FORT MCPHERSON MILITARY COMMUNITY SET A SIDE PROGRAM
PROCEDURES

THE SET ASIDE PROGRAM IS ONLY AN OPTION. THE HOUSING SERVICE
OFFICE (H.S.O.) CAN ALSO ASSIST YOU WITH A VARIETY OF OFF-POST
HOUSING ALTERNATIVES.

The Fort McPherson Military Community and local Management
Companies have formed a partnership in establishing the Set Aside
Housing Program for the military as alternative housing.

Establishment of the Set Aside Program allows military personnel the
flexibility of obtaining off-post rental housing at reduced rental rates.

Occupancy in an apartment complex participating in the Set Aside
Program does not guarantee a “trouble free” tenancy and should not be
confused with government housing. Efforts have been made by the Fort
McPherson Housing Service Office in the selection process to eliminate
those apartments deemed inappropriate or unacceptable.

NOTE: SERVICE MEMBER WILL PAY FIRST MONTH’S RENT UPON MOVE-
IN WITH A CASHIER CHECK OR MONEY ORDER.
                       HOUSING SERVICE OFFICE:


RENTAL PAYMENTS:

     Initial payment shall be paid with a cashier’s or money order.
     Must be able to pay rent through allotments.

LEASE TERMS:

     Mandatory one-year lease agreement.
     Abide with terms specified in lease agreement.

INSPECTIONS:

     Initial inspection prior to move in with the property manager.

LANDLORD/TENANT CONCERNS

     Service member shall contact the Property Management Office for
      resolution of problems identified. If not satisfied, service member
      can contact the Set A-Side coordinator office for further assistance
      or military legal services.


EARLY TERMINATION:

     May result in serious penalties.
     Refer to your lese and consult with your H.S.O. office.
     If necessary, contact the military legal office.

MILITARY CLAUSE:

     In accordance with the Official Code Of Georgia O.C.G.A. § 44-7-22 &
      (Senate Bill 258, passed 2005) if you have entered into a rental
      agreement, or a modification thereof, on or after 01 July 2005,
      O.C.G.A. Section 44-7-37 Service member’s family may terminate a
      lease prematurely upon receipt of orders (PCS) or temporary duty
      orders (TDY) with duty excess of 60 days that is at least 35 miles
      away. A 30-day written notice must be submitted with a copy of
      said government orders.
LEASE EXPIRATION/RENTAL INCREASE:

     Property Management may offer several renewal options prior to the
      initial lease expires.

VACATING PROCEDURES

     Refer to the lease for vacating procedure.
     Schedule final inspection with property management office.
     Furnish property management and housing service office with a 30-
      day notice, copy of government orders, and a forwarding address.
     H.S.O. will complete DD Form 2558, Stop Allotment; in the housing
      service office. The set a-side coordinator who will then forward the
      form to the Defense Military Pay Office for processing.

ON POST GOVERNMENT FAMILY QUARTERS

Service member that is eligible to apply for government family housing
will not be assign to the government housing until the service member
fulfill the year’s lease agreement. Interested parties should see the family
housing section for placement of their name on the government’s housing
waiting list.

Housing Service Office H.S.O. duties

  1. Brief service member on specifics of the Set Aside Program.
  2. Issue a Set Aside procedures, packet with prices and driving
     directions to rental properties.
  3. Receipt of a Letter of Intent (LOI) from a rental property,
  4. Process DD Form 2558, Start Allotment, for the approved applicant.

  AGREEMENTS THAT I WILL COMPLY WITH TO QUALIFY FOR THE
                   SET-A-SIDE PROGRAM


I                                  have been counseled by the Set
Aside Coordinator of the Housing Service Office and understand that if
I elect to accept an apartment rental above my combined allowances
(BAH), I am responsible for paying the cost above this allowance.

            I understand, in the event that I receive Permanent Change
of Station (PCS) orders, retirement/separation orders, or temporary
duty orders (TDY) for a period in excess of two ( 2 ) months, that my
maximum tenant liability for rent will NOT EXCEED 30 days, providing
proper notice had been given. Proper notice includes: providing the
property manager a copy of such orders, provide a written notice of
intent to vacate property, and pay the 30 day notice rent.

            I understand that if I terminate my lease agreement
prematurely because of my own personal reasons, I may incur serious
penalties. Upon my vacating of property, I am responsible for paying
all monies due, according to the early termination clause specified in
written lease. I will contact the property management’s office for
specific amount due.

            I understand that to participate in this program I must be
on active duty assigned to Fort McPherson/Fort Gillem, or within the
Atlanta area. I must be eligible to initiate an allotment immediately,
have at least one year remaining in the area. (Copy of orders,
extension and/re-enlistment will be verified by my first sergeant).

            A housing representative will issue both letter and
verification of eligibility.
             I understand that it is my responsibility to make visits to
each set-a-side property that I may be interested in prior to making my
final selection.

            I understand that a copy of the letter of intent will be
provided to the housing service office representative.

            I understand that I must complete the set aside
application, which includes an initiation of an allotment in the
government housing office. (DD-2258 Start/Stop Allotments attached)

          I understand that I must contact the property
management office, for an initial inspection prior to moving in.

          I understand that I must contact with the property
management office, for final inspection prior to moving out.

             Each property management office will have their policies,
ordinances, and or regulations. It is my responsibility to inquire and
adhere accordingly.

           Upon my decision to vacate the property, I will notify and
clear through the Government Housing Office prior to initiating a
stoppage of allotment of payment to the rental property.

           Sixty days (60) prior to expiration of lease and terms, I
understand that I am required to provide to the rental property
manager advance notice in writing of my intent to renew or vacate the
property.

             I understand that if I fail to follow any of the above
instructions, my eligibility to participate in this program will be
revoked and any reduced rent, and or wavered fees will be owned at
that time.

                  VERIFICATION OF ELIGILITY




   Member is eligible for all available rentals on Set-Aside Program
   that do not exceed monthly’s rent $________________.

   hereby understand through my participation in the Fort
   McPherson/Gillem Army Base Set-Aside Program that when I sign
   a lease, it will be for a period of 12 months under the terms of
   the Agreement between Fort McPherson / Gillem Base and the
   approved landlord. In the event I receive a Government directed
   move (i.e., PCS, early release, retirement, my lease may be
   terminated with proper notice. I understand I maybe required
   paying a liquidated damage (s) fee for early termination for other
   than above reasons.

   The conditions are no up front security deposits and other
   deposits. I understand that I must execute an allotment to have
   rental payments made directly to the landlord. I will not stop
   the allotment until the rental agreement is fulfilled.

Housing Program that when I sign a lease. It will be for a 12
month term as required by the Army’s Set-Aside Agreement and
approved Landlord.

2. It is my understanding that my lease may be terminated after giving
a proper 30day written Notice in the event that I receive a government
directed move, i.e., P.C.S, Retirement Military Separation, or TDY (for
a period in excess of three (3) months).

Signing this Set-aside application acknowledges that I intend to rent at
the complex from which the letter of intent is received, with the
conditions that is set by the guidelines and principles of the Set-A-Side
Program. Payments for rent will be established using the allotment
system. Allotment will be effective not later than the third month of
occupancy. All allotment transactions will be conducted thru the
Housing Referral Office at Ft. McPherson. I understand that failure to
comply with these requirements will result in the lease being converted
to a NON-SET-A-SIDE STATUS. When being converted to a non-set-a-
side status, I will be subjected to repayment of discounts that is
afforded to the set-a-side participants and any application fees.
