Declarations of Conformity and Instructions on how to complete them agreed by
Member States of the European Union and the European Economic Area
Directive 2003/44/EC amending Directive 94/25/EC on the approximation of the laws,
regulations and administrative provisions of the Member States relating to recreational
craft became fully mandatory on 1 January 2007. As of this date, all recreational craft
and engines placed on the market must comply with all the relevant provisions of the
amended Directive (i.e. Directive 94/25/EC as amended by Directive 2003/44/EC).
The Administrative Co-ordination Working Group (ADCO) of Market Surveillance
Authorities in the EU/EEA Member States has therefore amended the common format
for the written Declaration of Conformity elaborated for Directive 94/25/EC to include
the new and amending provisions of Directive 2003/44/EC. This document, now
available for downloading on the BERR website, replaces the one which had been in
use up to 31 December 2005. Similar harmonised forms for the Declaration of
Conformity required by engine manufacturers have also been produced and all are
available from our publication pages under cover of this letter -

These documents, although not mandatory, will be translated into the various
Community languages and their use is highly recommended by the European
Commission and Market Surveillance Authorities across the European Union. It is
hoped that these documents will ease the task of manufacturers and provide uniformity
across Europe regarding the information required on a Declaration of Conformity.

Instructions on completing the harmonised format for the
Declaration of Conformity for craft design, construction and noise
All complete recreational craft placed on the EEA market shall have a Declaration of Conformity
(DoC). The Directive specifies what information this declaration shall contain but not its format. The
Declaration of Conformity shall be issued by the manufacturer or his Authorised Representative before
the craft is placed on the EEA market. For craft manufactured outside the EEA and where the
manufacturer has no authorised representative in the EEA, it is for the importer to provide the market
surveillance authority with a copy of the DoC. A copy of the Declaration of Conformity in the official
language of the country where the craft will be placed on the market and/or put into service shall be
attached to the owner’s manual which shall accompany the craft.
A harmonised format for a Declaration of Conformity has been created as an answer to manufacturers’
and Notified Bodies’ requests for an interpretation of the statutory requirements of the Directive as
guidance.
The document has been agreed by representatives from Member States and it provides all the
information judged necessary to satisfy the market surveillance authorities in the EEA Member States.
The form can be customised by omitting sections not relevant for the craft concerned and by using one’s
own company layout. However it is important that the overall information and format is not changed too
much to maintain common design.
NB! Although this common format is not mandatory, its use is highly recommended.
Manufacturer and Authorised Representative details:
Manufacturer: The craft manufacturer is any natural or legal person who designs and manufactures a
craft or who has it designed and/or manufactured for him with the view to place it on the market.
Authorised representative: The manufacturer may appoint an authorised representative based in the
Community to act on his behalf to carry out certain tasks required by the applicable Directive. However,
a manufacturer established outside the Community is not obliged to have an authorised representative
within the Community, although this may present some advantages.
The delegation of tasks from the manufacturer to the authorised representative shall be explicit and
should be in writing, in particular to define the tasks and the limits of the representative’s responsibility.
The authorised representative may, for instance, affix the CE marking and draw up and sign the EC
declaration of conformity. If the authorised representative is issuing and signing the DoC, he has to fill
out the data field concerning the manufacturer of the craft on whose behalf he is acting.
Where a manufacturer has appointed an authorised representative, both their names and addresses
should appear in an appropriate data field.
If an authorised representative is not appointed, this data field is not required and can be removed..
Notified Bodies details:
Module Aa for construction and design:
If a craft manufacturer has used internal production control plus tests (module Aa) for assessing the
stability and buoyancy (essential requirement 3.2 &3.3) of his craft, the name, address and identification
number of the Notified Body responsible for carrying out the tests, equivalent calculation or control has
to be filled out . A module Aa Examination Report issued by a Notified Body is not an ‘EC-type
examination certificate’. The Examination Report number and date should be stated instead of the EC
type- examination Certificate number.
Module B+C, B+D, B+E, B+F, G and H for construction and design:
If a Notified Body has intervened in the conformity assessment for construction and design under one of
the following modules: B+C, B+D, B+E, B+F, G or H, its name, address and identification number shall
be stated.
The Certificate number of the Module B ‘EC type-examination certificate’ issued by the Notified Body
shall be stated.
When a different Notified Body is responsible for the Quality Assurance supervision, as in Module B+D
and B+E, their name and number shall also appear on the Declaration of Conformity.
If module G or H is used, a certificate number and date should not be stated.
Module Aa, G and H for noise emissions:
If a craft manufacturer has used module Aa, G or H for assessing the conformity of his craft with the
noise emission requirements, the name, address and identification number of the Notified Body involved
in the noise emission assessment shall be stated.
In case the craft manufacturer is placing his craft on the market fitted with a stern drive engine with
integral exhaust or an outboard engine, the data field for the Notified Body’s details for noise emission
assessment is not required. The engine delivered with the craft has to be accompanied by a DoC with the
noise emission requirements issued by the manufacturer of the stern drive or outboard engine.
