                                              SECTION I
                                          SELECTION PROCESS

A.   INTRODUCTION
     This document shall serve to provide interested parties with specific information as to the procedures for
     selection of Architectural Services where the method of compensation is a Negotiated Fee for THE
     SCHOOL DISTRICT OF LEE COUNTY, FLORIDA. Pursuant to the Florida Consultant's Competitive
     Negotiation Act, Section 287.055 F.S., The School Board of Lee County, Florida (hereinafter referred to as
     the “Board”), will consider the contracting of an Architect, (hereinafter referred to as the "Architect"), for
     providing professional services for:

     PROJECT: Request for Qualification – CS#266 – Villas Elementary School
     The Board is seeking expressions of interest for Architectural Services to work with the Department of
     Construction Services and the selected Construction Manager on the project described above. The
     Architectural firm shall be responsible for creation of an architectural site plan, design development,
     creation of construction drawings, and construction administration.

     Business entities interested in providing Architectural services to the Board are hereby notified that a sealed
     Qualifications Statement for providing the required services must be received by 3:00 pm, local time, on
     Wednesday, September 30, 2009, at The School District of Lee County, Support Services Annex Central,
     Department of Construction, 3308 Canal Street, Fort Myers, FL 33916.

     Qualification Statements will ONLY be accepted from firms who attended the Mandatory Pre-Submittal
     Meeting.

     This general information application packet shall serve to provide interested parties with general information
     as to the procedures for selection of architectural services for the Board.

B.   GENERAL INSTRUCTIONS
     1.    The response shall be clearly identified as:

           Due no later than 3:00 p.m., Wednesday, September 30, 2009.
     The response shall be submitted in a sealed envelope addressed to:

     3.    Three (3) original responses must be furnished on or before the stipulated deadline. Response must
           arrive at the address listed above no later than 3:00 p.m., local time, to be considered.

     4.    Any questions concerning the Request for Qualifications shall be directed in writing via e-mail to the
           Secretary of the Department of Construction Services, 3308 Canal Street, Fort Myers, FL 33916, at
           nancyw@leeschools.net. Any response resulting in an Addendum will be delivered to all persons
           who attend the mandatory meeting. Otherwise, all responses will be made in writing only to the
           person making inquiry, and copies of the same will be available at the Office of the Director,
           Department of Construction Services, The School District of Lee County, Florida. Applicants that do
           not comply with the Board’s Procedures or deadlines established will not be considered. The Board
           will retain all application information received. Responses received after the stipulated date and time
           will not be accepted and will be returned unopened to the Applicant.

     5.    The Board is not liable for any costs incurred by the Applicants prior to the issuance of an executed
           contract.

     6.    The contents of the proposal of the successful Applicant will become part of the contractual
           obligations.

     7.    All information submitted by Applicants is subject to the Laws of Perjury as set forth in Chapter 837,
           Florida Statutes. In the event an Applicant is found to have committed perjury, such Applicant shall be
           ineligible for consideration for future projects. The minimum qualifying information outlined in Sections
           I and II shall be submitted by an Applicant as a prerequisite for consideration by the Committee and
           the Board. In order to facilitate selection by the Committee, Applicants are required to respond and
           index their submittals with the same paragraph notations as in Section II, Qualification Statement
           Format. The questionnaire is included with the RFQ.

     8.    Proposals must be typed or printed. All corrections made by the Applicant prior to the opening must
           be initialed and dated by the Applicant.

     9.    All firms are hereby placed on notice that the Board, school-based staff, District level staff and
           members of the Professional Selection Committee do not wish to be lobbied either individually or
           collectively about this project. Firms and their agents are hereby placed on notice that they are not to
           contact members of the Board or staff members for such purposes as holding meetings of
           introduction, dinners, etc. in the attempt to influence the outcome of the selection process, if they
           intend to, or have submitted a proposal or Letter of Interest for this project.

C.   ARCHITECT DUTIES
     The Board intends to award a contract to the company that it deems most qualified and responsive to this
     request.

D.   PROJECT DESCRIPTION
     The scope of this project includes but is not necessarily limited to: HVAC Mechanical Design, Roof Design
     for Music/Art Classroom, Window/Exterior Wall Re-Design, Flooring, Complete re-do of 2 Restrooms, Clinic
     Remodel, Cabinets, Data, Power for Data, New Door in ESE Class, Exit hardware at Gate by new ESE
     Door, Removal of partitions and new wall in its place, Repair Leak in Media Center, New Grid & Lighting,
     Demolish Outdoor Amphitheater and Move Canopy.

