25   auctioneer holding a valid state Trader’s License. Private auto auctions include businesses
26   conducting on-site auctions and businesses auctioning vehicles through Internet sites.

 56       Any private automobile and other motor vehicle auction in the C-M Zone which was lawfully established prior to the effective date of this provision shall be allowed to
          continue only if:
                   (a) The use is brought into conformance with the provisions of Section 27-251.01(c);
                   (b) The use is brought into conformance with the requirements of Section 27-251.01(d) of theZoning Ordinance within two (2) years of the effective date of this
          provision; and
                   (c) The property conforms to all other standards associated with the C-M Zone.
          Until such time as all three conditions are met, the use will require certification as a nonconforming use under Section 27-244. If all three conditions are met, the property
          then shall be considered a permitted use and is not required to continue certification under Section 27-244. If the use is not brought into conformance with these
          requirements within the specified timeframe, the property owner shall cease all auction operations at the expiration of the two-year period. If the property becomes a
          permitted use under this provision, any expansion of the use shall comply with Section 27-475.06.06.

54 Any private automobile and other vehicle auction lawfully established in the I-1 or I-2 Zone prior to the effective date of this provision shall not be required to obtain
certification as a nonconforming use, but will only be allowed to
   continue if:
      (a) The use is brought into conformance with the provisions of Section 27-251.01(c); and
         (b) The use is brought into conformance with all requirements of Section 27-251.01(d) of the Zoning Ordinance
     within two (2) years of the effective date; and
      (c) The property meets all other standards associated with the I-1 or I-2 Zone.
If the use is not brought into conformance with these requirements within the specified timeframe, the property owner shall cease all auction operations at the expiration of the

 6    12 Any private automobile and other motor vehicle auction which was lawfully established in the M-X-T Zone prior
 7   to the effective date of this provision shall:
 8          (a) Only be allowed to continue if the use is brought into conformance with the provisions of Section 27-
 9   251.01(c); and
10          (b) Have two (2) years from this effective date to cease all auto auction operations on the property.

15   Sec. 27-568. Schedule (number) of spaces required, generally.
16            (a) In all zones (except the M-X-T Zone), the minimum number of required off-street
17   parking spaces for each type of use shall be as listed in the following schedule. In the schedule,
18   each "employee" means each employee on the largest shift.

 1          SECTION 2. BE IT ENACTED by the County Council of Prince George’s County,
 2   Maryland, that Section 27-251.02 be and the same is hereby renumbered:

 7   Sec. [27-251.01] 27-251.02 Nonconforming Apartment Buildings.
 8          SECTION 3. BE IT ENACTED by the County Council of Prince George's County,
 9   Maryland, that Sections 27-251.01, 27-475.06.06, and 27-630.02 of the Prince George's County
10   Code be and the same are hereby added:

13         DIVISION 6. NONCONFORMING BUILDINGS, STRUCTURES, AND USES.
14               Subdivision 2. Additional Requirements for Specific Nonconforming Uses.
15   Sec. 27-251.01. Private Automobile and Other Motor Vehicle Auctions
16          (a) In order for a certified nonconforming private automobile auction to continue, the
17   requirements of this Section shall be met, in addition to any other applicable requirements of this
18   Division.
19          (b) The purposes of this Section are:
20                   (1) To prevent or control detrimental effects upon neighboring properties, and
21   existing and proposed land uses in the general area, including noise, dust and traffic;
22                   (2) To prevent or control detrimental effects upon the subject property, including
23   excessive crowding of vehicles, discarded vehicle parts and other debris, and environmental
24   contamination from fluids or chemical residues; and
25                   (3) To prevent or control untreated stormwater runoff, which may include residues
26   from exhaust fumes, brake pads, gasoline and motor oil, to ensure that harmful materials do not
27   enter the Chesapeake Bay and its tributaries.
28          (c) All certified nonconforming automobile auctions and all private auto auctions
29   established lawfully in the I-1 and I-2 Zones prior to the effective date of this section shall meet
30   the following requirements:
31                   (1) All parking and loading shall be performed on site. Any car carrier

