NOTICE INVITING OFFER FOR BIDDING FOR MAINTENANCE OF HANTHI PARK
ON RENOVATE OPERATE AND TRANSFER BASIS




    The  Allahabad  Development  Authority,  Allahabad  (in  short  ‐  ADA,  Allahabad)  is  a  body  Corporate  under 
    President’s Act no. 11 of 1973 enacted in the twenty fifth year of the Republic of India and further constituted 
    by Notification of Government of UP functioning under the jurisdiction of Ministry of Housing, Government of 
    Uttar Pradesh. 

    Allahabad  Development  Authority  is  interested  to  invite  bid  for  granting  licence  for  maintenance  of  Park  on 
    Renovate‐Operate‐Transfer basis for 11 years on above mentioned pattern. 

    Selected Bidder will be allowed to upgrade existing public services, sub lease for ATM space,  install high speed 
    play apparatus, water rides, amusement equipments, beautify gardens and lawns, Install and run food plazas, 
    display advertisement  inside park at his own cost.

      GENERAL

       The Allahabad Development Authority, Allahabad (in short - ADA, Allahabad) is a body
       Corporate under President’s Act no. 11 of 1973 enacted in the twenty fifth year of the

1      ELIGIBILITY OF BIDDERS

1.1    The terms “LICENCEE" shall mean any person, who at the time of his application is a firm
(Proprietary, Partnership, Private Limited Company, Organization under government, Corporation)
or    Firms/companies already in the business of running and maintaining water parks and
amusement park

1.2    The firm having its head office in Allahabad or those stationed outside Allahabad are
eligible to apply.
1.3    The applicant not fulfilling the above conditions shall summarily be rejected and shall not be
considered for evaluation.


2.     GENERAL

       2.1     The detailed application documents can be had form the office of Joint Secretary
       Allahabad Development Authority, 8th Floor-Indira Bhawan, Civil Lines, Allahabad

      Development Authority on any working day between 10:00 A.M. to 5:00 P.M. and may also
      be downloaded from web site of Allahabad Development Authority

      2.2        Ownership of Park will not be affected even after” Licence for maintenance” to the
      lowest bidder.

      2.3        The employees and their family members will be given only free entrance on
      production of Identity Card. However payment to use other rides will be chargeable.

      2.4        All correspondence will be done at the address of registered office of Licencee


3.    TENTATIVE SCHEDULE OF LEASE FORMALITIES

3.1   Downloading of Document/Boucher starts from: 20/6/2008
3.2   Last date of submission of application unto: 3.00 pm: 10/7/2008
3.3   Opening of the applications: at 3.30 pm on 10/7/2008

3.4   Approval of Proposal of prequalification by: 30/7/2008

4.    DETAILS TO BE SUBMITTED BY BIDDER


      The application is required to be submitted in a sealed envelop, super scribed "Application
      of License for maintenance of Hanthi Park for 11 years" along with the following details.
4.2   Name and address of the firm along with Registration No.
4.3   Detailed profile of the firm
4.4   The List of in house technical staff with details of their qualification, experience and field of
      expertise
4.5   Copy of balance Sheet for the last 3 Years (As per Annexure-A)
4.6   List of project(s) handled during last 5 Years (As per Annexure-B)
4.7   List and addresses of parks run and managed by bidders.
4.8   Cost of documents as mentioned in 9.1.
4.9   Earnest money deposit as mentioned in 9.2


5.    PERIOD OF LICENSE

5.1   The selected agencies shall be given License for maintenance for 11 years from the date of

agreement. However ADA reserves the right to discontinue the License at any time if ADA notices
any of the following irregularities are being committed.

(a) Any activity which is illegal or unlawful.
(b)The overall maintenance and cleanliness of park is not taken care of regularly.
(c)Any other opening except the existing is made for any purpose on main road for any activity.
(d)Deposit of Annual License fee is delayed by more than 7 days.
(e)Any other violation of condition or law of land.
In case of termination of License on any of the above mentioned ground the ADA shall not be liable
to pay any compensation on this account.
6      SERVICES TO BE PROVIDED BY LICENSEE

       6.1     The License shall faithfully and honestly develop the PARK with the
       provision of following. The License shall submit a drawing for renovation and
       construction within a month of approval of bid to ADA and once the drawings are
       approved/ amended the bidder would be required to complete the work within 6
       months to the satisfaction of Authority
6.2    Total renovation of wash rooms to deluxe standard.
6.3    Relaying of all footpaths is to be done with Dhaulpur, red sand, rough Kota stone.
6.4    Re -grassing and maintenance of hedges, rockery, flower beds etc are to be done,
6.5    Overall upkeep of park
7 OTHER RESPONSIBILITIES OF BIDDER
7.1    The License will be responsible to arrange for Electrical connection and pay all electrical
consumption charges and other dues to concerned authorities.
7.2    License shall be responsible to arrange NO OBJECTION CERTIFICATES from other
departments( Other departments means other departments than Allahabad Development).
7.3    License shall be wholly responsible for any loss of life and damages if found to be caused by
the negligence of Less or in the premises of Park.
7.4    It will be responsibility of License to maintain strict security and keep the items of the
       inventory of Park intact and handover to Authority at the time of expiry of License.
7.5    All taxes are to be born by License
7.6    The lease rights except for place of ATM to bank will be non transferable.

8 BENEFITS TO THE LICENCEE
8.1      Permission to install high speed playing, apparatus, amusement equipments, etc.
Install food plazas whereas total covered space should not increase more than 5% of total area of
park.

8.2             Display Public advertisement inside park.

8.3             Permission to setup ATM, Telecom centre having entrance only from inside

8.4         Other benefits mentioned in other section of bid documents.

8.5             Any other suggestion of bidder which is in interest of Park Users and accepted by Authority

at the time of grant of license.




9 METHOD OF BIDDING FOR LICENSE.


9.1         The interested eligible bidders as mentioned in Eligibility criterion may download bidding
document from website. A bank draft of Rs 1000/- in favour of “Secretary, Allahabad Development
Authority” payable at Allahabad is to be enclosed as cost of Bidding document while submitting
offers.

9.2        An FDR/TDR of Rs. 200000/- (two lacs only) pledged in favour of Joint Secretary,
           Allahabad Development Authority is to be enclosed with the offer as earnest money
           deposit.
The offers of only those bidders will be considered who have enclosed
     requisite instruments as mentioned in 9.1 and 9.2 as above.
9.3         The applications qualifying the initial criteria, evaluated by scoring method as follows will
further be asked to participate in open bidding or sealed financial bidding.

9.4     The marks shall be decided by the Committee generally on the basis of predetermined
criteria and where it is not possible to do so, based on their won judgment. The evaluation carried
out by the said Committee shall be final and binding.

 I/We hereby certify that all the statements made and information, supplied in the enclosed forms A
 to C and accompanying statements are true and correct.
 I/We have furnished all information and necessary details required for the license and no further
 pertinent information to supply.
 I/We submit the requisite certified solvency certificate and authorize the Joint Secretary to
 approach the bank issuing the solvency certificate to confirm the same. I/We also authorize Joint
 Secretary to approach individuals, employers, firms and corporation to verify competence and
 general reputation.

  This deed of license made on the……..…… date of …...…...… 2008 In between 

  The Allahabad Development Authority, Allahabad, a body corporate under President’s Act no.11 of 1973
  enacted in the twenty fifth year of the Republic of India through its Secretary hereinafter called “The First
  Party” which expression shall include their successors also, of the one Part.

  And

  ……………………………………………………………………………….…...

  hereinafter called the Second Party which expression shall include his/her/their successors also of the
  Second Party.

  Whereas Sumitra Nandan Pant Bal Udyan (Hathi Park) was handed over to the First Party ADA through
  PIL No.2547/07 by the Hon’ble High Court of Judicature at Allahabad from Nagar Nigam Allahabad for
  its control, management and maintenance after, managing and maintaining the aforesaid park.

  Whereas now the First Party in view of better management development and maintenance of the said Park
  for making or developing or more attractive the same into Children Amusement Park, such as by provision
  of power operated games, water rides etc through Public Private Partnership (PPP) and for this purpose the
  bid was invited and Second Party agreed to perform the functions on the basis of PPP on following terms
  and conditions:-

(i)      The Second Party shall renovate, develop, install the power rides, water rides etc in the Park like
         manner wholly faithfully and honestly on his own source and income.
(ii)     The Second Party shall have to keep the Park very clear and attractive.
(iii)    The Second Party shall have to relay all footpaths as mentioned in original terms and condition of
         bid document .
(iv)     The Second Party shall make re-grassing and maintenance hedges, rockery, floor beds etc.
(v)      The Second Party is permitted to install high speed play apparatus, amusement equipments etc.
(vi)     The Second Party may install food plazas inside the park.
(vii)    The Second Party may display public advertisement inside the park.
(viii)   The Second Party may set up or sublicence ATM, telecommunication center having its entrance
         only from inside the park.
(ix)     The Second Party shall keep power-operated games for the children, install play apparatus.
(x)      The Second Party shall pay the total premium of Rs………………… to the First Party one time or
         proportionately Rs………../year
(xi)     The First Party or its officials or employees authorized by him have free access to the park and to
         look after the activities of the Second Party inside the park.
(xii)    The activities of the Second Party shall not be ……. unlawful and injurious and harmful to the
         health and habit of the children also shall keep the park well maintain and clean.
(xiii)   The Second Party shall not make the opening of park on main road for any other purpose or activity,
         except the ingress and egress of the warranted elements should be allowed to enter inside the park.
(xiv)    That the premium as agreed upon shall be paid regularity and the delay if any, will disentitle the
         Second Party to cancel the license .

(xv)   The First Party reserves its right to revoke the license even before the stipulated period. This license
       given to the Second Party is revocable at will.
(xvi) The First Party is not responsible for any less or damages of the Second Party, the First Party shall
       not pay any compensation to the Second Party of the license is revoked earlier to the stipulated
       period.
(xvii) The decision of the Vice-Chairman shall be final.
