The Nevada State Board of Massage Therapists (NSBMT) is scheduled to hold its regularly
scheduled meeting;

Pursuant to NRS 241.030 The Board may close a meeting to consider the character, alleged
misconduct, competence or physical or mental health of a person.

      Due to the schedule change and time restraints items may be tabled.

3.    Application Review

       a.   Review application of Mindy Dimitri for approval, denial or other administrative
            action pursuant to Assembly Bill No. 250 Section 56.
                 Lisa Cooper stated that Mindy Dimitri had a Douglas County license that expired
                 on 9/21/01 and is requesting to be grandfathered. Ms. Dimitri made an opening
                 statement. Ms. Dimitri stated the expiration was due to an oversight.
                 Motion: Michelle Viesselman-Denied license based on Assembly Bill No. 250
                 Section 56.

         b.   Review application of Paul D. Haber for approval, denial or other administrative action
              pursuant to NRS 640C.700.
                  Paul D. Haber-Present. Paul D. Haber had a felony DUI with bodily harm. Paul D.
                  Haber made an opening statement. Michelle Viesselman believed she knew Mr.
                  Haber and recused herself from the review. Detective Stacy Rodd proceeded to
                  ask Mr. Haber about the charges. Mr. Haber stated he did finish the alcohol rehab
                  program before he was discharged.
                  Motion: Paula Spradling-Approval to grant license

         c.   Review application of Lynn Wessel for approval, denial or other administrative action
              pursuant to NRS 640C.700.
                  Lynn Wessel-Present. Lisa Cooper stated Lynn Wessel is requesting Portfolio
                  Review and is asking for a license and to review her employment as going towards
                  her education. Billie Shea proceeded to ask Ms. Wessel about her history as a
                  massage therapist. Ms. Wessel worked in St. Thomas as Massage Therapist for
                  seven to eight years. Several board members proceeded to discuss Ms. Wessel’s
                  license, and her education hours. Lisa Cooper stated according to the NRS
                  640C.400.4 (a) and (b) and NAC 394.535; the law does have a reference, but the
                  clause in 640C.400. 4 (a) and (b) allows latitude. Board members continued to
                  discuss and comment on portfolio review and hours of education. Joe Cracraft
                  asked to reference to the law that states The Board does not have to hold the
                  applicant to 500 hours.

         d.   Review application of Yan Li Chen for approval, denial or other administrative action
              pursuant to NRS 640C.700.
                  Yan Li Chen-Present. Attorney- Dwayne Razel
                  Lisa Cooper stated Yan Li Chen was arrested and her record was sealed; Ms.
                  Chen did answer #2 on the application untruthfully but she did not follow through to

         h.   Review application of David R. Silvaggio for approval, denial or other administrative
              action pursuant to NRS 640C.700.
                  David R. Silvaggio-Present. Lisa Cooper stated David R. Silvaggio was arrested
                  for obstruction of justice with possession of a firearm and battery domestic violence
                  on 8/7/03. Mr. Silvaggio made an opening statement about his arrest on 8/7/03.
                  Several board members asked about Mr. Silvaggio’s community service,
                  counseling taken, and the details of the arrest. Christine Hollister, a friend made a
                  character reference on Mr. Silvaggio’s behalf.
                  Motion: Deborah Wenig- Approval to grant license
                  Seconded: Linda White
                  Discussion among board members on a possible modified probation due to history
                  of violence and firearm.
                  Opposed: Paula Spradling and Joe Cracraft
                  Motion not carried

                  2nd Motion: Michelle Viesselman-Approval to grant license with one year probation
                  based on NRS 640C. 700.3 with modified probation terms. Mr. Silvaggio must
                  report to The Board within 48 hours if he has any contact with law enforcement.
                  Mr. Silvaggio must also submit fingerprint criminal background investigation in one
                  year and must notify The Board of any changes of address within 15 days.

