BYLAWS of the Sacramento City Unified School District (SCUSD) DISTRICT ADVISORY COUNCIL ARTICLE I – NAME
Announces the full legal name of the organization.

The name of this committee shall be District Advisory Council, hereinafter referred to as DAC. ARTICLE II – OBJECT (or Purpose)
States why the organization exists.

The purpose of the DAC shall be to fulfill California education code mandated responsibilities as an advisory to the SCUSD Board of Trustees, to provide a “voice for parents”, and to advise the Board on all issues affecting the education of the students in SCUSD. ARTICLE III – MEMBERS
Explains who can be a member, how to join; and explains rights, duties and obligations of membership.

A. COMPOSITION 1. Parent Representative Member: 49 (7 per SCUSD Board trustee area) parents/guardians elected at a (June) district wide meeting of families in Title One/SCE programs. 2. School Site Council (SSC) Representative Member: Two parent/guardians, students or community members and one staff member elected from each SSC of SCUSD public, private, and charter schools. 3. Advisory Representative Member: Any person who completes a DAC interest form. B. RIGHTS and LIMITS 1. Parent Representative Member (Parent Rep) shall have voting rights, may serve as a DAC officer, and may serve on all committees as member or chair. In addition, their votes are the compliant (determine outcome) votes for all Title One/SCE assurances such as, but not limited to, Con App 1 & 2, Local Education Agency Plan (LEAP)and any required Addendums or revisions. 1. SSC Representative Member (SSC Rep) shall have voting rights, may serve as DAC Secretary or Auditor, and may serve on all committees as member or chair. Their votes are preferential (don’t determine outcome) votes for all Title One/SCE assurances such as, but not limited to, Con App 1 & 2, LEAP and any required Addendums or revisions. 3. Advisory Representative Member: shall not have voting rights, may not serve as an officer or as a committee chair but may participate in the DAC and serve as a committee member. C. TERM Members shall serve for two years. Members can be elected or enrolled for additional terms.

D. VOTING PROCEDURE Each voting member to the DAC shall be entitled to one vote indicator to raise on each action item submitted to a vote by the DAC. Proxy and absentee voting shall not be permitted. E. TRANSFER OF SEAT A seat for a member to the DAC is not assignable or transferable. F. TERMINATION OF SERVICE A member may resign by the filing of a written resignation with the DAC secretary. A voting member shall no longer vote should s/he terminate her/his relationship with the group s/he was elected to represent. Membership shall automatically terminate for any person who is absent from all regular and special meetings for a period of three consecutive months. The DAC by affirmative vote of two-thirds of all of the voting members of the DAC may suggest to a school that a representative be replaced or may suspend a member. G. VACANCIES Unexpired terms of Parent Representatives shall be filled by the ranked results of the district wide election. Unexpired terms of SSC Representative members shall be filled by the SSC. ARTICLE IV – OFFICERS
Provides for officers, how they are chosen, how long they serve, and their duties.

The officers of DAC shall be president, first vice-president, second vice-president, secretary, and [auditor]. A. Qualifications. To qualify for any office an individual shall have been attending DAC meetings since September (with only [number] absences) of current year and must be a voting member. To qualify for the office of president or first vice-president, a voting parent shall have attended DAC meetings for a period of two years with only [number] absences. B. Term of Office. All officers shall serve for a term of two years or until their successors are elected. Terms shall begin on July 1. C. Duties of Officers. Officers shall perform the duties prescribed by these bylaws and by the parliamentary authority adopted by the DAC. 1. The President shall be the official representative/spokesperson of the DAC. The president shall be an ex-officio member of all committees except the nominating committee. 2. The First Vice President shall preside in the absence of or at the request of the president, perform other duties as may be requested by the president, and shall serve on the SSC Liaison Committee.

