                                         ARTICLE 42
                                        Building Permits


§ 170-42.1.   Permits.

A.     No building permit or zoning compliance permit shall be issued for the erection,
       alteration, repair, modification or use of any building, structure or part thereof or for the
       use of any land, which is not in accordance with the provisions of this chapter and other
       applicable Township requirements.

B.     The terms altered or repaired shall include any structural changes, stairways, type of
       construction, type, class or kind of occupancy, light or ventilation, means of egress or
       ingress or any other changes affecting or regulated by the Building Code, Housing Law
       of Michigan (MCL 125.401 et seq.) or this chapter.

C.     The building official shall make the final determination regarding applicability of a
       building permit and/or zoning compliance permit, based on the information submitted by
       the applicant and subject to applicable legislation and Township standards.

D.     Zoning compliance permits. A zoning compliance permit must be obtained for certain
       buildings or structures as generally identified below. The zoning compliance permit
       signifies that the intended use, building or structure complies with the provisions of this
       chapter. Issuance of a zoning compliance permit shall not waive any provision of this
       chapter, other Township requirements or requirements of other permit agencies. Zoning
       compliance permits include, but are not limited to, the following.

       (1)    A change of use, including operations for current occupants, if the change affects
              the use classification in the Building Code or a change to the amount of parking
              required by this chapter.

       (2)    One-story detached accessory buildings and structures in non-residential zoning
              districts having a floor area of less than 200 square feet.

       (3)    One-story detached accessory buildings and structures in residential zoning
              districts having a floor area of less than 400 square feet.

       (4)    Fences greater than 36 inches and six (6) feet or less in height.

       (5)    Retaining walls less than four (4) feet in height.

       (6)    Pedestrian bridges.

Any change in the use of land, type of use or occupancy of any nonresidential building or
structure shall require a zoning compliance permit and/or a building permit. For changes in use,
additional improvements may be required to bring the site into greater compliance with current
standards.


§ 170-42.3. Application requirements.

Applications for building permits and certificates of occupancy shall be made on forms supplied
by the building department and accompanied by the specified fees. Applications for permits
shall explicitly describe the proposed work for which authorization is requested. All applications
shall be accompanied by a plot plan drawn to scale and in sufficient detail to enable the building
official to determine if the proposal is in compliance with this chapter. The plot plan shall, at a
minimum, provide the following information.

A.     The location and dimensions of the lot.

B.     The shape, size and location of all buildings or structures to be erected, altered or moved
       and all existing buildings and structures on the lot.

C.     The existing and proposed use of the lot, including all buildings and structures upon it.
       For multiple family units the number of units per building must be specified.

D.     The location of all utilities serving the site, including well and septic locations.

E.     All road rights-of-way, easements and driveways.

F.     Any regulated trees per the requirements of Article 23.

G.     Any additional information regarding the lot, adjoining lots or other matters deemed
       necessary for determining compliance with the provisions of this chapter.


§ 170-42.4. Final inspection.

The holder of any building or zoning compliance permit shall notify the building official upon
completion of the work, authorized by the permit, for the necessary inspection. If inspected
work receives approval, a request shall be made to the building department for a certificate of
occupancy. All roads, driveways and pathways damaged during construction shall be restored to
their original condition. Examples include curb cuts in pavement for underground utility needs,
pavement damage from equipment and similar damages caused through the construction
activities.

§ 170-42.5. Certificates of occupancy.

No land, building, structure, or part thereof, shall be occupied by or for any use until a certificate
of occupancy is issued. The following shall apply in the issuance of any certificate.

A.     General requirements. A certificate of occupancy shall be issued for a building, structure,
       or part thereof, or for the use of any land, only if such building, structure or use is fully in
       accordance with the provisions of this chapter, Chapter 58 and all other applicable
       Township ordinances and requirements.

B.     Certificates for accessory buildings and uses. Accessory buildings and uses shall not
       require separate certificates of occupancy but may be included in the certificate of
       occupancy for the principle use, provided the accessory buildings and uses are shown on
       the plan drawing and are completed at the same time as the principle use.

C.     Temporary certificates. A temporary certificate of occupancy may be issued for all or a
       portion of a building or structure in instances where building or site improvements, as
       required by this chapter and any other permits or approvals issued by the township, are
       not completed, provided that such portion of the building, structure or site conforms with
       the provisions of this chapter and the building code, and provided further that no threat to
       public safety exists. The building official may set a time limit for the duration of the
       temporary certificate of occupancy, which shall be indicated on the temporary certificate,
       and thereafter occupancy may only be authorized under a final certificate of occupancy.
       Failure to obtain a final certificate of occupancy within the specified time shall constitute
       a violation as defined in Chapter 58.

D.     Issuance of final certificates. The building official shall inspect a building or structure
       within five (5) days after the request for inspection is made. The building official shall
       issue a certificate of occupancy upon finding that the building or structure, or part
       thereof, or the use of land is in conformance with the provisions of this chapter and other
       applicable regulations. If the building official denies a certificate, the applicant shall be
       notified in writing of the denial, and the reasons for the denial, within five (5) days.

E.     Period of validity. A certificate of occupancy shall remain in effect for the life of the
       building, structure, or part thereof, or the use of the land, until the use of the building,
       structure or land changes. A change of use shall require a new certificate of occupancy.

F.     Records of certificates. A record of all certificates issued shall be kept by the building
       department. Copies of certificates shall be furnished upon request to any person having a
       proprietary or tenancy interest in the property.


§ 170-42.6. Stop-work orders.

A.    Upon notice from the building official that any use is being conducted or that any work
      on any building or structure is being pursued contrary to the provisions of this chapter,
      such work or use shall be immediately stopped. The stop-work order shall be issued in
      writing and shall be given to the owner of the involved property, to the owner's agent or
      to the person doing the work. The stop-work order shall state the conditions, if any,
      under which work or the use will be permitted to resume.

B.    Any person who continues to work in or about the building, structure, land or use after
      being served with a stop-work order shall be in violation of this chapter, except for such
      work necessary to remove a violation or correct an unsafe condition.