     Project Name - Villas Elementary
     The property is located at 8385 Beacon Blvd, Fort Myers. It includes the following strap numbers 13-45-24-

     All responses to the R.F.Q., with the exception of sample items which typically are generated in larger
     format, shall be submitted in an 8-1/2" x 11", edge-bound format. Covers may be slightly larger. Sections
     shall be tabbed to correspond to the headings listed in the R.F.Q. Contents shall be in conformance with
     requested criteria utilizing the applicant firm’s phrasing to complete the requested listing.

                                SECTION II
          RESPONSE TO REQUEST FOR QUALIFICATION STATEMENT FORMAT

A.   RESPONSE TO R.F.Q.
     Sections shall be numbered and tabbed to correspond with the headings listed in bold and underlined
     type. Regular type and underlined headings are to be specifically addressed within each section. The
     response to this request for qualification must be presented in the following order and format.

     TABLE OF CONTENTS

     1.   LETTER OF INTEREST (Yes/No)
          Limited to one page, signed and sealed with corporate seal.
          If not included, the review will be terminated.

     2.   INSURANCE AND LICENSING REQUIREMENTS (Yes/No)
          If not included, the review will be terminated.

          Liability Insurance - The Firm shall provide a copy of their current insurance information in the
          form of an insurance certificate. Listed below are the following requirements:
               Worker’s compensation insurance to comply with Florida Statutes. Insurance must cover all
                    employees and meet statutory limits in compliance with applicable state and federal laws.
                    Coverage must include employees' liability with a minimum limit of $500,000 for each
                    accident.
               Comprehensive general liability insurance, vehicle public liability and property damage in
                    minimum amounts of $1,000,000.00 per occurrence, combined single limit for bodily injury
                    liability and property damage liability. This shall include premises and operations broad-form
                    property damage; XCU coverage; independent contractors; products and completed
                    operations and contractual liability. Aggregate amount for this coverage will be no less than
                    $2,000,000.00.
               Business Auto Liability insurance shall be carried by the contractor and all subcontractors.
                    The contractor and all subcontractors shall maintain automobile liability insurance against
                    bodily injury, accidental death and property damage, in limits of not less than $500,000 per
                    claimant, $1,000,000 per occurrence. Coverage shall be for all vehicles used in connection
                    with the contract, whether owned, non-owned or hired.

                  Contractor shall, at the time of submittal of contract, supply documentation verifying that all
                  liability policies required by this contract are written and backed in full by companies
                  authorized to conduct business in the state of Florida, and rated by A. M. Best Rating Guide
                  as "A" or better.

                 Additional liability insurance (umbrella form) in an amount no less than $1,000,000.00
                  coverage.
                 All insurance shall be obtained from an insurance company duly qualified, authorized and in
                  good standing in the State of Florida.

          If coverage amounts do not meet the District’s requirement upon submittal of the RFQ, a letter
          from your Insurance Company stating that they will issue insurance in the type and amount
          required to cover your firm (if your firm is awarded the contract) constitutes acceptable proof
          of ability.

          Special Provisions: The School Board of Lee County shall be listed as an additional insured on the
          certificate of coverage for both the comprehensive general liability and the business auto liability
          policies. Said certificates of coverage shall be forwarded to Nancy Whann at Construction Services
          immediately upon contract approval and before the contracted project begins.

     Current valid insurance policies meeting the requirements herein identified shall be maintained for the
     duration of the named project. Renewal certificates shall be sent to the School Board 30 days prior to
     any expiration date. There shall also be a 30-day notification to the School Board in the event of
     cancellation or modification of any stipulated insurance coverage.

     Certificates of insurance meeting the required insurance provisions shall be kept on file at the
     Department of Construction Services of The School Board of Lee County.

     Licenses and Certificates- The Architect agrees to maintain professional liability insurance coverage
     with an insurance company licensed to do business in the State of Florida with limits of Coverage no
     less than $1,000,000.00 for a period of no less than the final completion date set upon award of this
     Contract. There shall be no charge to the Owner for such professional liability insurance coverage
     Copies of current State of Florida professional registration license renewals for the applicant
     (Architect Business License [excluding sole proprietorships] and all key professional personnel
     Licenses)to be used on the project. An applicant shall be properly registered to practice in the State
     of Florida with the appropriate state board governing the services offered. Applicants must possess
     and provide a copy of a Lee County Local Business Tax Receipt (F/K/A Lee County Occupational
     License) or a Lee County Municipality Tax Receipt for the period of 1 year prior to publication of the
     advertisement. The committee may verify the current status with the appropriate state board. Provide
     copies of current State of Florida Department of Professional Regulation Board of Architecture and
     Interior Design Certificate of corporation authorization showing (1) License number; (2) Certificate of
     Authorization date, and (3) designation of professional(s) qualifying the corporation to practice as an
     Architect Business.

3.   FINANCIAL RESPONSIBILITY (0-10 points)
     Provide information indicating financial capability of the firm to provide the resources required,
     including:

     Financial Statements: Audited financial statements for the most recent two (2) years, including
     income statement, balance sheet, statements of change in financial position and notes to financial
     statements. If audited financial statements are unavailable, provide similar unaudited statements.

