ORDER CONSOLIDATING MARKMAN HEARINGS Before the court is the parties Agreed Motion to Consolidate the Markman hearing in this case with the Markman hearings in the related cases of DataTreasury v. Small Value Payments Co., No. 04-CV-85 (the “SVPCo Litigation”), and DataTreasury v. Magtek, No. 03-CV-459 (the “Magtek Litigation”), and to conduct such hearing on June 8, 2006, the currently scheduled date of the Markman hearing in this matter. The Court, having considered this
motion is of the opinion that is should be granted; it is therefore . Ordered that the Markman hearings for this case, DataTreasury v. Small Value Payments Co., No. 04-CV-85 (the “SVPCo Litigation”), and DataTreasury v. Magtek, No. 03CV-459 (the “Magtek Litigation “) be consolidated and heard on June 8, 2006.
