Re: Draft Preserve Area Management Plan – Palm Cove Golf Club

Dear Karen,

Enclosed is the draft Preserve Area Management Plan (PAMP) for the Palm Cove Golf Course, LLC, (Golf
Club) submitted to Martin County on September 8, 2006. Under the terms of the Stipulation and Agreed
Final order signed by Martin County and the Golf Club, the PAMP was to cover “the Preserve Areas to be
maintained by the Palm Cove Golf Course, LLC, and identifying lakes to be maintained by the Palm Cove
Golf Course, LLC.” The enclosed draft PAMP does not meet that condition.

Martin County’s PAMP regulations can be enforced only on property owned by the person or organization
submitting the PAMP. Therefore, “sharing” of management responsibilities in the preserve areas covered
by a PAMP cannot be allowed. The owner of the property has to be responsible for all maintenance and
restoration necessary to all preserve areas located on his property. It was noted on the Site Plan submitted
with the PAMP that some of the preserve areas onsite had been split arbitrarily in order to effect this
“sharing” of responsibilities.

I have enclosed a template that can be used for preparing PAMPs. Please review the previously submitted
PAMP to determine that it is in compliance with all provisions of this template. In addition, please
coordinate with Toll FL Limited Partnership (Toll) to assure that all preserve areas located on Toll
property, within the Palm Cove development, are included in the PAMP submitted by Toll and that all
preserve areas located on property owned by the Golf Club, within the Palm Cove development, are
included in the PAMP submitted by the Golf Club. Also, I have enclosed an example Lake Area
Management Plan (LAMP) for your use in addressing the maintenance of any restored lake littoral areas
located on Golf Club property within the Palm Cove development. The LAMP should be included as an
appendix to the PAMP and should not be considered a separate document.

Finally, there is a $300 processing fee for each PAMP. Checks should be made out to Martin County
Board of County Commissioners.