Module used:
The modules used for conformity assessment, in accordance with Article 8 of the Directive shall be
indicated. Only one modular choice may be applied for each assessment (construction and noise). The
modular choice applied for noise emission assessment is not to be indicated by the craft manufacturer in
case his craft is designed to be powered by stern drive engine with integral exhaust or outboard engine.
NB! This DoC is not applicable for craft intended for stern drive engines but placed on the market
without such an engine. Such a craft is not completed and shall not bear a CE marking. In such a
case, an Annex III (a) declaration shall be used.
NB! All applicable directives have to be listed.
It should also be noted that test certificates and/or type-approval certificates issued by notified
bodies should not be mistaken for a Declaration of Conformity. These should be attached to the
Technical file. A Declaration of Conformity is a document issued by the manufacturer to certify
that his product meets the essential requirements of the Directive.
Description of the craft:
The description of the craft should contain the above stated information. Maximum recommended
engine power is the maximum engine power recommended by the craft manufacturer. The installed
engine power refers to the power of the engine that is actually installed. In case of craft to be powered
by outboard engines, but placed on the market without such engine, this may not be applicable and may
be removed. Length, beam and draught of hull shall be measured in accordance with the harmonised
standard “Principal data” (EN ISO 8666:2002). The maximum draught Tmax shall be used. For the
correct determination of Deck it is advisable to use EN ISO 12217:2002 series, section Term and
Definition.
Tick boxes or items which are not applicable may be removed.
The Declaration:
In case Module A, Aa, G or H is
used, the underlined text shall be
deleted, as no EC type
examination certificate has been
issued.
The Declaration of Conformity shall identify by name the person empowered to sign on behalf of the
craft manufacturer, their signature and the position held by that person. If the craft manufacturer, or his
authorised representative, has empowered in writing a person to sign the DoC, on their behalf, that
person can sign this document.
The signature could be stamped, printed, copied etc. but shall always be given in such a way that the
person empowered to sign could be identified.
The second side of the form:
For each essential requirement, listed in Annex IA that applies to the craft the details of the referenced
standards or other normative documents against which compliance is declared should be given. It is
important that the revision years of the standards are clearly stated (e.g. EN ISO 8666:2002). If
reference is made to the Technical documentation, this should be in a precise, complete and clearly
defined way, for example by indicating applicable pages or chapters. All essential requirements
concerning the design, construction and noise emissions that apply to the craft have to be shown on page
2 of the Declaration of Conformity.
The essential requirements for noise emissions, Annex IC, (the three rows below) is not required when
the craft is to be powered by outboard engine, but is placed on the market without such engine(s). When
such engine(s) are delivered with the craft (fitted or not), or when an inboard engine or stern drive
engine without integral exhaust has been installed in the craft, the lines for noise emissions shall be
completed as follows:
• Reference shall be made to either
o the standards EN ISO 14509-1 (Pass-by test) or EN ISO 14509-2 (Reference
Boat) – tick box for “Standard” shall be marked or,
o to the P/D ratio method –tick box for “Other normative document / method”
shall be marked
• The tick box for “technical file” shall be marked and reference shall be made to either
the P/D ratio calculation or the Notified Body’s test report in the Technical
documentation.
• The tick box for “Other normative document/method” shall be marked and if an
inboard engine is installed, reference to the owner’s manual issued by the craft
manufacturer shall be given. If an outboard engine or stern drive with or without
integral exhaust is installed, reference to the owner’s manual issued by the engine
manufacturer shall be given.

his engine(s) with the exhaust emission requirements, the name, address and ID number of the Notified
Body involved shall be stated. In case of module B+C, B+D, B+E or B+F assessment, the number for
the ‘EC type-examination certificate’ issued by the Notified Body shall be provided in the table under
the section ‘description of the engine’ below.
If module G or H is used, a certificate number should not be stated.
Type approval for exhaust emissions issued under Directives 97/68/EC and 88/77/EC:
If the engine’s conformity with the exhaust emission requirements is based on a type approval issued
under Directive 97/68/EC or 88/77/EC, the data field of the Notified Body for exhaust emissions
assessment may be omitted, but the details of type-approval certificate shall be provided in the table
under the section ‘description of the engine’ below.
Module used:
The modules used for conformity assessment, in accordance with Article 8 of the Directive shall be
indicated. Only one modular choice may be applied for exhaust emission assessment. Alternatively, if
engines are type approved according to 97/68/EC or 88/77/EC, the relevant directive shall be indicated.
The ‘tick boxes’ of modules, which are not used, can be deleted.
NB. All applicable directives have to be listed.
Description of the Engine:
The description of the engine shall contain the above stated information.
The first column of the above table should state the engine model or engine family name(s). The second
should refer to the engine’s unique identification number(s) or engine family code(s). The last column
shall refer to the number(s) of the ‘EC Type-examination certificate(s) ’ for exhaust emission
assessment issued by the Notified Body under module B+D, B+E, or B+F, or the details of the type-
approval certificate issued under Directive 97/68/EC or 88/77/EC.
