Bangalore, 21st Aug 2008 Dear Sir / Madam, SUB: Receipt of the letter from Karur Vysya Bank regarding the mortgage of FLATs by ORCHHA HOTELS RESORTS & RESIDENCIES PVT LIMITED. REF: Home Loan from BHW Home Finance Limited - Loan Appl Cust Id : 204900, Appl Id : 202902, File No : BNG/030474, Agreement No: BNG/HOUSIN/IN/010266 of Flat BL211, Level 2 ( First Floor) Block B ITTINA ANU Apartments, Pattandur Agrahara Village, HOPE FARM, WHITE FIELD Reg I purchased flat BL 211 from Orchha Hotel Resorts & Residencies Pvt Limited, Bangalore with the registration on 2nd January 2008 and took the possession in April 2008. All the original documents in this regard are currently with you. I have been paying all my EMI regularly. This month, there was a Public Notice in Deccan Herald published on 5th August , Bangalore edition stating that Orchha Hotel Resorts & Residencies Pvt Limited mortgaged 56 Apartments of Ittina Anu including my flat BL 211, along with proportionate share of land in which the apartment was constructed, to Karur Vysya Bank , JC Road, Bangalore branch. Subsequently, I received communication from Karur Vysya Bank confirming Orchha Hotel Resorts & Residencies Pvt Limited has sold the flat to me without obtaining NOC from Karur Vysya Bank and my flat BL211, which is financed by you , is still mortgaged with Karur Vysya Bank. It makes evident that there is a deficiency of service from your bank in processing of legal verification of the property. I went ahead with the purchase of the Flat only with the confidence given by the Bank. I strongly put it to BHW Home Finance Limited to take the responsibility to ensure that the Flat is not having any other liability and property is free and marketable. Hence, I request you to give the immediate clarification on this issue and take the required legal action against Orchha Hotel Resorts & Residencies Pvt Limited and concerned parties safe guarding all my interests as buyer of Flat BL211. I, here by ask your reply to the letter we received from Karur Vysya Bank and take necessary action & confirm the same to me within five days failure of which I will be constrained to initiate necessary actions. Also please let me know why I can't stop the payments of EMI till this issue is resolved.