                  Note: NRS 640C.700.3
                        3. Has been convicted of a crime involving violence, prostitution or any other
                        sexual offense, a crime involving any type of larceny, a crime relating to a
                        controlled substance, a crime involving any federal or state law or regulation
                        relating to massage therapy or a substantially similar business, or a crime
                        involving moral turpitude within the immediately preceding 10 years.

         i.   Review application of Daniel M. Casolaro for approval, denial or other administrative
              action pursuant to NRS 640C.700.
                  Daniel M. Casolaro-Present. Lisa Cooper stated Daniel M. Casolaro was arrested
                  for domestic violence and battery on 5/17/01 and he did disclose his arrest on his
                  application. Mr. Casolaro made opening statement on his arrest and also stated
                  he attended Safe Nest for his violence. Stacy Rodd stated this was the only arrest
                  that Mr. Casolaro had on record and he plead no contest.

         j.   Review application of Sharon D. Harris for approval, denial or other administrative
              action pursuant to NRS 640C.700.
                   Sharon D. Harris- Present. Lisa Cooper stated Sharon D. Harris was arrested for
                   domestic violence on 3/17/06 and she disclosed the arrest on her application. Ms.
                   Harris made comment on the details of her arrest. Stacy Rodd stated on the arrest

                  that it was dismissed on 7/12/06. Several board members asked Ms. Harris about
                  her arrest.

         k.   Review application of Paula A. Williams for approval, denial or other administrative
              action pursuant to NRS 640C.700.
                  Paula A. Williams-Not Present. Lisa Cooper stated Paula A. Williams had issues
                  with a cross gender massage and was cited for it on 10/25/04. Stacy Rodd stated
                  Ms. Williams did not have her work card at the establishment and was issued
                  citation and it was dismissed on 2/2/05. Ms. Williams has an independent massage
                  therapist license with Healing Touch Massage which expires on 8/31/07. Several
                  board members had a discussion on case and cross gender massage.
                  Motion: Karen Sartell- Approval to grant license with a letter of clarification of
                  cross gender massage restrictions in local jurisdictions.

         l. Review application of Jing Wu for approval, denial or other administrative action
            pursuant to NRS 640C.700.
                 Jing Wu-Present. Attorney- Dwayne Vazelle Interpreter- Jenny Liu
                 Lisa Cooper stated Jing Wu was arrested 8/9/02 and was issued two year
                 probation. Ms. Wu had her record sealed but arrest still showed on her fingerprints.
                 Ms. Wu made an opening statement. Billie Shea proceeded to ask Ms. Wu
                 questions about her education and employment in California. Ms. Wu was
                 practicing massage in Pasadena City and Orange County for a total of four years.
                 Stacy Rodd stated the arrest on 8/9/02 in Santa Ana was dismissed after the
                 probation.

         m. Review application of Karen R. Mabe for approval, denial or other administrative action
            pursuant to NRS 640C.700.
                Karen Mabe-Present.
                Lisa Cooper stated Karen Mabe was arrested for battery, domestic violence,
                obstruction and resisting arrest on 2/2/03. Those charges were amended to
                disturbing the peace. Ms. Mabe made opening statement. Stacy Rodd stated
                there were no other arrests. No other discussion was made.

         n.   Review application of Yin Lai for approval, denial or other administrative action
              pursuant to NRS 640C.700.
                  Yin Lai-Present. Interpreter-Gi Keen Ging. Lisa Cooper stated Yin Lai was
                  arrested on 10/10/04 for solicitation of prostitution, it was amended to jaywalking
                  and she did disclose the arrest on the application. Yin Lai is owner of the Pearl of
                  the Orient. Stacy Rodd stated Ms. Lai had a 2nd citation for no employee list on
                  3/21/06 and plead no contest on 6/21/06 and received a fine of $103.00. Stacy
                  Rodd stated there was documentation that management of Pearl of the Orient is
                  pending change. Lisa Cooper stated paperwork received from City of Las Vegas
                  shows Ms. Lai as the owner of Pearl of the Orient Acupressure and Massage.

