                                                                           13          Before this court is defendants’ motion to dismiss or in the alternative to transfer.
                                                                           14   Plaintiff in its opposition to the motion requests a stay of the litigation pending a decision by
                                                                           15   the Judicial Panel on Multidistrict Litigation whether this case and seven others involving the
                                                                           16   same patent and filed throughout the country should be consolidated for pretrial purposes.
                                                                           17   Having read the parties’ papers and considered their arguments, the court hereby rules as

                                                                           18   follows.
                                                                           19          Defendants’ request to stay this matter is GRANTED, and all proceedings in this action

                                                                           20   are hereby STAYED pending a decision from the Judicial Panel on Multidistrict Litigation.
                                                                           21   The December 8, 2004 hearing is VACATED. The parties are ordered to notify the court
                                                                           22   immediately after a decision is rendered by the JPML.

                                                                           23          IT IS SO ORDERED.
