Subj:     INSTRUCTIONS FOR EXPLANATION OF UNIFORM CODE OF MILITARY
          JUSTICE, TYPES OF DISCHARGE, AND CODE OF CONDUCT

1. Purpose. The purpose of this instruction is to promulgate
instructions for explanation of the UCMJ, types of discharge, and
Code of Conduct.

2.   Cancellation.    NAVSTANORVAINST 5810.2D.

3.   Background

    a. Reference (a) and Article 137 of reference (b) require that
Articles 2, 3, 7 through 15, 25, 27, 31, 37, 38, 55, 77 through
134, and 137 through 139 of the UCMJ be carefully explained to
every enlisted person. A complete text of the UCMJ and the regula-
tions prescribed by the President of the United States thereunder
shall be made available to any person on active duty in the armed
forces upon their request for their personal examination.

    b. Reference (a) further requires that enlisted personnel be
advised of the various types of discharge certificates and the
basis for issuance and the possible effects of such certificates
relative to reenlistment, civilian employment, veterans’ benefits,
and related matters.

    c. Reference (c) requires that the Code of Conduct be care-
fully explained to each enlisted person. An information package is
provided to each Department Head in order to effect the training.

     d.   The required time for complying with the above are:

          (1) Within six days of initial enlistment;

          (2) After completion of six months active service; and

        (3) Upon the occasion of each reenlistment or extension of
enlistment (voluntary or involuntary).

    a. Legal Department will provide information packet to all
Naval Station Department Heads.

    b. Department Heads and Command Career Counselors of the Naval
Station will:

        (1) Explain the UCMJ articles specified above, types of
Discharge Certificates, and Code of Conduct to each enlisted person
attached to their department upon completion of six months active
duty and upon reenlistment or extension of enlistment.

        (2) Forward a memorandum to the Military Personnel Officer
(MPO) stating that the above has been complied with, the date, and
the names of the personnel concerned.

    c. Upon receipt of the memorandum from the Department Head,
the Military Personnel Officer will ensure appropriate service
record entries are made on the Administrative Remarks Page (NAVPERS
1070/613).
