                                       JANUARY 6, 2009


1. Call to Order
The joint meeting of the City Council and Redevelopment Agency was called to order at 7:34 p.m.
by Mayor Ford who then led the Pledge of Allegiance. A special meeting of the City Council was
opened concurrently.

5. Oral Communications
    a. Mike Gandy, Planning Commission Chair, asked the status of Planning Commission
        vacancies.

    b. Roland Mendonca, Gustine resident, requested that the restrooms in Henry Miller Park
       remain unlocked for use during daylight hours.

    c. Mayor Ford, introduced and welcomed Rich Calderon the city’s new police chief and
       invited the public to attend his swearing-in ceremony on Thursday, January 8.

8. City of Gustine Consent Calendar
All matters listed under the Consent Calendar are considered routine and may be approved by
one action of the City Council, unless any member of the City Council wishes to remove an item
for separate consideration.
        a. Minutes of Meeting of December 16, 2008
           Recommendation: Review and approve
        b. Warrants
           Recommendation: Approval of Warrants as listed.
        c. Employment Agreement – Chief of Police
           Recommendation: Approve employment agreement with Richard Calderon
           incoming Police Chief.

Mayor Pro Tem Oliveira made a motion to approve the consent calendar. Seconded by Council
member Garcia. Motion carried. 5-0.


9. City of Gustine Administrative Agenda

        Mayor Ford announced that the item to be considered from the special meeting
        agenda “Requests of Patrick Ranahan, Location Scout” would be addressed after
        item b.

        a. Appointment to Special City Selection Commitee for the San Joaquin
           Valley Air Pollution Control District’s Governing Board
           Recommendation: That the City Council make an appointment from one of
           its members to a Special City Selection Committee for the San Joaquin
           Valley Air Pollution Control District’s Governing Board

            The City Clerk gave a staff report. After discussion, Mayor Pro Tem Oliveira made a
            motion appoint Rich Ford to a Special Selection Committee for the San Joaquin
            Valley Air Pollution Control District’s Governing Board and further appoint Council
            member Bart Garcia as an alternate. Seconded by Council member Schultz. Motion
            carried 5-0.


        b. Request to Reactivate Frozen Sergeant Position
           Recommendation: Police Department staff recommends approval of request to
           reactivate the frozen Police Sergeant position, and freeze the Lieutenant position that
           is currently authorized on the allocation list.

            The Police Chief gave a staff report. Administrative Services Manager also
            answered questions of the City Council. After discussion, Mayor Pro Tem Oliveira
            made a motion to reactivate the frozen Police Sergeant position, and eliminate the
            Lieutenant position Amaral. Motion carried 5-0.

10. City Department Reports
        a. City Clerk Dept.
           The City Clerk reported on efforts to recruit Planning and Airport Commissioners, re-
           iterated the invitation to the swearing in of Police Chief; and relayed that Self-Help is
           due to break ground over the next few weeks.

        b. Administrative Services
           The Administrative Services Manager announced that the city’s new auditors would
           be onsite January 20 for four to five days to work with staff.
        c. Fire Department
           The Fire Chief reported on calls for December; relayed that calls had increased
           thirteen percent in 2008; and shared that the department had adopted a family at
           Christmas, which was very rewarding. He went on to report that department by-laws
           would be adopted soon and that EMS training was forethcoming.

        d. Police Department
           The Police Chief reported on recent police activities including DUI saturation check
           points; relayed the news of a serious auto accident involving several teens and
           expressed a desire to educate High School students on the dangers of drunk driving.
           The Police Chief further reported on recent arrests, efforts to work with the City of
           Newman and his desire to engage the community in policing efforts.


11. City Manager Reports
        a. Welcome New Chief
           The City Manager welcomed the new police chief and indicated that the chiefs across
           the county had been invited to the swearing-in.

        b. Community Involvement
           The City Manager reinforced that the whole community is needed to make positive
           changes.


12. City Council Reports
        a. Council member Schultz
           Council member Schultz welcomed the Police Chief and reported that the Lions Club
           had supported 52 families with food and gifts over the holidays. He further expressed
           remorse at the loss of Lions Club member, Steve Streeter.

        b. Council member Garcia
           Council member Garcia welcomed the Police Chief and stated he was looking
           forward to the new year.

        c. Council member Amaral
           Council member Amaral welcomed the Chief and congratulated the Lions Club on
           their charitable involvement.

        d. Mayor Pro Tem Oliveira
           After welcoming the Police Chief, Mayor Pro Tem Oliveira paid tribute to Steve
           Streeter, a very active member of the community. He asked that the Mayor adjourn
           the meeting in his memory.

        e. Rich Ford
           Mayor Ford commented on the loss of Steve Streeter. He further commented on the
           loss a soldier from Newman, Tony Gonzales, and encouraged residents to line the
           streets for the funeral procession on January 7.



13. Closed Session

Mayor Ford adjourned to Closed Session in memory of Steve Streeter at 8:08 p.m.

The City Manager reported out of closed session that staff was directed to:
     bring a City Clerk job description and contract back for approval;
     bring a Clerks Association Memorandum of Understanding back for approval;
     bring a Public Works Director contract back for approval; and
     bring an Administrative Services Manager contract back for approval.


14. Adjournment
Mayor Ford adjourned the meeting at 9:45 p.m.