3. The Second Vice President shall preside in the absence of or at the request of the president and the first vice president, perform other duties as may be requested by the president, and shall serve on the Advisory Committees Liaison Committee. 4. The Secretary shall prepare meeting agendas, record minutes for meetings and maintain minutes for all meetings, the list of current standing and special committees and members, and voting member rosters. These shall be available at every meeting as well as a copy of DAC bylaws, DAC standing rules, applicable SCUSD Board Policy and CA Education Code, 5. The [Auditor] shall be the custodian of the official copies of the district fiscal reports applicable to DAC activities and the expenditure reports that require DAC review for purposes of providing advice. E. Nominations and Election of Officers. 1. Nominating Committee. The nominating committee shall be elected by the voting members at the regular meeting in April. The committee shall report the nominees to the membership at the May meeting, and post on SCUSD DAC website. 2. Elections. Elections shall be held at the regular meeting in June by ballot. A plurality [majority, instant runoff ] shall elect. In the event there is but one nominee for any officer, the vote for that office may be taken by voice vote. 3. Consent of Nominees. No name may be placed in nomination without the consent of the nominee. F. Vacancies/Removals. 1. A vacancy in the office of president shall be filled by the first vice-president for the unexpired term of the president. 2. A vacancy in any other office shall be filled by the nominations committee presenting a list of candidates, followed by elections, both at the next available opportunity, for the unexpired term. 3. Officers may be removed from office by a two-thirds vote of the voting membership. ARTICLE V – MEETINGS
Describes when regular, special, and annual meetings are held, how they are called, and the quorum required.

A. Regular Meetings. There shall be at least twelve regular meetings of the DAC to be held on the 2nd Tuesday of the month. B. Annual Meeting. The regular meeting in September shall be the annual meeting for the purpose of presenting the LEAP and the annual DAC calendar. C. Orientation Meetings. The regular meetings in July and August shall be the orientation meetings and shall be limited to the board orientation regarding parliamentary procedure, a review of the current LEAP and the preparation of the annual DAC calendar. D. Special Meetings. Special meeting of the membership may be called by the president, a majority of the Board or by a [percent, number] of [voting members], in the form of a written

petition, provided that notice shall be sent to the members at least ten days prior to the date of the meeting. Notice can be provided through the DAC website. E. Quorum. A quorum shall be [number, percent] of voting members in attendance providing the majority of voting members present are parents. F. CONFERENCE ITEMS All agenda items for consideration and recommendation by the DAC shall be presented first as a conference item. Whenever, because of a time urgency, an agenda item is to be presented for conference/action consideration, DAC will receive no less that ten (10) calendar days prior to the scheduled meetings, information concerning the conference/action agenda item and the reason for the conference/action consideration. ARTICLE VI – BOARD of [MANAGERS, FACILITATORS, DIRECTORS]
Describes the composition and duties of the board, what power is given to the board, board meetings, action without meetings, and quorum.

D. The board shall not ……………… ARTICLE VII – COMMITTEES
Provides for standing and special committees and the power to appoint them. May include duties of committees.

A. Standing Committees shall be 1) Bylaws, 2) Consolidated Application, 3) Advisory Committees Liaison, 4) Financial Review, 5) Local Education Agency Plan (LEAP) Analysis, 6) Membership, 7) SSC Liaison, and 8) Program. All standing committees shall consist of at least three members and be selected by the board for the approval of voting members in September. ARTICLE VIII - PARLIAMENTARY AUTHORITY
Prescribes the parliamentary authority.

The rules contained in the current edition of Robert’s Rules of Order Newly Revised shall govern the DAC in all cases to which they are applicable and in which they are not inconsistent with these bylaws, Sacramento City Unified School District Board Policy and Administrative Regulations, California Code of Regulations, California Education Code, and United States Federal Education Law and Regulations. ARTICLE IX - AMENDMENTS OF AUTHORITY
Establishes the method to change bylaws or rewrite them completely.

These bylaws may be amended by the voting membership at any regular meeting of the DAC by a two-thirds vote, provided that the written amendment has been provided at the prior meeting and posted on the DAC website.
