Pension Member Annual Record Updates This notice is to advise all employers and payroll agencies that if you have not yet submitted your annual year-end returns up to and including 31 March 2008 (this includes any leavers during this tax year where a leaver notification is outstanding) then please arrange to do so by the 31st December 2009. From analysis carried out by NHS Pensions records are currently only 86% updated to 31st March 2008. You will appreciate that the Pension Division must exercise care over the Scheme Accounts/Records and we are obliged to seek closure to the above year-end pension returns, which are long overdue. This data is required for reports to the National Audit Office and the Department of Health to demonstrate accuracy of members’ records and your co-operation is sought to achieve this. NHS Pensions have previously notified employers of the legal obligation to ensure pension returns are sent within the prescribed timeframe. This is outlined below but can be viewed within the NHS Pension Scheme Regulations. Legal Requirement The NHS Pension Scheme Regulations 1995 outline the legal requirements for all Employing Authorities to ensure that year-end returns are sent. The statutory requirements for Employing Authorities host Trusts or Board is- • For Practitioners and non GP Providers Within 1 month of the end of the financial year immediately following the financial year, to which it relates – i.e. for year-end returns ending 31 March 2008, returns should be supplied by 30 April 2009. • All other members Within 2 calendar months of the financial year-end – i.e. for-year end returns ending 31 March 2009, returns should be supplied by 30 May 2009 Penalties for Failure to Comply Failure to provide year-end returns is a breach of law and the Pension Division has a legal duty under the Pension Act to report any breaches of law to the Pensions Regulator. If any individual is found guilty of a breach of law they may be subject to a heavy fine.
