NDDOT/AGC Contractor Training
The NDDOT and AGC will be offering two free contractor training sessions! Topics will include: electronic bidding, quoting, electronically accessing plans and proposals, electronic payrolls, and exploring the Constructions Services and Civil Rights Division’s web sites. There will be a ―meet-and greet‖ sponsored but the AGC the evenings of March 17th and March 25th.
The sessions are free and open to all highway construction prime contractors and subcontractors.

Changes in the Family Medical Leave Act and the Americans with Disabilities Act Affect Small Employers

Two major changes in employment law will go into effect in January: amendments to the American with Disabilities Act (ADA) and revisions to the Family and Medical Leave Act of 1993 (FMLA). President Bush signed the ADA Amendments Act into law in September, and the Act takes effect on January 1, 2009. The amendments overturn a series of Supreme Court cases, expanding the number of workers who are considered disabled under the ADA and increasing the number of employers that must make reasonable accommodations for these employees. The ADA defines a ―disability,‖ in part, as ―a physical or mental impairment that substantially limits a major life activity of an individual.‖ The ADA Amendments Act emphasizes that this statute should be broadly interpreted to cover more individuals, and in particular, it directs the Equal Employment Opportunity Commission to interpret the term ―substantially limits‖ in a future rulemaking. The amendments also provide commonly used examples for the undefined ADA term ―major life activity,‖ such as seeing, eating, sleeping, and thinking. This provision also adds ―major bodily functions‖ such as ―functions of the immune systems, digestive, and neurological functions‖ to this list, which could lead to an expansion of workers considered disabled under the ADA. This Act also makes it easier for individuals to claim that they are disabled based on the perception of disability (the ―regarded as‖ prong of the ADA). The amendments state that the beneficial effects of mitigating measures such as medications or prosthetics will not be considered in assessing whether an individual has a disability (there is an exception for eyeglasses or contact lenses). They also clarify that an impairment that is temporary or in remission, such as epilepsy or cancer, can be considered a disability.
The ADA amendments will shift the focus of litigation from whether an employee is disabled (allowing more plaintiffs to be considered disabled) to whether there was discrimination in the workplace. They also leave many questions unsettled—for instance which disabilities will be considered to ―substantially limit‖ a major life activity and what types of reasonable accommodations employers may have to provide. A second development in employment law with important ramifications for small employers is the recently finalized revisions to the Family and Medical Leave Act of 1993 (FMLA). The new regulation takes effect on January 16, 2009. Under the FMLA, employers with 50 or more employees are required to provide up to 12 weeks of unpaid leave for the birth or adoption of a child, or for a serious health condition. This new rule clarifies how FMLA leave affects the substitution of paid leave, perfect attendance awards, and light duty assignments. This rule also specifies that leave-takers with chronic conditions are required to have two doctor’s visits a year. This rule requires four types of employer notifications and provides more time for these notifications. Employees are also required to provide sufficient and timely notification to their employers, removing provisions that allowed employees to notify their employers up to two full business days after an absence. Employers can now require employees to comply with the employer’s call-in procedures for notification. Employers can now ask for annual medical certifications for conditions that last over a year, and they can request re-certifications and fitness-forduty certifications under certain circumstances. The rule also sets new timelines for medical certification requests. A new military caregiver provision also expands FMLA coverage for family members taking care of covered service members. The Department of Labor did not reform two provisions recommended by the Office of Advocacy that are particularly burdensome for employers—the definition of a ―serious health condition‖ and the ―intermittent leave‖ sections. North Dakota Small Businesses, Meet the Internet!

The economics of North Dakota’s small businesses has been relatively isolated from the volatile changes facing the world’s financial markets. The state has benefited from a strong agricultural industry supported by favorable growing conditions and higher commodity prices. The redevelopment of the western oil reserves and an emphasis in research supported by the growth in funding for the Red River Research Corridor provides North Dakota with a longterm economic stimulus. Add to all of this the practical and conservative business models employed by the state’s banking community and it appears the small business community in North Dakota has so far weathered the ―financial storm.‖ One way that North Dakota small businesses should not be isolated from the rest of the nation is in the use of the Internet as a viable business tool. The original design of business internet sites ranged from a simple, static, and passive ―e-brochure‖ to the very complex and expensive ―personalized‖ designs employed by companies such as Amazon.com. The personalized sites employed sophisticated software and hardware configurations to personally greet users to the site based on information gleaned from previous visits and were used by a few companies whose business model was the Internet. Most businesses employed the e-brochure model. If your business still employs the e-brochure