         o.   Review application of Yan Liu for approval, denial or other administrative action
              pursuant to NRS 640C.700.
                  Yan Liu-Present. Attorney-Darren Dorsey Interpreter-Alex Young.
                  Lisa Cooper stated Yan Liu was arrested for solicitation of prostitution and unlawful
                  touch on 2/28/06; it was dismissed on 5/12/06. Ms. Liu did disclose the arrest and
                  the record were sealed. Darren Dorsey made opening statement. Stacy Rodd
                  stated Ms. Liu was arrested on 1/18/07 for solicitation of prostitution. CSA
                  examined areas at the establishment and specimen resulted in a positive test. Ms.
                  Liu previously worked at Sun City Spa and Sahara Valley Spa. Ms. Liu currently
                  works at Sakura Massage and Spa.

                  on NRS.640C.700 (9).

         p.   Review application of Hui Mei Hsu for approval, denial or other administrative action
              pursuant to NRS 640C.700.
                  Hui Mei Hsu-Present. Lisa Cooper stated Hui Mei Hsu was arrested for solicitation
                  of prostitution at Ocean Massage on 2/15/01 and found guilty 10/25/01. Ms. Hsu
                  was cited on 3/10/06 for no display of license and cited on 4/6/06 for having no
                  work card. Ms. Hsu currently has a temporary license and works at Nature Care.
                  Stacy Rodd commented there is a lot of previous activity (three arrests in the last
                  six months) at Nature Care.

                        (c) Massaged, touched or applied any instrument to the breasts of the
                        person, unless the person has signed a written consent form provided by the
                        Board

                        9. Has, in the judgment of the Board, engaged in unethical or unprofessional
                        conduct as it relates to the practice of massage therapy.

         q.   Review application of Xiao-Qing Tang for approval, denial or other administrative action
              pursuant to NRS 640C.700.
                  Xiao-Qing Tang-Present. Attorney-Richard Shawn Felt. Interpreter-Joyce Song.
                  Lisa Cooper stated Xiao-Qing Tang was arrested for solicitation of prostitution on
                  11/18/05 and on 11/16/06 she was arrested for solicitation of prostitution, operating
                  requirements and unlawful touch. Ms. Tang did disclose all her arrests on her
                  application. Stacy Rodd stated both arrests were dismissed and the court
                  mandated Ms. Tang take AIDS counseling and to stay out of trouble for 90 days.
                  Xiao-Qing Tang is currently working at the Oriental Health Center

         r.   Review application of Pi Hua Wu for approval, denial or other administrative action
              pursuant to NRS 640C.700.
                  Pi Hua Wu-Present. Attorney-Scott Holper. Interpreter-Jenny Liu
                  Lisa Cooper stated Pi Hua Wu was arrested on 5/9/05 in Los Angeles, California.
                   Ms. Wu stated the arrest was dismissed. Mr. Holper made opening statement.
                  The details of the arrest cannot be confirmed due to arrest being out of state. Wu
                  was licensed in North Las Vegas in 3/19/07. Billie Shea confirmed with Lisa
                  Cooper that North Las Vegas runs a background check and Ms. Wu’s North Las
                  Vegas license was current. Stacy Rodd stated City of Las Vegas denied her
                  application and is pending on results of this case. Stacy Rodd stated the arrest in
                  California was dismissed due to insufficient information. Mr. Holper stated Ms. Wu
                  is currently working as an independent contractor and she will be working at Desert
                  Inn Spa pending the result of this case.

         s.    Review application of Jie Tian for approval, denial or other administrative action
               pursuant to NRS 640C.700.
                   Jie Tian-Present. Lisa Cooper stated Jie Tian was arrested on 2/9/06 in California
                   penal code of 237A.2. Stacy Rodd stated Ms. Tian was arrested for solicitation of
                   prostitution and the case was dismissed. Billie Shea asked Ms. Tian if AZ license
                   was in good standing. Ms. Tian stated yes. Ms. Tian currently has been licensed
                   since 4/07. Ms. Tian has multiple licenses in NV, AZ, AK, and FL. Several board
                   members discussed the current status, location, and dates of the multiple licenses.
                   Motion: Deborah Wenig-Approval of license upon providing update information on
                   all current licenses.

