Pennsylvania DEP’s Five-Year Plan for TMDL Development Developed by the Bureau of Water Supply and Wastewater Management Updated July 29, 2002 • The number of TMDLs that are expected to be completed within the specified time frames shown in the table have been updated based on our most current projections. Introduction During the past several years, the Department of Environmental Protection has focused on watershed management techniques and processes that take a comprehensive approach to water pollution control to address polluted runoff or nonpoint source pollution as well as point sources of pollution. Using the watershed approach requires selection or definition of watershed size and begins with a comprehensive assessment of water quality problems in the watershed. After water quality problems are identified, a planning process occurs to develop strategies that can successfully address and correct water pollution problems in the watershed. Pennsylvania is using this process together with federal Clean Water Act requirements for establishing total maximum pollutant loadings or TMDLs to clean up polluted streams so that they meet water quality standards. Water quality standards are the combination of water uses, such as water supply, recreation, and aquatic life, to be protected and the water quality criteria necessary to protect them. TMDLs can be considered to be a watershed budget for pollutants, representing the total amount of pollutants that can be assimilated by a stream without causing impairment or water standards to be exceeded. The pollutant allocations resulting from the TMDL process constitute the amount of pollutants that can be discharged into a waterway from each category. The TMDL does not specify how discharges must attain particular load reduction. In an April 7, 1997 MOU with EPA the Department agreed to a 12year schedule to develop TMDLs for impaired streams listed on the 1996 CWA Section 303(d) list. Over the past two years the Office of Water Management has met those TMDL goals. Concurrently, Central Office staff of Water Management is developing methodologies, processes, and computer models to establish TMDLs on a broader scale by a wide range of staff. In addition, several contracted TMDL initiatives have been undertaken in various parts of the Commonwealth. In conjunction with managing water resources through a watershed-based approach, the Department’s TMDL development is being carried out by the Regional and District Mining Offices with oversight and coordination from Central Office. The following report presents a plan to detail this objective. It identifies specific impaired waterbody segments from the 1996 Section 303(d) list where TMDLs must be established. This plan is a multi-year commitment of Department resources. Although the general elements of the plan will remain valid over time, it will by necessity be a fluid document, ever changing in response to new information, better tools and emerging priorities. TMDL Projection Report Table 1 outlines DEP's total maximum daily load (TMDL) commitments contained in the consent decree between the Plaintiffs and EPA. The number of segments that must be completed in each year are identified along with the number of TMDLs completed. Subsequent tables display a specific schedule of milestones for TMDL completion, and specific segments that, if addressed, will meet our submittal requirements through the year 2007. The final table denotes TMDLs that have been completed to date. Each section contains a narrative and a table that provides a possible solution for meeting submittal requirements. 1 It should be noted that the 1996 303(d) list may change as new stream surveys are completed. It is possible that some of the historic listings (prior to 1997, the start of the unassessed waters program) will no longer be valid, or the source and cause of the impairment may be updated by new data. These streams were selected by the District Mining Offices and BAMR Field Offices after evaluation of the 1998 303(d) list. The proposed list may be further refined by the Mineral Resources Deputate. The Division of Water Quality Assessment and Standards will provide modeling support. The Division will act as a facilitator and an intermediary with EPA for all TMDL-related activities and will package and submit TMDLs to EPA. 5 Table 6.