Essential Requirements:
For each essential requirement that applies to the engine, the details of the referenced standards, other
normative documents or the Technical File against which compliance is declared shall be given. It is
important that the revision years of the standards are clearly stated (e.g. EN ISO 8178-1:1996). If
reference is made to the Technical File, it shall indicate applicable pages or chapter(s).
Engine identification: The requirements for engine identification are listed in Annex I.B.1.1 of directive
2003/44/EC. A harmonised standard is not yet available. Therefore, reference shall be made to the
Technical File. It shall indicate relevant chapter(s) of the Technical File.
Exhaust emission: Reference shall be made to EN ISO 8178 (Date)
Durability: The requirements relate Annex I.B.3 in the Directive. A harmonised standard is not yet
available and reference shall therefore be made to the Technical File. It shall indicate the relevant
chapter(s) of the Technical File.
Owner’s manual:
The requirements of the Owner’s Manual relate to installation and maintenance instructions. The
requirements relate to Annex I.B.4 in the Directive.
It shall indicate the relevant chapter(s) of the Technical File and/or Owner’s Manual.
The Declaration
The Declaration of Conformity shall identify by name the person empowered to sign on behalf of the
engine manufacturer, their signature and the position held by that person. In the case where the
manufacturer of the engine, or his authorised representative, has empowered, in writing, a person to sign
the DoC, on their behalf, that person can sign the document. The signature could be stamped, printed,
copied etc. but shall always be given in such a way that the person empowered to sign could be
identified.

If an authorised representative is not appointed, this data field is not required and can be removed..
Notified Bodies details:
Module B+C, B+D, B+E, B+F, G and H for exhaust:
If an engine manufacturer applies module B+C, B+D, B+E, B+F, G or H for assessing the conformity of
his engine(s) with the exhaust emission requirements, the name, address and ID number of the Notified
Body involved shall be stated. In case of module B+C, B+D, B+E or B+F assessment, the number for
the ‘EC type-examination certificate’ issued by the Notified Body shall be provided in the table under
the section ‘description of the engine’ below.
If module G or H is used, a certificate number should not be stated.
Type approval for exhaust emissions issued under Directives 97/68/EC and 88/77/EC:
If the engine’s conformity with the exhaust emission requirements is based on a type approval issued
under Directive 97/68/EC or 88/77/EC, the data field of the Notified Body for exhaust emissions
assessment may be omitted, but the details of type-approval certificate shall be provided in the table
under the section ‘description of the engine’ below.
Module used:
The modules used for conformity assessment, in accordance with Article 8 of the Directive shall be
indicated. Only one modular choice may be applied for exhaust emission assessment. Alternatively, if
engines are type approved according to 97/68/EC or 88/77/EC, the relevant directive shall be indicated.
The ‘tick boxes’ of modules, which are not used, can be deleted.
NB. All applicable directives have to be listed.
Description of the Engine:
The description of the engine shall contain the above stated information.
The first column of the above table should state the engine model or engine family name(s). The second
should refer to the engine’s unique identification number(s) or engine family code(s). The last column
shall refer to the number(s) of the ‘EC Type-examination certificate(s) ’ for exhaust emission
assessment issued by the Notified Body under module B+D, B+E, or B+F, or the details of the type-
approval certificate issued under Directive 97/68/EC or 88/77/EC.
Essential Requirements:
For each essential requirement that applies to the engine, the details of the referenced standards, other
normative documents or the Technical File against which compliance is declared shall be given. It is
important that the revision years of the standards are clearly stated (e.g. EN ISO 8178-1:1996). If
reference is made to the Technical File, it shall indicate applicable pages or chapter(s).
Engine identification: The requirements for engine identification are listed in Annex I.B.1.1 of directive
2003/44/EC. A harmonised standard is not yet available. Therefore, reference shall be made to the
Technical File. It shall indicate relevant chapter(s) of the Technical File.
Exhaust emission: Reference shall be made to EN ISO 8178 (Date)
Durability: The requirements relate Annex I.B.3 in the Directive. A harmonised standard is not yet
available and reference shall therefore be made to the Technical File. It shall indicate the relevant
chapter(s) of the Technical File.
Owner’s manual:
The requirements of the Owner’s Manual relate to installation and maintenance instructions. The
requirements relate to Annex I.B.4 in the Directive.
It shall indicate the relevant chapter(s) of the Technical File and/or Owner’s Manual.
The Declaration
The Declaration of Conformity shall identify by name the person empowered to sign on behalf of the
engine manufacturer, their signature and the position held by that person. In the case where the
manufacturer of the engine, or his authorised representative, has empowered, in writing, a person to sign
the DoC, on their behalf, that person can sign the document. The signature could be stamped, printed,
copied etc. but shall always be given in such a way that the person empowered to sign could be
identified.