          t.   Review application of Hong Mooney for approval, denial or other administrative action
               pursuant to NRS 640C.700.
                   Hong Mooney-Present. Lisa Cooper stated Hong Mooney was arrested on11/1/05
                   for solicitation of prostitution in Phoenix, AZ and the arrest was dismissed. Metro
                   ran fingerprints and they came back negative. Ms. Mooney has an application
                   pending with Nature Spa in Lovelock, NV for a business license. Ms. Mooney had
                   an arrest for solicitation of prostitution on 9/2/05 also in Phoenix, AZ and it was
                   also dismissed. Ms. Mooney is currently working as a Travel Agent. Billie Shea
                   proceeded to ask Ms. Mooney questions on her past employment. Board
                   members proceeded to discuss possible motion.
                   Motion: Deborah Wenig-Approval to grant license with one year probation based
                   on NRS 640C. 700.1

                         1. Has submitted false, fraudulent or misleading information to the Board or

         u.    Review application of JieQiong Huankg-Tao for approval, denial or other administrative
               action pursuant to NRS 640C.700.
                    JieQiong Huankg-Tao-Present. Interpreter-Joyce Song. Lisa Cooper stated Jie
                    Qiong Huankg-Tao was arrested on 12/16/06 for solicitation of prostitution. Stacy
                    Rodd stated the case is pending until 10/20/07. Ms. Tao is not currently working.
                    Ms. Tao wanted to know if she could be issued another temporary license until the
                    case. Billie Shea stated The Board does not issue a 2nd temporary license after
                    one temporary license has been issued. Stacy Rodd stated Ms. Tao was issued an
                    independent license in error on 2/26/04 and would not be issued another license in
                    the County.
                    Motion: Karen Sartell-Motion to table review until December board meeting.

         v.   Review application of Michael Houser for approval, denial or other administrative action
              pursuant to NRS 640C.700.
                  Michael Houser-Present. Lisa Cooper stated Michael Houser was arrested on
                  2/9/01 for solicitation of prostitution and was found guilty on 9/19/01. Mr. Houser
                  also let his work card expire on 3/31/03. Mr. Houser is the business owner of
                  Dream Master Massage Therapy and currently works Homeland Security.
                  Discussion among board members on Mr. Houser’s application and incomplete
                  information.
                  Motion: Michelle Viesselman-Deny based on incomplete application.
                  Seconded: Karen Sartell

         w.   Review application of Ruifang Zhang for approval, denial or other administrative action
              pursuant to NRS 640C.700.
                  Ruifang Zhang-Present. Lisa Cooper stated Ruifang Zhang was arrested for
                  solicitation of prostitution on 7/9/03 and was found guilty on 10/20/04. Ms. Zhang
                  was also arrested for solicitation of prostitution on 8/31/06 and was cited for no
                  massage license in 11/06. Ms. Zhang pleaded no contest, was found guilty, and
                  paid $600 fine. Ruifang Zhang is currently not working. Stacy Rodd stated Ms.
                  Zhang withdrew her application prior to receiving approval of LVMPD background
                  investigation. Stacy Rodd stated Ms. Zhang was denied a Henderson license due
                  to using an erroneous social security number, and has ‘out of business’ status for
                  City of Las Vegas pending the outcome of this review. Billie Shea asked about the
                  current status of Ms. Zhang license. Stacy Rodd stated the City is waiting for The
                  Board’s decision before making their own.

          x.   Review application of Mei Qin Zhao for approval, denial or other administrative action
               pursuant to NRS 640C.700.
                   Mei Qin Zhao-Present. Lisa Cooper stated Mei Qin Zhao was arrested for illegal
                   entry into the U.S. on 3/26/04. Ms. Zhao was arrested for solicitation of prostitution
                   in Pennsylvania on 10/26/01 and the record was expunged. Board members
                   discussed massage licenses in multiple states.
                   Motion: Karen Sartell-Approval to grant license upon confirming AZ licensure was
                   in good standing.