 1   loading/unloading area shall be located separately from customer parking areas.
 2                  (2) Parking and loading areas shall not be used for the sale, display, or storage of
 3   vehicles; performing vehicle services; or any other purpose unrelated to parking and loading.
 4                  (3) Junked, salvaged, or wrecked vehicles may not be sold or stored on the
 5   property, unless associated with an auction that regularly deals in the disposal of vehicles that have
 6   been declared total losses by insurance companies.
 7                  (4) The following is prohibited on all private automobile and other motor vehicle
 8   auction properties:
 9                            (A) Retail sales (other than by auction) or vehicles or vehicle parts;
10                            (B) The sale, display, or storage of boats;
11                            (C) Outdoor storage or display of vehicle parts;
12                            (D) Vehicle dismantling and demolition;
13                            (E) The stacking of vehicles and/or use of a vehicle rack system;
14                            (F) The parking, storage, or display or vehicles within public rights-of-way
15   or internal driveways.
16                  (5) No vehicle may be displayed or stored on the site for more than ninety (90)
17   days.
18                  (6) All auction activities, including sales, loading/unloading of vehicles, and
19   vehicle transport on or off the property shall be conducted between the hours of 7:00 a.m. and
20   10:00 p.m. seven (7) days a week.
21                  (7) The site must be kept clear of all trash, litter, and other debris. Exterior trash
22   receptacles shall be provided in all areas open to the public including those for parking, auction
23   activities, and offices and be routinely emptied. Trash and debris within the public right-of-way
24   resulting from an auction shall be immediately removed by the auto auction operator.
25                  (8) The auction operator shall maintain records of bills of sale and make those
26   records available to County inspectors upon request within thirty (30) days of the sale during
27   normal business hours to ensure that vehicles abandoned off site can be traced back to the auction
28   house and/or the purchaser.
29           (d) In addition to the requirements in Section 27-251.01(c), all certified nonconforming
30   properties within the C-M Zone and all private auto auctions established lawfully in the I-1 and I-2
31   Zones prior to the effective date of this section shall be required to meet the following provisions

 1   within two years of the effective date of this section:
 2                  (1) In addition to the landscaping requirements found in Section 4.2 of the
 3   Landscape Manual, the automobile auction shall be screened to block visibility from public rights-
 4   of-way and residential zones by a solid, sight-tight (opaque) wall or fence six (6) feet high. This
 5   fence may not be constructed of slatted chain-link, corrugated metal, fiberglass, or sheet metal.
 6   The fence or wall shall be located behind a ten (10) foot wide planted landscape strip located
 7   behind the public right-of-way.
 8                  (2) Any fencing along the property boundaries not visible from a public right-of-
 9   way or a residential zone shall be enclosed by a black, vinyl-clad, chain-link fence or other
10   material not prohibited by (d)(1) above.
11                  (3) All areas used for vehicle sales, display, parking, or storage shall be on a paved
12   concrete or asphalt surface.
13                  (4) Ingress and egress driveways shall have a minimum width of thirty (30) feet
14   and shall be paved with concrete and meet with DPW&T commercial driveway standards. Drive
15   aisles for internal circulation shall have a minimum width of twenty-two (22) feet and shall be
16   paved with either concrete or asphalt.
17                  (5) Paved surfaces shall be maintained in good repair.
18                  (6) The applicant shall identify the dust-control measures to be used on the site.
19                  (7) The parking, loading, and vehicle storage and display areas associated with an
20   automobile auction shall be considered an environmental “hot spot” with regard to the stormwater
21   management facilities required, and as such shall provide on-site water quality treatment in
22   addition to an approved prevention plan as required by the County Stormwater Ordinance.
23                  (8) The applicant shall provide evidence that the disposal of all fluids and other
24   materials will be accomplished in a manner that complies with all County, State, and Federal
25   regulations.
26                  (9) All lighting shall be directed away from adjoining properties.
27                  (10) No signs permitted by Part 12 of this Subtitle shall be placed on the exterior
28   of any fence visible from the public right-of-way, nor shall any flags, banners, pennants, or similar
29   items mounted, suspended, or otherwise displayed for advertising be visible from the public right-
30   of-way.
31                  (11) Any sign permitted under Part 12 of this Subtitle shall contain the date and

 1   time of the auction with a contact phone number for further information.
 2                    (12) If an amplified public address system is utilized for the auction’s sales
 3   activities, the sales activities shall be located five hundred (500) feet from any land within a
 4   residential zone. If this condition cannot be met, all sales shall be conducted within a wholly
 5   enclosed building.
 6   (e) The requirements of Subsections (c) and/or (d) above shall apply to all nonconforming
 7   automobile auctions, regardless of any prior nonconforming use status.
 8                                            SUBTITLE 27. ZONING.
 9                                     PART 7. INDUSTRIAL ZONES.
10              DIVISION 5. ADDITIONAL REQUIREMENTS FOR SPECIFIC USES.
11   Sec. 27-475.06.06. Private Automobile and Other Motor Vehicle Auctions.
12           (a) A Private Automobile and Other Motor Vehicle Auction may be permitted subject to
13   the following:
14                    (1) Requirements:
15                           (A) The auction shall be located on a parcel or parcels with a total area not
16   less than ten (10) acres.
17                           (B) The auction shall have direct access to, at minimum, a commercial
18   street with a right-of-way width of seventy (70) feet and pavement width of forty-six (46) feet.
19                           (C) No direct access shall be provided to or from residential streets.
20                           (D) Driveways for ingress and egress shall be identified on the site plan and
21   shall be located so as not to endanger pedestrians or create traffic hazards. Ingress and egress
22   driveways shall have a minimum width of thirty (30) feet and shall be paved with concrete. Drive
23   aisles for internal circulation shall have a minimum width of twenty- two (22) feet and shall be
24   paved with either concrete or asphalt.
25                           (E) All areas used for vehicle sales, display, parking or storage shall be on a
26   paved concrete or asphalt surface.
27                           (F) Paved surfaces shall be maintained in good repair.
28                           (G) The applicant shall identify the dust-control measures to be used on the
29   site.
30                           (H) All parking and loading shall be performed on-site. Any car carrier
31   loading /unloading area shall be located separately from customer parking areas.

