning and
development districts and Sebastian Country RSWMD is included in the audit
of the City of Ft. Smith. Mississippi County RSWMD submitted an audit of
Mississippi County as fulfillment of their audit requirements. However, the
audit of Mississippi County submitted is not a single audit and, therefore, a
separate audit is required. Mississippi County RSWMD states that a separate
audit in accordance with Ark. Code Ann. 8-6-704(c) has been contracted for,
beginning with the 1998 calendar year. Failure to provide an audit report
prohibits the future distribution of grants from ADEQ unless authorized by the
director. The law does not specify a time frame for the completion and
submission of an audit and, to date, no grant funds have been withheld for
failure to submit an audit.

RSWMD must adopt county purchasing procedures. However, they may
employ such engineers, architects, attorneys, financial advisors and other
consultants deemed necessary by their board. They may maintain offices and
enter into contracts and agreements with private entities for provision of
services. Pulaski County RSWMD has such an agreement for hauling
services in the City of Little Rock. Such broad authorization for the uses of
funds does not provide for consistency among districts. A comparison of
expenditures by district is included in Schedule 1.

                 REGIONAL SOLID WASTE MANGEMENT DISTRICT
                  SUMMARY OF SOLID WASTE MANAGEMENT IN
                         ARKANSAS BORDER STATES

              Louisiana Department of Environmental Quality - The State does not have regional
              districts. All planning and administration is done at the State level. The State
              Legislature establishes fees that are charged uniformly throughout the State. Currently
Louisiana     there are landfill construction and operating permit fees as well as annual maintenance
              fees based upon the tonnage received each year by the facility. The State charges no
              tipping fees above what is collected by the landfill. Transporters are charged a one-time
              registration fee of $100 plus $25 per truck.
              Mississippi Department of Environmental Quality - Counties are allowed to manage solid
              waste independently or group themselves into organizations known as Authorities. Each
              county/authority must submit an ongoing 20-year management plan to the State for
Mississippi   approval. The county/authority is allowed to set fees within their own district. The State
              charges a $1 per ton tipping fee if the local county/authority charges a fee. Some counties
              do not charge their citizens a tipping fee, and therefore the State does not collect the $1
              per ton fee on that transaction.
              Missouri Department of Natural Resources - The State is divided into twenty (20) Solid
              Waste Management Districts. Counties within each district may join their district if they
              choose. They may not, however, join another district. The boards are made up of
              elected officials with a few exceptions as required by State law. Each district may assess
              fees within their district. However, none have done so because State law requires such a
 Missouri     fee to be approved within each voting ward in each of the local governments within the
              district. Some of the districts do require their municipalities to pay dues to help cover
              administrative costs. The State charges no hauling fees but does require a tipping fee in
              the amount of approximately $2.00 per ton. This amount continually changes based
              upon the rate of inflation.
              Oklahoma Department of Environmental Quality - Counties are required to submit Solid
              Waste Management Plans in accordance with State law. The counties are not prohibited
Oklahoma      from assessing their own fees within their districts but none are known to be doing so
              currently. The State does not charge a hauling fee, but does assess a $1.50 per ton
              tipping fee on a declining scale to $1.25 per ton.
              Tennessee Department of Environment and Conservation - Each county is responsible for
              meeting State regulations for planning and administering solid waste needs within their
              county. Counties are allowed to join with other counties in forming larger Waste
Tennessee     Management Districts. There are no State requirements regarding the makeup of these
              districts. The State charges an annual $50 per vehicle hauling fee and an $.80 per ton
              tipping fee. The counties are not allowed to assess additional fees on privately owned
              landfills within their districts.
              Texas Natural Resource Conservation Commission – Solid waste is managed at the State
  Texas       level. No permit fees are charged for haulers. A $1.25 per ton tipping fee is remitted to
              the State by all landfills.