     The results of the Financial Responsibility, Criteria 3 will be derived in the following manner:

     Two points will be awarded for providing audited financial statements with comparative years and
     notes to the financial statements. Points will be deducted when notes to the financial statements are
     not provided, if the financial statements are not comparative, or an independent certified public
     accountant did not audit them.

     Two points will be awarded for the applicant to be in good standing with the IRS and the Florida
     Division of Corporations. The applicant’s IRS and Florida Corporation standings will be reviewed to
     assure that the applicant is in good standing. We will review the Florida Department of State, Division
     of Corporations, website to assure that the applicant is properly registered and that a Federal
     Employer Identification number has been assigned to them.

     Six points will be awarded for four financial statement ratios. The applicant’s financial statements will
     be used to generate four financial statement ratios. Each ratio has a potential of 1.5 points. An
     applicant’s pool average and an applicant’s pool median will be generated. The industry median will
     be used to determine how much of the 1.5 points each company earns. Points will be added from the
     four different categories to determine how many total points the company earns for financial
     statement strength.

     Example: Points will be scored by the District Audit Department as follows:

     Financial Statement                                  0 – 2 points
     IRS and Florida Corporation Standing                 0 – 2 points
     Financial Statement Ratio (4)                        0 – 6 points




     Points from each of the three categories will be added together to determine the applicants overall
     rating.

     Provide any recent or anticipated merger, acquisition, or change in the business status of the Firm.
     State the date of the Firm’s inception.

     For clarification or any questions regarding this section (Financial Responsibility) please contact the

     NOTE: Proposers wishing to preserve the confidentiality of the information requested by question No.
     3 should provide the financial information in a separate envelope labeled ''Confidential Proprietary
     Financial Information." This information will not be considered a public record, pursuant to the
     exemption provided in Section 119.071(1)(c), Florida Statutes.

4.   RELATED DESIGN EXPERIENCE (0-10 points)
     Educational Projects        .25 points each for Educational projects (up to 10 projects)
     Equal Size and Cost         .25 points each for Projects submitted of the same size and cost
                                 of the RFQ project (up to 10 projects).
     Construction Administration .25 points each for Construction Administration projects. CM
                                 must be listed (up to 10 projects)
     Anticipated Staff           .25 points each for each anticipated staff for the RFQ project (up
                                 to 10 staff)

     List the projects which best illustrate the experience of the firm in Sections a, b, and c, below and
     current staff who will be assigned to this project in Section d, below.

     The same projects can be used in categories a, b, and c if they meet the criteria

     For category b, the projects will be reviewed according to meeting the criteria of approximate size
     and cost of the proposed project. Both cost and size have to comply to receive points. If information
     is not provided, 0 points will be awarded.

     List no more than 10 projects, per section. Projects that were completed more than 10 years ago
     WILL NOT BE COUNTED. Provide, as a minimum in each section, the following information:

     Subsections
     a.   Educational Projects (projects completed or currently under construction for educational
          facilities)
     b.   Equal Size and Cost Projects (projects completed or currently under construction of
          approximate size and cost of the RFQ project)
     c.   Construction Administration Projects (must be identified as a CM contract and CM must
          be listed)
     d.   Anticipated Staff – List staff members anticipated to work on this project. State the
          percentage of each person’s time that will be dedicated to the project. Credit will only be given

      for a maximum of 10 full time employees with a minimum of 50% time for each employee
      dedicated to the project.

Example: (Note: Only the first 4 of the 9 points of the required information are shown in this Example to
demonstrate how projects can be used multiple times in your RFQ response. You must answer all 9
subsection headings in your Submittal Book.

   2.5 points are awarded for each of the 4 subsections

  5.    WORK CONTRACTED WITH THE DISTRICT (0-30 points)
        List all projects and the total contract amount that have been awarded to your firm during the past 5 years up to
        the date of this submittal, excluding projects cancelled by the District. Include Bids, RFQ’s, RFP’s and
        Continuing Contract work with a dollar amount in excess of $10,000 per project. Points will be awarded
        proportionally according to the number of projects and the dollar amount of those projects your firm performed in
        comparison to all the other firms submitting.

6.   DISTANCE TO SITE (0-20 points)
     Provide the physical location of the firm’s office that will have direct responsibility to the project. Map
     Quest will be used to calculate the distance in determining your score.