18   transport on or off the property shall be conducted between the hours of 7:00 a.m. and 10:00 p.m.
19   seven (7) days a week.
20          (d) If an amplified public address system is utilized for the auction’s sales activities, the
21   sales activities shall be located five hundred (500) feet from any land within a residential zone. If
22   this condition cannot be met, all sales shall be conducted within a wholly enclosed building.
23          (e) The parking, loading and vehicle storage and display areas associated with an
24   automobile auction shall be considered an environmental “hot spot” with regard to the stormwater
25   management facilities required, and as such shall provide on-site water quality treatment in

30   Manual, the automobile auction shall be screened to block visibility from public rights-of-way and
31   residential zones by a solid, sight-tight (opaque) wall or fence six (6) feet high. This fence may not

 1   be constructed of slatted chain-link, corrugated metal, fiberglass, or sheet metal. The fence or wall
 2   shall be located behind a ten (10) foot wide planted landscape strip located behind the public right-
 3   of-way. In lieu of a sight-tight fence or wall and landscape strip, a landscaped berm may be
 4   provided. The applicant must demonstrate that the planted berm is equally or more effective than
 5   the fence or wall and landscaped strip in terms of quality, durability, hardiness, and ability to
 6   screen the use.
 7          (h) Any fencing along the property boundaries not visible from a public right-of-way or a
 8   residential zone shall be enclosed by a black, vinyl-clad, chain-link fence or other material not
 9   prohibited by (2) (g) above.
10          (i) All lighting shall be directed away from adjoining properties.
11          (j) No signs permitted by Part 12 of this Subtitle shall be placed on the exterior of any
12   fence visible from the public right-of-way, nor shall any flags, banners, pennants, or similar items
13   be mounted, suspended or otherwise displayed for advertising be visible from the public-right-of-
14   way.
15          (k) Any sign permitted under Part 12 of this Subtitle shall contain the date and time of the
16   auction with a contact phone number for further information.
17          (l) The site must be kept clear of all trash, litter and other debris. Exterior trash receptacles
18   shall be provided in all areas open to the public including those for parking, auction activities, and
19   offices and be routinely emptied. Trash and debris within the public right-of-way resulting from an
20   auction shall be immediately removed by the auto auction operator.
21          (m) The auction operator shall maintain records of bills of sale and make those records
22   available to County inspectors upon request within thirty (30) days of the sale during normal
23   business hours to ensure that vehicles abandoned off-site can be traced back to the auction house
24   and/or the purchaser.

26                            (A) A Detailed Site Plan shall be approved for the auction, in accordance
27   with Part 3, Division 9, of this Subtitle, to ensure compliance with the provisions of this Section.
28   In addition to the submittal requirements of Part 3, Division 9, the site plan shall identify:
29                                     (i) All storage, vehicle display, loading and unloading, and auction
30                                     sales areas;
31                                     (ii) Internal circulation;

 1                                    (iii) Stormwater management facilities including those for water
 2                                    quality;
 3                                    (iv) Proposed hours of operation;
 4                                    (v) Dust control measures to be used.
 5                           (B) In addition to the above requirements, the application shall be
 6   accompanied by:
 7                                    (i) A Traffic Impact Analysis which identifies the volume of traffic
 8   expected to be generated by the operation and the streets to be used between the site and the
 9   nearest intersection;
10                                    (ii) A Lighting Plan showing a photometric diagram and details of
11   all light fixtures and full cut-off optics.
12                           (C) The Planning Board shall find that the proposed hours of operation, site
13   design and anticipated traffic levels will not be detrimental to the use or development of adjacent
14   properties and the general neighborhood.
15                           (D) All information required as part of the DSP application shall be referred
16   to the Traffic and Stormwater Management Divisions of the Prince George’s County Department
17   of Public Works and Transportation, the Maryland State Highway Administration, the Prince
18   George’s County Department of Environmental Resources and the Maryland Department of the
19   Environment for review and comment.
20                                                 PART 12. SIGNS.
21                                  DIVISION 3. DESIGN STANDARDS.
22                            SUBDIVISION 5. SIGNS FOR SPECIFIC USES.
23   Sec. 27-630.02. Private Automobile and Other Motor Vehicle Auctions.
24           (a) No signs permitted by Part 12 of this Subtitle for a private automobile or other motor
25   vehicle auction shall be placed on the exterior of any fence visible from the public right-of-way,
26   nor shall any flags, banners, pennants, or similar items be mounted, suspended or otherwise
27   displayed for advertising visible from the public-right-of-way.
28           (b) Any sign permitted under Part 12 of this Subtitle shall contain the date and time of the
29   auctionwith a contact phone number for further information.
30           SECTION 3. BE IT FURTHER ENACTED that this Ordinance shall take effect forty-five
31   (45) calendar days after its adoption
