Annex GEN 1-4: EU Rules on Origin & Nationality

Please note that this annex includes two guidelines on EU Rules on origin and nationality:

A: Applicable rules of nationality and origin for instruments before 2007 for procurement purposes within grant agreements
B: Applicable rule of nationality and origin for the 2007-2013 instruments for procurement purposes within grant agreements

Key Definitions

Rule of nationality: refers to the nationality of the service providers, suppliers (companies) and consultants. These rules of nationality apply for all service,
works and supply contracts within grant agreements. The rule does not apply for experts proposed by service providers. Tenderers must state in the tender,

the country of which they are nationals by presenting the usual proof of nationality e.g. company registration, under their national legislation .

Rule of origin: refers to the origin of goods and equipment. Rules of origin apply to supply contracts, only. Goods originating in a country shall be those wholly
obtained or produced in that country. Goods whose production involved more than one country shall be deemed to originate in the country where they
underwent their last, substantial, economically justified processing or working. For equipment and vehicles of a unit cost on purchase of more then EUR 5,000,
the origin must be certified by a Certificate of Origin that you should ask the supplier to provide when making the purchase. The Certificate of Origin must be

issued by the competent authorities of the country of origin e.g. such as Chambers of commerce.

Rules of nationality and origin apply from the first Euro spent.

Frequently Asked Questions

            Question: Is it possible to obtain derogations?
             Answer: Derogation must be included in the special conditions of the contract. For EuropeAid, it is possible to obtain a derogation, but only in duly
             substantiated exceptional cases, justified on the basis of the unavailability of products and services in the markets of the countries concerned, for
             reasons of extreme urgency, or if the rules would make the realization of the project impossible or exceedingly difficult.

            Question: What is the legal basis of my contract? Is my contract under a thematic or a geographical instrument?
             Answer: The legal basis is mentioned in the guidelines of the relevant call for proposals / call for tenders. Thematic legal basis are mentioned in
             footnote 1 of this document. Geographical legal basis are mentioned in under title “instruments with a geographic scope”.

            Question: What if I don’t respect the rules of origin and nationality?
             Answer: Expenditure will be declared ineligible.

A: Applicable rules of nationality and origin for instruments before 2007 for procurement purposes
within grant agreements

On 28 December 2005, the European Union adopted two regulations on untying of aid, modifying the rules of nationality and origin applicable under EU grants
and contracts. These rules are applicable from that date for new procurement procedures, under new and existing contracts. This document is therefore only
relevant for procurement procedures after this date.

ECHO Annex IV – states ”The rules concerning the origin of the supplies set out in Annex IV have been drafted having due regard to the respect of the consuetudinary principles of International
Humanitarian Law, in particular the principle of impartiality, meaning that the implementation of Actions must solely respond to identified needs, without discrimination of any kind and the principle of
independence, which implies the autonomy of the humanitarian Action with regard to economic or other motivations. These principles are equally reflected in Council Regulation (EC) 1257/96 concerning
humanitarian aid (hereafter Humanitarian Aid Regulation). Accordingly, humanitarian Actions have to be free from any tied aid interference. Furthermore, whenever feasible and advisable.”

B: Applicable rules of nationality and origin for the 2007-2013 instruments for procurement purposes
within grant agreements

In the context of the financial perspectives (2007-2013), and further to the efforts undertaken to simplify the approx. 30 legal bases applicable to external aid,
7 new instruments will from 1. January, 2007 govern the external aid (except humanitarian assistance) financed from the general budget.

There are no limitations on origin and nationality for humanitarian assistance.

The applicable rules of nationality and origin for the 2007-2013 instruments are explained in detail in the EuropeAid document entitled “General Annex A2 -
Eligibility of programmes 2007-2013”. Another relevant EuropeAid document is entitled “General Annex A2 – EC programmes” and includes the legal bases of
EC external assistance programmes. These annexes are available on the EuropeAid website:

For development projects implemented through NGOs, we can summarize the applicable rules of nationality and origin as follows:
