PWS is defined as any water s~fstemsupplying 15 or more services, or 25 or more people for 60 the or more days per year. As SUC]1, water system owner is required to submit chemical samples according to the system's established sampling schedule to the State laboratory or a State- certified laboratory in complia:tlce with NH Administrative Rule Env-Ws 326. DES records show that the subject water system failed to submit the following chemical sample result for the following monito,ring period (calendar quarter). Quarter 3 -2001 MtBE As a result of the failure to sublmit the above-described sample, a Notice ofViolation (NOV), to dated April 19, 2002, was sen1: you. The NOV requestedthat you immediately submit the above-described sample as a !!lake-up sample. To date, DES has not received the make-up sample result, thus placing the water system in violation ofEnv-Ws 326. DES believes the monitoring/reporting deficiency can be addressedby taking the following action: By August 12, 2002, submit a MtBE "make-up samples" to the State laboratory or a State-certified labolratory.Please use the enclosed analysis results form when to submitting the sam]ples your laboratory . The failure to submit Quarter ~\-2001 MtBE sample required you to perform public notice of the monitoring/reporting violation. The April 19, 2002, NOV requested that you perform the public notice within 30 days and submit proof of public notice to DES within 10 days of providing public notice. By August 12,2002, provide public notice of the failure to submit the Quarter 3 - as 2001 MtBE sarnp1~, specified on the enclosed form; and 2. By August 21,2002, provide proof of public notice to DES, as specified on the enclosed form. In the event compliance is not achieved within this period, DES may take further enforcement action. These actions include jlssuing an order requiring the deficiencies to be corrected, initiating an administrative fine proceedling, and/or referring the matter to the NH Department of Justice for imposition of appropriate penalties.
