I RECOMMEND THE BOARD OF COUNTY COMMISSIONERS (BOARD) RESCIND THE AWARD OF
CONTRACT STAFFING RESOURCES FOR INFORMATION SYSTEMS. (IS) WITH TEKSYSTEMS
MANAGEMENT, INC.,a/k/a TEKSYSTEMS, INC. (TEKSYSTEMS), TAMPA, FLORIDbON THE BASIS OF BEING
NON-RESPONSIVE TO THE TERMS AND CONDITIONS OF THE COUNTY'S CONTRACT PURCHASE ORDER.
On September 19, 2006, the Board awarded a portion of the bid for Contract Staffing Resources for IS to
TekSystems. A s per standard p rocedure, a contract p urchase order was m ailed t o T eksystems t o finalize the
award process. Upon receipt of the contract purchase order, TekSystems refused to accept the terms and
conditions contained within. Specifically, TekSystems will not agree to hold harmless the County from all suits,
actions or claims arising out of the misconduct of contract staffing personnel they provide to the County.
A conference call that included representatives from IS, Purchasing, Legakand TekSystems was held in an effort to
reach an agreement favorable to all parties. The outcome of the conference call resulted in TekSystems advising
the County that they decline to participate in the bid award based on the current language within the contract
purchase order terms and conditions. However, they requested the County to reconsider them for award should
the other vendors not be able to meet the bid requirements.
All required contract documentation has been received from the other fifteen (15) vendors that were award
participants, with none taking any exceptions to the contract purchase order terms and conditions. Therefore, there
is no reason to reconsider the exceptions taken by TekSystems and the award to TekSystems should be rescinded.
Funds that were to b e a llocated t o TekSystems will be re-allocated to other a warded vendors. Funding for this
contract will be provided by Information System's operating budget.

On July 14, 2006, the Purchasing Department on behalf of the IS Department let a bd to provide IS with temporary
contract staffingfor professional services for staff augmentation on an "as neededwbasis.
IS is employing a new staffing model which utilizes permanent staff to meet the ongoing level of S W ~ C ~
maintenance requirements of the department, while using contract personnel to meet peak load requirements
including the development of new projects. The contract staff will be used on an 'as needed" basis to supply
specific business, technological, application skill, or backfill existing support demands in an effort to accommodate
new work, while maintaining service levels on existing work.

The benefits of this staffing model are as follows:
.* a) Cost avoidance by not hiring permanent staff based on fluctuations in project workload.
b) Immediate availability of a wide breath and depth of resource skill and experience levels limited only by the
c) Ability to allow InformationSystems employees the opportunity to develop and learn new skills by providing
cross-training by making it part of the mission that the temporary resources train internal staff as part of the
d) Reduce reliance on consulting engagements by creating a 'on demand' resource pool, that has consistent
skill, delivery and expectations defined.
The estimated annual expenditure for staffing augmentation in P/07 is $3 million. This equates to approximately
onehalf of the total estimated costs of new projects and initiatives slated for the year. Actual expenditures incurred
will be a function of specific project requirements.
The contract is efFective for twenty-four (24) months from the date of the award and has one (1) twenty-four (24)
renewal beyond the primary contract period. The renewal will allow for price adjustments in an amount not to
exceed the average of the Consumer Price index (CPI) for Urban Wage Earners and Clerical Workers Not
Seasonally Adjusted. U.S. Ci Average, all items for the twelve (12) months prior to renewal, or h e (5%) percent,
whichever is less.
