									                            Memorandum of Understanding


Memorandum of understanding and cooperation between the Georgian Public Broadcaster
and Political Parties and Unions participating in the Parliamentary Elections to be held on
May 21, 2008.

We, undersigned, fully aware of the importance of the Parliamentary Elections and
its impact in the establishing democratic values in Georgia and Georgia’s integration
into the Euro Atlantic Structures of Georgia, declare to respect and fully accomplish
obligations under the Constitution and legislation of Georgia.

Have agreed as follows:

   1. During the Pre-election Period in compliance with the Georgian Law, the Georgian
      Public Broadcaster shall cover all activities of Political Parties and Political Unions
      participating in the Parliamentary Elections, in a balanced, impartial and objective
      way and further undertakes following obligations – From April 21, 2008 until the day
      of announcement of the final results of the election, or in the event of challenge of the
      election results, until and including the day of announcement of final decision of the
      court.

   1.1 In framework of news editions shall be created the “Election Chronicle” and the “Official
       Chronicle” headings. Except in the event of covering extraordinary situations news editions
       (including foreign language editions) shall start with the “Election Chronicle”. The “Election
       Chronicle” shall present all election subjects, carrying out newsworthy activities for that
       moment (such as: briefing, announcements, meetings with voters etc.). Each edition of The
       “Election Chronicle” shall cover election activities of that day by producing slots with
       duration from 1 to 1,5 minutes or transmit live, with duration from 2 to 3 minutes. Live
       transmission of election activities shall be provided by the Georgian Public Broadcaster in
       accordance of its technical possibilities (including regions).

   1.2 In case of simultaneous election activities (Election activities of different election subjects
       held simultaneously and the Georgian Public Broadcaster does not have technical
       possibilities to transmit live all of them) the Georgian Public Broadcaster shall not give
       priority to any of election subjects and broadcast them in the nearest news edition as a
       recorded version (see 1.1). The “Election Chronicle” shall constitute no less than 30% of
       total duration of daily news editions and the “Official Chronicle” shall constitute no more than
       25% of total duration of daily news editions.

   1.3 From April 21 to May 20, 2008 the Georgian Public Broadcaster shall regularly put on the
       evening air TV debates between election subjects and Pre-election Presentations. The rival
       order at the TV debates shall be determined by the draw and shall be aired live. Each
       undersigned election parties shall take part in the draw. Rivals of the TV debates shall be
       granted with equal time,
1.4 All public and political organizations shall be permitted to control the compliance of
    obligations under the present memorandum by the Georgian Public Broadcaster. The
    Georgian Public broadcaster shall be tolerance while monitoring groups from the OSCE
    Mission and other international organizations. Consequently, the Georgian Public
    Broadcaster shall provide all interested parties with recorded versions of news editions and
    TV debates. In addition, the Georgian Public Broadcaster shall broadcast weekly public
    discussions in order to evaluate the accomplishment of obligations and results.

1.5 In the event of violation of present provisions by the Georgian Public Broadcaster, within 2
   days Board of Trustees shall make public apology and instruct the Director General to
   correct mistakes. In the event of further derogation Board of Trustees shall raise the issue of
   professional responsibility of the head of news service and as a last resort responsibility of
   the General Director, upon which public announcement shall be made.

2. Obligations of Political Parties and Unions participating in the Parliamentary
   Elections to be held on May 21, 2008

1.1 Political Parties and Unions shall cooperate with the Georgian Public Broadcaster in
    accordance with provisions of the present Memorandum, in particular under the article 1.3;
    shall be presented in all listed activities.

2.2 Political Parties and Unions shall provide the Georgian Public Broadcaster with their next
    week activity schedule in advance. Daily, before 20:00 Political Parties and Unions shall
    provide news service of the Georgian Public Broadcaster with their agreed activity schedule
    of the next day. In the event of breach of present obligation, the Georgian Public
    Broadcaster shall not be responsible to cover such activities.

3.3 Political Parties and Unions shall respect norms of ethics during their appearance at the
    Georgian Public Broadcaster.

4.4 In the event of breach of obligations by the Georgian Public Broadcaster, Political Parties
    and Unions, within two days, shall present their claims in writing and abstain from public
    criticism, before the resolution of issues as per 1.4.

5.5 During their activities, Political Parties and Unions shall prevent attack against employees of
    the Georgian Public Broadcaster. In the event of confirmation of such facts Political Parties
    and Political Unions shall make public apology and compensate moral and material
    damages.
