Aspects of potential permitting delays: – Workload issues - State Parks supports approximately 1 FTE for DOH review. Ecology is processing applications without additional support. – Jurisdictional issues between Health and Ecology - Ecology and Health will share project review (new technologies less than 100,000 gallons per day) until July 2009. Parks will work with Ecology and Health to permit wastewater system upgrades. – Ambiguity in the interpretation of specific regulations applicable to Parks' PS Initiative projects - with the new deadlines these issues are not viewed as problematic. As issues come up, Parks will address them immediately. 3 Priority 4: Prevent Nutrient and Pathogen Pollution State Parks Puget Sound Initiative Projects Common or Potential Problems: 1) Permit Process for MBR technology and water reuse may take longer than previously expected. • Action Plan: Parks is providing advance information to reduce time needed for permit review and approval by DOE of Membrane Bio-Reactor (MBR) technology and water re-use. 2) Partnering with neighboring communities has slowed project development. • • Action Plan: Clarify interest and capabilities outside park boundaries for area-wide treatment solutions. Action Plan: Develop in-park wastewater treatment solutions ensuring capability to handle increased effluent when area-wide partnerships are possible. Action Plan: Changed self-imposed deadline for projects to June 30, 2009 (end of Biennium). Action Plan: Develop Programmatic Agreement with DAHP Funding Shortfall to complete all 25 projects. Action Plan: Request 2008 supplemental funding for Fort Flagler Action Plan: Put Possession Point on hold pending other project final costs. Use any cost savings to complete project Action Plan: Move funding from Kopachuck partnership project to higher priority projects. Bring this project forward in 09/11 in partnership with Peninsula School District. 5 Follow-up from March 20 GMAP How is commercial shellfishing affecting natural shellfish beaches? • • Answer: We don’t know. Analysis and Long-Term Action Plan: Due to uncertainty of the long-term effects of prevalent geoduck aquaculture techniques and practices on the natural environment. The action plan, based on HB2220 passed in 2007: – – – The University of Washington Sea Grant Program will study and review existing literature to identify gaps in knowledge to target research needs. Report Due December 2007. DNR is restricting aquaculture leasing to no more than 15 acres of state-owned aquatic lands for geoduck aquaculture per year through December 1, 2014. The newly-formed shellfish aquaculture regulatory committee is meeting monthly to 1.) Make sure research satisfies the planning, permitting and data management needs of the state; and 2.) Make recommendations for an integrated regulatory system for shellfish aquaculture. Their recommendations are due by March 2008. Ecology will begin rule-making in mid-2008 to develop guidelines for Shoreline Master Programs regarding appropriate siting and operation of geoduck aquaculture operations. A final report is due to the legislature in December 2008. Fish and Wildlife is amending their aquatic farmer registration program to require an accessible database and they are coordinating data with Health's shellfish growing area certification program. 6 – – Governor's Puget Sound Initiative 06 Supplemental Budget, $51.7 million (capital and operating budgets) G G Y Y G $5.8 million to accelerate cleanup of contaminated state owned aquatic lands. $5.0 million to accelerate clean-up of contaminated sites within half of mile of Puget Sound. $7.5 million for remedial action grants to clean up 11 sites in Bellingham Bay $3.4 million for remedial action grants to cap contaminated sediments in Commencement Bay $3.3 million to restore high priority estuarine and salmon habitat and restore nearshore ecosystems. $6.5 million for a new Puget Sound-area loan program to help homeowners repair failing septic systems. $4 million to fix wastewater treatment plants and aging infrastructure at six state parks and ensure that parks are Sound-friendly. $7.5 million to restore estuaries and shorelines to protect salmon. Work in progress near Sequim, Anacortes, Port Angeles, Shelton and the Kitsap Peninsula. Started 31 new cleanups this year. Plan to start 25 each year for the first two years. Grants issued, clean ups take, on average, 12 years to complete Grant issued and design work started. Phased construction projects to restore 808 acres of estuary, reestablish access to 22 miles of stream, protect 300 feet of shoreline, and remove 56,250 feet of levee and dikes. G Y G 7 Governor's Puget Sound Initiative 06 Supplemental Budget, $51.7 million (capital and operating budgets) Y G $1.0 million to fix, repair or upgrade sewer infrastructure or for stormwater management. $2.5 million in local government grants to accelerate adoption of innovative low-impact development techniques to minimize harm from stormwater runoff. $0.9 million for an inspection program to prevent spills during oil transfers. $1.0 million for additional spill responders for pipeline, oil refining and transportation related spills, and to cache equipment for responding to spills $2 million to remove derelict creosote logs from Puget Sound shorelines. $0.7 million to survey and report on geoduck and sea cucumber populations $0.5 million to hire new staff to help industrial and commercial facilities eliminate or reduce the production of toxic wastes $0.2 to stop invasive tunicates from spreading on hulls of recreational boat Five projects in various stages of planning and implementation. Ecology evaluated 27 eligible project proposals for a total of $10.2 million. Made offers to ten local governments. Obligated all funds. New program with slow start-up in hiring new staff - two vacancies remain. Hired one new responder was hired and re-allocated two inspectors to focus work on PS. Deployed 36 caches in the Puget Sound basin. Slow start-up to minimize conflict with fish windows and work around weather issues. Overall, the number of completed cleanups was exceeded for the biennium. Ecology has tightened up consistency with the cleanup law and within the program. This has slightly reduced the number of decisions on completed cleanups. Action Plan • Completed Cleanups Target • Strategy: Contaminated sites are cleaned up. Measure: Number of cleanups completed (this is a state-wide number). Target: Complete 70 cleanups each quarter. Ecology can now track and report sites within ½ mile of Puget Sound (Puget Sound sites comprise over 12% of all sites state-wide). Ecology has committed to reducing the time it takes to cleanup Puget Sound sites by 12 months. 10 Priority 2: Reduce and prevent toxic contamination Toxics Loading Study Steering Committee: Ecology, EPA, The Partnership, King Co. Phase 1 Identify indicator toxic chemicals Estimate loadings from major pathways Identify uncertainties and data gaps September 07 Control Action Strategies Phase 2 Improve loading estimates and models From: roads, storm water, sewers, industry, ocean & sediments Model the effects of new loading information June 08 Phase 3 Conduct sampling to improve load estimates Sample: roads, sewers, ocean Research: diesel soot deposition Model effects of new loading information June 09 Analysis: The three phases of the toxics loading study will provide a credible basis to target the highest priority toxic sources for developing control strategies. Phases 1 & 2 are based upon existing data and models. Phase 3 focuses on actual sampling and refinement of loadings. Action: Results from all phases will be used to develop the 2020 Puget Sound Action Agenda. Phase 3 will require legislative approval of a 2008 Supplemental Budget Request for $1.13 million. 11
