The Regular Meeting of the Board of Trustees of Austintown Township
was held Tuesday, May 26, 2009, at the Township Hall, 82 Ohltown Road,
Austintown, Ohio.

The Meeting opened at 6:00 P.M. with a salute to the flag led by
Chairperson Lisa L. Oles. Roll Call was as follows: Mrs. Oles, present; Mr.
Pritchard, present; and Mr. Ditzler, present.

Mrs. Oles introduced the Department Heads and Sergeant at Arms.

Mr. Pritchard made a motion to approve the Minutes of the Regular
Meeting of May 11, 2009. Mr. Ditzler seconded the motion. Roll Call: Mrs.
Oles, yes; Mr. Pritchard, yes; and Mr. Ditzler, yes.

                        DEPARTMENT BUSINESS

ROAD DEPARTMENT

1) RESOLUTION #09-05-26-01: Mr. Ditzler made a motion to award the
bid to FOUST CONSTRUCTION, INC., 1700 WILSON AVENUE, GIRARD,
OH 44420, in the amount of $84,231.55 for the Baker Street Storm Sewer
Phase II Project. Mr. Pritchard seconded the motion. Roll Call: Mrs. Oles,
yes; Mr. Pritchard, yes; and Mr. Ditzler, yes.

ZONING DEPARTMENT

1) RESOLUTION #09-05-26-02: Mr. Pritchard made a motion to schedule
the appeal hearing on Demolition of 154 N. Turner Road on Monday, June
8, 2009, at 6:00 P.M. pursuant to request of owner and the mortgage
company. Mr. Ditzler seconded the motion. Roll Call: Mrs. Oles, yes; Mr.
Pritchard, yes; and Mr. Ditzler, yes.

PARK DEPARTMENT

1) An acknowledgement was made to the First National Bank for their
donation and sponsorship to the 2009 Concerts in the Park.

NEW BUSINESS

1) RESOLUTION #09-05-26-03: Mr. Ditzler made a motion pursuant to
Ohio Revised Code 505.86 for the removal (DEMOLITION) of structure and
garage at 252 S. Four Mile Run Road, Austintown Township, Mahoning
County, OH 44515, Parcel #480090011000 and Parcel #480090087000,
based on the buildings being declared structurally defective, insecured
and unsafe by the Fire Inspector. Mr. Pritchard seconded the motion. Roll
Call: Mrs. Oles, yes; Mr. Pritchard, yes; and Mr. Ditzler, yes.

2) RESOLUTION #09-05-26-04: Mr. Pritchard made a motion pursuant to
Ohio Revised Code 505.10(A)(2) to find that the fair market value of each
of the following is $2,500 or less and is not needed for public use, is
obsolete, or is unfit for the use for which it was acquired:

3) RESOLUTION #09-05-26-05: Mr. Pritchard made a motion to approve
the following Resolution:

                                                                Austintown Township
                                                               Mahoning County, Ohio

   The Board of Trustees of Austintown Township, Mahoning County, Ohio, met in
   regular session, pursuant to notice on the 26th day of May 2009 at 6:00 P.M.. with the
   following members present: Lisa L. Oles, Warren Bo Pritchard and David C. Ditzler.

   Mr. Pritchard moved the adoption of the following Resolution:

   BE IT RESOLVED by the Board of Trustees as follows:
   1. That, in conjunction with the Boards of Trustees of Boardman Township and
      Canfield Township, both of Mahoning County, Ohio, and pursuant to the power
      vested in it under the laws of the State of Ohio, and more specifically, under R. C.
      6119.02, the Board of Trustees hereby finds it to be necessary and advisable, and
      in the best interests of the Township residents, to commence proceedings to create
   2. a regional water and storm water district under O.R.C. Chapter 6119 within those
      unincorporated areas of Austintown, Boardman and Canfield Townships depicted
   3. as "Phase 1" on maps labeled "Proposed ABC Water & Storm Water District
      Exhibit" attached hereto and incorporated herein by reference.

   4. That the Board further approves the Petition attached hereto and incorporated
      herein and authorizes the Trustees to sign the same in their official capacity.

   5. That the Board further authorizes the filing of said signed Petition and the
      Proposed ABC Water & Storm Water District Exhibit in the Court of Common
      Pleas of Mahoning County, Ohio, to accomplish the formation of the "ABC Water
      & Storm Water District".

   6. That the Board, having found that the provision of water and storm water services
      to said residents of Austintown Township is for the best interests of the Township
      and its residents, further authorizes all additional action necessary and proper to
      establish such a district and to implement this Resolution so as to promote the
      general health, safety and welfare of said residents of Austintown Township.

   7. That it is found and determined that all formal actions of this Board of Trustees
      concerning and relating to the adoption of this Resolution were adopted in an
      open meeting of this Board of Trustees, and that all deliberations of this Board of
      Trustees and of any of its committees resulting in such formal action, were in
      meetings open to the public, in compliance with the law, including Section 121.22
      of the Revised Code of Ohio.

John Paulette thanked the Board for the letters from utility companies

Gary Brant spoke regarding the closing of New Road and the bridge over
Route 11 on Mahoning Avenue.

Sebastian Rucci, the silent owner and manager of the Go Go Cabaret,
stated he is sorry for not approaching the Township before this date in
regards to the Go Go Cabaret and is willing to do whatever the Township
requires of him.

Off camera:

Marshall Silvernail thanked the Board for trying to clean up the house next
to him on N. Turner Road.

                REMARKS FROM THE BOARD MEMBERS

FISCAL OFFICER MICHAEL J. KURISH:             Thanked the veterans’
organizations that organized the Memorial Day Parade and remembering
those who died for our country.

Thanks were also extended to those who attended the parade.

TRUSTEE DAVID C. DITZLER: Mr. Ditzler echoed the comments regarding
the Memorial Day Parade.

Congratulations to Dr. Mark Popovich for being recognized as the Doctor
of the Year.

TRUSTEE WARREN BO PRITCHARD: Mr. John Paulette and Mr. Gary
Brant should be thanked for their interest in watching over county
government.

TRUSTEE LISA L. OLES: Mrs. Oles echoed the comments also regarding
the Memorial Day Parade.

Mrs. Oles thanked Laura Stone for speaking at the event.

Condolences are extended to Rosemary Jones on the loss of her son.

The Township is hiring summer help to deal with the high grass/ nuisance
complaints.