         Example:

         0 – 60 miles       =      20 points
         61 – 90 miles      =      10 points
         91 – 150 miles     =      5 points
         Over 150 miles     =      0 points



7.   REFERENCES (0-10 points)
     Please provide names of three (3) previous owners that you will contact for references. Please list the
     name of the firm or organization, contact name, address, phone and fax numbers in this section.
     The Reference Form is enclosed for you to send to the 3 references you have listed in this
     section. It is your responsibility to ensure that the form is provided to your references and is faxed
     back to the Construction Services Department by the date referenced on the form provided. The
     Construction Services Department will not provide this form to your references or contact
     your references if the forms are not returned to Construction Services.

     The References you list for this section must be the same as the References returned to the
     Construction Services Department to receive a score.

           projects.

     10.   PRESENTATION (0-5 points)
           You will be scored on the quality, completeness and appearance of the presentation.

B.   THE SELECTION PROCESS
     1.     The full ranking will be determined by combining the scores of Section II and Section III and then
     dividing them by two (2).

     2.    In order to minimize the possibility of unethical pressures or influences on the recommendations of
           the Selection Committee, appointments to the Selection Committee will not be made public. The goal
           of this committee is to assess the applicants on an equitable basis. All contacts and/or
           communication shall be made with the Director of the Department of Construction Services. All
           prospective companies are hereby cautioned not to contact any Board Member, nor to attempt to
           persuade or promote through other channels.

     3.    Once the Board has ratified the final rankings, the Board, or its designee, will engage the highest
           ranked Firm, or Designated Firm in negotiations for the purpose of executing a Construction
           Administration Contract with a Guaranteed Maximum Price (GMP) for each project.

     4.    Should the Board or its designee be unable to negotiate a satisfactory contract with the highest
           ranked Firm, the Board or its designee shall formally terminate negotiations. The Board or its
           designee shall then undertake negotiations with the next highest ranked Finalist, or Designated Firm.
           Termination of negotiations shall occur with that Firm before starting with the number two ranked Firm
           and so on. Negotiation for the next project will begin with the next firm on the rotation/ranking list.

     5.    The professional service agreement entered into by the Board shall contain a prohibition against
           contingent fees as follows: “The Architect warrants that it has not employed or retained any company
           or person, other than a bona fide employee working solely for the Architect to solicit or secure this
           agreement and that it has not paid or agreed to pay any person, company, corporation, individual, or
           firm, other than a bona fide employee working solely for the Architect any fee, commission,
           percentage, gift or other consideration contingent upon or resulting from the award or making of this
           agreement.”

6.   For the breach or violation of this provision, the Board shall have the right to terminate the agreement
     without liability and, at its discretion, to deduct from the contract price, or otherwise recover, the full
     amount of such fee, commission, percentage, gift, or consideration.

7.   The Board reserves the right to reject any or all proposals, if it is in the best interests of the Board.

8.   If your firm will be providing any services on campus while students are present, your firm will comply
     with all requirements of Sections 1012.32 and 1012.465, Florida Statutes, by certifying that all of your
     employees who provide services under this contract have completed the background screening
     required by the referenced statutes and meet the standards established by the statutes. This
     certification will be provided to the Director of Construction Services in advance of providing any
     services on campus while students are present. Your firm will bear the cost of acquiring the
     background screening required by Section 1012.32, F.S., and any fee imposed by the Florida
     Department of Law Enforcement to maintain the fingerprints provided with respect to Architect and its
     employees, will provide the Director of Construction Services a list of its employees who have
     completed background screening as required by the referenced statutes and meet the statutory
     requirements. Your firm will update these lists in the event that any employee listed fails to meet the
     statutory standards or new employees who have completed the background check and meet
     standards are added. You agree that in the event any employee that you have certified as
     completing the background check and meeting the statutory standards then is convicted of any
     disqualifying offense, you will notify the Director of Construction Services within 48 hours of such.

9.   Any person who is adversely affected by a decision of the Lee County School District concerning this
     procurement shall file a Notice of Intent to protest, in writing, within 72 hours after the notice of
     decision is posted, excluding Saturdays, Sundays, and legal holidays. A formal written protest shall
     be filed no later than 10 days after the notice of intent to protest is filed. The formal written protest
     must be accompanied by a bid protest bond in the amount of $25,000 or 2% of the lowest accepted
     proposal, whichever is greater. Any person who is adversely affected by the terms, conditions, or
     specifications set forth in this Request for Qualifications shall file a notice of intent to protest, in
     writing, within 72 hours after the solicitation document (RFQ) is posted, excluding Saturdays,
     Sundays and legal holidays. A formal written protest shall be filed no later than 10 days after the
     notice of intent to protest is filed. The formal written protest must be accompanied by a bid protest
     bond in the amount of $25,000. The notice of intent to protest and formal written protest shall be filed
     with Reggie Snell, Director of Construction Services, 3308 Canal Street, Fort Myers, Florida 33916.
     The formal written protest shall state with particularity the facts and law upon which the protest is
     based. Failure to file a written protest or failure to post the bond or other security within the time
