After greatly under-reporting the story, now the Establishment Media can today report a defeat on this particular legal challenge to Obama's constitutional eligibility to be elected president. There are other legal challenges, notably the Pennsylvania Berg case, and the California Keyes case, still in the legal pipeline. Pay attention to how much coverage the Establishment Media gives to these other ongoing cases, not only today, but also in the days ahead. Or, if the CFR-controlled media manipulators of public thought and attention will under-report once again. The U.S. Supreme Court today announced it has denied bringing Donofrio v. Wells – one of several cases challenging Barack Obama's eligibility to serve as president – before a full hearing. The case of Leo C. Donofrio v. New Jersey Secretary of State Nina Mitchell Wells claims Obama does not meet the Constitution's Article 2, Section 1 "natural-born citizen" requirement for president because of his dual citizenship at birth. Where's the proof Barack Obama was born in the U.S. or that he fulfills the "natural-born American" clause in the Constitution? If you still want to see it, sign WND's petition demanding the release of his birth certificate. Unlike many of the lawsuits regarding Obama's "natural-born citizen" status, the Donofrio case makes no allegation he was born on foreign soil. Instead, Donofrio contends Obama was a British citizen at birth, because of his father's citizenship in a British colony, Kenya. "Don't be distracted by the birth certificate and Indonesia issues," Donofrio writes on his Natural Born Citizen blog. "They are irrelevant to Senator Obama's ineligibility to be president. Since Barack Obama's father was a citizen of Kenya and therefore subject to the jurisdiction of the United Kingdom at the time of Senator Obama's birth, then Senator Obama was a British citizen 'at birth.'" As WND has reported, Donofrio's case is only one of several filed around the country challenging Obama's eligibility to be elected president under the Constitution. Former presidential candidate Alan Keyes and others filed a court petition in California asking the secretary of state to refuse to allow the state's 55 Electoral College votes to be cast in the 2008 presidential election until Obama verifies his eligibility to hold the office. The California action was filed by Gary Kreep of the United States Justice Foundation on behalf of Keyes, the presidential candidate of the American Independent Party, along with Wiley S. Drake and Markham Robinson, both California electors. "Should Senator Obama be discovered, after he takes office, to be ineligible for the Office of President of the United States of America and, thereby, his election declared void, Petitioners, as well as other Americans, will suffer irreparable harm in that (a) usurper will be sitting as the President of the United States, and none of the treaties, laws, or executive orders signed by him will be valid or legal," the action challenges.

Without any comment whatsoever, the Supreme Court today declined to take up an appeal by a New Jersey man who questioned President-elect Barack Obama’s eligibility for the presidency, based on his birth to a father from Kenya and a mother who was a United States citizen. The case, brought by Leo Donofrio of East Brunswick, N.J., contended that Mr. Obama could not be considered a “natural-born citizen” a constitutional ground for becoming president of the United States because he had dual nationality at birth.
The state of Hawaii has declared that Mr. Obama was born there in August of 1961, and is a United States citizen, but that hasn’t stopped a small squall of Internet-fueled rumors from trying to debunk his citizenship. The issue of his birth certificate has long been the subject of rumors, to the point that Mr. Obama’s Web site posted a copy of it on its “fightthesmears” mini-site to try to staunch the innuendo during the campaign. This is the kind of doubt-bending thing that lives independently online, but from the looks of today’s decision by the highest court in the land, the accusation isn’t gaining much ground in the realm of reality.

Photo: AP Even with the election decided, the widely debunked whisper campaign claiming that Barack Obama is secretly not an American, and thus not qualified to be president, is going strong. The Supreme Court Monday rejected one case contending that Obama is not a "natural born citizen," as the president is required to be under Article II, Section 1 of the U.S. Constitution. The case, referred to the court by Justice Clarence Thomas after Justice David Souter had rejected it, argued that because Obama's father was a citizen of Kenya, at the time a British colony, the president-elect was born with dual citizenship. Another case, filed by Attorney Phillip J. Berg, effectively contends that Obama has outright lied about having been born on American soil. The high court has yet to rule on that argument. A decision by the court to take such a case is unlikely, as at least four of the court's nine judges must approve before a case is heard and the great majority of the petitions brought before the Court are dismissed without comment. Still, it's further grist for what's been an active conspiracy mill. "I think there are just a lot of people who just want to believe it," said Paul Waldman, who has studied the conspiracy theories over Obama's citizenship for Media Matters. Waldman said that like with the claims that the Clintons killed White House Counsel Vince Foster, a certain segment of the population will continue to believe Obama won on illegitimate grounds no matter how often the claim is disproved. Bob Schultz, who heads the "We the People Foundation" which has raised tens of thousands of dollars raising questions about Obama's background and promoting Berg's legal action with full-page ads in the Washington Times, Chicago Tribune and the conservative newspaper Human Events. The group is now eyeing buys in the New York Post and USA Today. Schultz's Web site, which had previously been dedicated to promoting Rep. Ron Paul's (R-Texas) insurgent presidential campaign, hosts an array of documents and web videos offering conflicting arguments - that Obama was born outside of the United States, or that he lost his citizenship upon moving to Indonesia with his mother and step father and then must have re-entered the United States illegally. The claim has reverberated in conservative media outlets, especially talk radio. According to Media Matters, conservative radio hosts Michael Savage, Brian Sussman, Lars Larson, Bob Grant, Jim Quinn, Rose Tennent and Mark Davis (who was guest-hosting for Rush Limbaugh) have all repeated the widely discredited claim.