model or even worse, no Internet strategy at all, you may be missing out on a tremendous business opportunity. In 2005 a new Internet configuration or model was described as ―Web 2.0.‖ This next generation web site was seen as a move from a static environment to a collaborative, creative, and interactive venue where customers exchanged information with businesses and other customers on a regular basis in a variety of formats. Web 2.0 employs the use of blogs, podcasts, video sharing, wikis, social networking, and web services to create this collaborative Internet experience for users. • Blog: an online diary; a personal chronological log of thoughts published on a Web page. • Podcast: a Web-based audio broadcast via an RSS (really simple syndication) feed. • Wiki: a collaborative, informational Web site set up to allow user editing and adding of content. • Social Networking: online communities of people who share interests and activities or want to learn more about the activities and interest of special interest groups. • Web Services: describes a standardized way of integrating Webbased applications using open standards over an Internet protocol backbone. (In other words, Web Services represents applications allowing for communication between many different computer programs and platforms. It is analogous to the system used by the United Nations to translate speeches into many different languages so there can be continuous and immediate dialog on the issues at hand.) Why is Web 2.0 so important for today’s small businesses? It represents the opening of a ―new‖ network of contacts for business owners. North Dakota small businesses have traditionally networked through local chambers of commerce; regional and national industry associations; and other social events such as the 7 am coffee group at the local
diner. These traditional network contacts have been and continue to be a valuable source of information for small business owners to gauge customer likes and dislikes. Web 2.0 not only allows another way for your local contacts to communicate with you but also brings new voices and information to your doorstep and definitely widens the awareness of your business.

Attention All Bidders
As of August 2008, the NDDOT no longer prints or sells plans and proposals. All bid documents (plans, proposals, addenda and other project information) are available on the NDDOT Electronic Plans and Proposals webpage. The documents are posted in PDF format. The documents can be viewed, printed or saved to a computer. To access the bid documents; go to the Department’s webpage http://www.dot.nd.gov/ and then under the ―Business‖ section, click on ―eplans‖. Once on the webpage, use the drop down box to select the bid opening date you are interested in. That bid opening’s projects and their corresponding bid documents are listed by job number on the webpage. Paper copies of bid documents are available for examination at the Construction Services Division office on the 3rd floor of the Transportation Building on the State Capital grounds in Bismarck. Addenda will no longer be sent to plan holders. Addenda shall be obtained from the website (same location where the plan and proposal were obtained). As per section 102.07 of the Standard Specifications, bidders shall check the website for addenda periodically and prior to submitting a bid. A Plan Holders List is available on the Department’s website. Instructions on how to get your company information put on the plan holders list is also posted on the website. Attention All Prime Bidders
The format of the NDDOT Bidders Proposal has changed. Beginning with the November 21, 2008, Bid Opening you will notice several changes. Following are highlights of the changes: 1. Bidders who submit paper proposals (with or without a diskette) shall enter their company name and other requested information on the coversheet of the Bidders Proposal. 2. The Bidders Proposal sections that require a bidder to enter information have been con solidated into one area at the front of the Bidders Proposal. This includes such sections as the Non-Collusion and Debarment Certification, Bid Limitation, Permissible Discount, Receipt of Addenda Acknowledgement, Bid Guarantee, DBE – Form A, Unit Bid Prices and Extensions, and the Contract Execution/Affidavit. 3. Bidders are no longer required to return the entire Bidders Proposal booklet when submit ting a paper proposal (with or without a diskette). Bidders only need to return the front portion of the proposal; namely the coversheet and the sequentially numbered pages titled ―PROPOSAL‖ that follow the coversheet. The last page of this group is the Contract Execution/Affidavit page. These changes do not affect the process for submitting bids via the Internet through Bid Express. NEW SAFETY VEST REQUIREMENTS
Effective November 24, 2008, a new Federal Highway Administration regulation requires all workers within the highway right-of-way on federal-aid highways to wear high-visibility safety apparel meeting Class 2 or 3 requirements of the American National Standard for High Visibility Safety Apparel / International Safety Equipment Association (ANSI/ISEA) 107-2004. Have the federal regulations changed regarding the requirement for contractors to include employees’ social security numbers and home addresses on weekly payrolls? Yes, the U. S. Department of Labor regulations concerning employees’ social security numbers and addresses on Davis-Bacon certified payrolls were changed effective January 18, 2009. The revised regulations: Remove the requirement that weekly payrolls submitted to the contracting agency contain employees’ addresses and complete social security numbers. Require that certified payrolls include an individually identifying number (i.e., the last four digits of the employee’s social security number) for each covered employee. Require that contractors and subcontractors maintain complete social security numbers and home addresses for employees; and that government agencies are entitled to request or review all relevant payroll information, including social security numbers and addresses of employees. Contractors and subcontractors are required to provide such information upon request. These revisions apply to contracts let on or after January 18, 2009.
