On September 27, 2004, this Court signed an order granting Defendants' Motion t o
Dismiss the Consolidated Complaint, partially with prejudice and partially without prejudice, an d
granted Plaintiffs' request for leave to amend .
On October 27, 2004, Plaintiffs filed Notice of Plaintiffs' Election to Stand on th e
Consolidated Complaint, asking the Court to enter judgment so that it could appeal therefrom .
On March 4, 2005, Plaintiffs filed their Notice of Appeal, stating that under Federa l
Rule of Civil Procedure 58(b)(2) judgment was deemed entered by operation of law as early a s
150 days after September 27, 2004, which is February 24, 2005 .
On August 12, 2005, the parties filed in the Fifth Circuit Court of Appeals a
Stipulated Voluntary Dismissal under Federal Rule of Appellate Procedure 42(b), and the Clerk of
the Fifth Circuit Court of Appeals signed an Entry of Dismissal on August 12, 2005 , dismissing
Plaintiffs' appeal with prejudice .
The Court having never entered a final judgment on a separate document a s
required by Federal Rule of Civil Procedure 58(a) does so now for the sake of providing clarit y
and certainty to the parties . The Court expressly enters this final judgment nunc pro tunc
retroactive to February 24, 2005, the date when the Court's judgment became final by operation o f
law.
The Court orders that Plaintiffs take nothing by their suit. Each party shall bear
their own costs.
