      YOUNG BUSINESS & PROFESSIONAL SCHOLARS FUNDING
                        CONDITIONS
1.     The Australia-China Council’s Scholarship may at any time be terminated if, in the opinion
       of the Council, the approved activities for which the Scholarship has been provided are not
       being carried out with competence and diligence or the Recipient is in breach of any
       provision in these conditions.

2.     Without prejudice to the availability of the remedy above, the Council may direct the
       Recipient to rectify any breach of these conditions within seven (7) days of receiving
       written notice from the Council.

3.     If the funding is withdrawn by the Council for any reason, or if the programme fails to
       commence, the Recipient shall be required to repay to the Council within thirty (30) days
       of receipt of notice monies provided by the Council.

4.     The Scholarship shall not be undertaken by any body or person other than the Recipient.

5.     No substantial changes in the scope of the project for which the Scholarship has been
       awarded shall be made without the prior written agreement of the Council.

6.     If at any time the Recipient becomes aware of an inability to take up the Scholarship, the
       Recipient shall immediately notify the Council.

7.     The funding support of the Australia-China Council must be acknowledged, including
       wherever possible by use of the Council's logo, in all papers and publicity arising from this
       Scholarship, where this is appropriate. The Council's logo is available from the Council's
       website - www.dfat.gov.au/acc.

8.     Under this award, the Recipient agrees to undertake in Greater China a language refresher
       course and business subjects at a tertiary institution, arranged by the ACC, and to reside in
       accommodation provided by the Council.

9.     The Recipient agrees, if requested by the Council, to make a short presentation or conduct
       a seminar at an Australian Studies Centre in Beijing/Taipei on a subject relevant to the
       study of Australia.

10.    The Recipient agrees to keep accommodation provided under this award in a clean and tidy
       state. The Recipient is responsible for the repair of any damage to the accommodation
       other than fair wear and tear. Nothing in this clause 10 shall require the Recipient to repair:

       (a) any external renovations or damages resulting from lightning, storm, flood, tempest,
          earthquake, water damage arising from sprinkler leakage and rain water, radiation,
          fusion, explosion or concussion from explosion, impact by aircraft or article dropped
          from aircraft, termites, structural or inherent defect (whether due to faulty design,
          construction, inadequate supervision, defective or unsuitable materials or other cause),

         subsidence, inevitable accident, Act of God, riot, civil commotion, strikes and enemy
         action

11.   The Recipient agrees to respect and obey the rules and regulations of the host university.

12.   The Recipient indemnifies the Council against liability for any loss or injury suffered by
      the Recipient in undertaking the Scholarship other than loss or injury resulting from any
      breach of these conditions by the Council or negligent act or omission by the Council. The
      Recipient will arrange for any medical, negligence, professional liability, or other insurance
      necessary for undertaking the scholarship. The Council may direct the Recipient to obtain
      any such insurance it thinks necessary, and, upon receiving such a direction, the Recipient
      will comply with that direction, at no additional cost to the Council.

13.   Under this award, the Council will pay all costs relating to the language and business
      courses at the host university, the costs of the selected accommodation in Greater China,
      one economy class international airfare (return) for the Recipient, basic travel insurance for
      the first six months of the programme (scholarship period), and stipend to cover living
      expenses during the study period. Special membership to Austcham in Beijing and
      ANZCham in Taiwan will also be provided by the Council. The Recipient is responsible
      for all other costs. The Council is under no obligation to provide any supplementary
      funding.

14.   The Recipient shall provide the Council with two written reports, one half-way through the
      scholarship period and the other within thirty days of the conclusion of the scholarship
      period, according to the requirements of the Acquittal Report form (ACC Scholarship
      Acceptance Form - Attachment B). The Recipient is also encouraged to provide an
      additional report to the Australia-China Council after completion of the internship.

15.   If the Recipient fails to provide satisfactory and timely reports, the Australia-China Council
      may direct the Recipient to repay all or a proportion of funds expended on behalf of and to
      the Recipient. Similarly, if the recipient fails a unit of study due to poor attendance, failure
      to submit assignments or failure to attend examinations, the Council may seek
      reimbursement from the Recipient of the relevant course costs.

16.   Obtaining appropriate visas and finding a suitable internship are the responsibility of the
      Recipient. If the Recipient is unable to obtain an appropriate work visa or an internship,
      the Council may direct the Recipient to return to Australia.

17.   If a project results in the Recipient's creating or producing data, information, reports or
      materials which may be subject to copyright or which constitute intellectual property of
      whatsoever nature ("Project Materials"), such Project materials remain the property of the
      Recipient as and when they are created or produced, notwithstanding that any report or
      acquittal documentation provided to the Council by the Recipient in accordance with these
      conditions will be owned by the Council.

18.   The Recipient indemnifies and shall keep indemnified the Council, the Commonwealth, its
      officers, employees and agents from and against all actions, claims, demands, costs and
      expenses (including the costs of defending or settling any action, claim or demand) made,
      sustained, brought or prosecuted in any manner based upon, occasioned by or attributable
      to any injury to any person (including death) or loss of or damage to property which may
      arise from or be a consequence of any unlawful or negligent act or omission of the
      Recipient, its officers, employees or agents in carrying out the approved project.
