					             NELSON COUNTY PARK BOARD MINUTES
                 July 7, 2009 – 8:30 A.M.


     The meeting was called to order by Chairman Odell
Flaagan with Harold Bergquist, Maynard Loibl, Ron Houdek,
Bert Elgin, Don Fougner, and Ron Dahlen present.

     Moved by Ron Dahlen and seconded by Harold to approve
the minutes as distributed.     All voted “Yes”.    Motion
carried.

     Dwight Elfman discussed the success of the Polkafest,
the 4th of July dance, and the fireworks. He reported that
a stove needs to be repaired or replaced and that the
fireworks could be purchased through the Devils Lake Fire
Department in the future.

     Moved by Harold and seconded by Ron Dahlen to pay one
half of the cost of lighting the fireworks.      All voted
“Yes”. Motion carried.

     There was discussion on upcoming      events   and   the
purchasing of larger items for the café.

     Moved by Ron Houdek and seconded by Ron Dahlen to
recommend to the Commissioners to approve a special events
permit for Dwight for July and August.    All voted “Yes”.
Motion carried.

     Moved by Don and seconded by Maynard to pay for the
pie cooler for the café. All voted “Yes”. Motion carried.

     Dennis Johnson reported that steel siding has been put
on the bait shop.

     There was discussion on the pavilion steps and the
temporary shortage of water when there are a lot of
campers.

     Moved by Ron Houdek and seconded by Don to pour new
steps at the main entrance to the pavilion.    All voted
“Yes”. Motion carried.

     There was discussion on applying for a Garrison
Diversion grant, Engel’s Point, application for the
National Register, a different dumpster at the point, In-
Kind work on the dock, blocks for urinals, and the painting
of the floor in the restrooms. It was decided to apply for
a grant for a new campground.

     Ralph Miller will check to see if the Pioneer Village
has an extra stove.

     Dwight discussed a broken window in a door, the golf
cart parade, future activities, taco night, T-ball, and
softball.

     Doug Manbeck discussed the ownership of the pavilion.
He was directed to take legal steps to resolve the issue
for the county.
     Moved by Ron Houdek and seconded by Don to pay the
park bills as listed:    Dwight Elfman - $200.00; Farmers
Union Lumberyard - $33.80; Farmers Union Oil Co. of Tolna -
$133.16; Ferrellgas - $817.58; Lakota Sanitation Service –

     The meeting was called to order by Chairman Flaagan
with Commissioners Fougner, Bergquist, Dahlen, and Loibl
present.

     Moved   by   Commissioner   Fougner   and   seconded   by
Commissioner    Bergquist   to   approve   the    minutes   as
distributed. All voted “Yes”.    Motion carried.

     Sharon Young discussed the fire escape ladders
installed on the Courthouse, the Multi-Hazard Mitigation
Plan, the upcoming State Flood Coordination Center meeting,
sandbags, and the upcoming Community Acquistion Workshop.
The rough draft of the Multi-Hazard Mitigation Plan has
been received.

    Nels Peterson submitted the extension activity report.

    The Veteran’s Service Officer Report was reviewed.

     Rick Urvand discussed FEMA projects, flooded roads,
weather-related funding, the shortfall in FEMA funding,
County Road #23 rip rap, the graveling of County Roads, the
County Road #35 seal coat, County Road #22 inspections, the
retention of a blade operator, and an easement request.

     Moved   by  Commissioner   Dahlen and   seconded  by
Commissioner Fougner to approve an easement for Minnkota
Power to build an approach to County Road #4 at the SW1/4
of Section 11 in Adler Township. All voted “Yes”. Motion
carried.

     Moved   by   Commissioner  Dahlen   and  seconded   by
Commissioner Fougner to approve a special events permit for
Dwight Elfman for July 12 through August 9 at Stump Lake
Park. All voted “Yes”. Motion carried.
     The Farm Service Agency has been contacted regarding
the haying of CRP and there is no provision to open it up
at this time.

     Moved by Commissioner Bergquist and seconded                   by
Commissioner Dahlen to support the opening of CRP                   to
haying. All voted “Yes”. Motion carried.

     There was discussion on a signing ceremony for the
North Dakota Community Military Covenant.

     The State    Fire    and    Tornado   Insurance    coverage   was
reviewed.

     Kelly Janke presented the Calls for Service report and
discussed the number of calls, the budget, a job he is
looking into in Fargo, salaries, holiday compensation, cost
of living increases, and a wage study.

     Ben Varnson updated the Board on the Michigan Spillway
Project and other water projects. State funding for these
projects was discussed.

     At 1:30 P.M. the omitted property hearing began.
Roger Clauson discussed his omitted property with Michelle
Linstad. The assessments were reviewed with no objections.

     At 2:00     P.M.    the    County   Equalization   meeting    was
reconvened.

     Michelle Linstad reviewed the changes of assessments,
Homestead Credits, Veteran’s Exemptions, Blind Exemptions,
and Farm Residence Exemptions.

    The equalization meeting was recessed.

    The Commissioners meeting was reconvened.

     Moved   by   Commissioner  Dahlen   and  seconded              by
Commissioner Fougner to transfer $273,444.12 from                  the
Highway Distribution fund to the Road and Bridge fund.             All
voted “Yes”. Motion carried.

     Moved by Commissioner Bergquist and seconded by
Commissioner Fougner to transfer $314.00 from the Weed
Control fund, $2,024.00 from the Veteran’s Service fund,
and $4,582.00 from the County Agent fund to the County
General fund according to the cost allocation plan.  All
voted “Yes”. Motion carried.

     Moved   by   Commissioner  Dahlen   and   seconded  by
Commissioner Fougner to reappoint Elvin Johnson to the Weed
Control Board. All voted “Yes”. Motion carried.

     Moved   by   Commissioner  Dahlen   and  seconded   by
Commissioner Bergquist to appoint Maynard Loibl to complete
the unexpired term of Noel Lofthus on the Job Development
Authority. All voted “Yes”. Motion carried.

     Moved by Commissioner Bergquist and seconded by
Commissioner Fougner to authorize the Social Services Board
to use the Commissioners Room for meetings.      All voted
“Yes”. Motion carried.
     There was discussion on the hiring of a secretary for
the County Agent and the funding of the Red River Basin
Commission.

     Moved   by  Commissioner   Fougner  and   seconded  by
Commissioner Bergquist to reapprove the following pledged
securities: State Bank of Lakota - $1,500,000.00; McVille
State Bank - $250,000.00; Choice Financial Group of
Petersburg - $175,000.00; Farmers & Merchants State Bank of
Tolna - $500,000.00; and Sheyenne Financial, Aneta Station
- $264,201.45. All voted “Yes”. Motion carried.

     Moved   by  Commissioner  Fougner   and  seconded  by
Commissioner Bergquist to nominate Odell Flaagan for the
Excellence in County Government Award in the County
Commissioner category. All voted “Yes”. Motion carried.

     The Board examined the vouchers   and   instructed   the
Auditor to pay all bills as listed.

                                            9:A.M.
     The county equalization meeting was reconvened with
Commissioners Flaagan, Loibl, Bergquist, Fougner, and
Dahlen present.

     Michelle   Linstad   presented the  2008-2009   Ratio
Adjustment Worksheet, the 2009 Supplemental abstract, and
an abstract with reassessments.

     Moved   by   Commissioner   Dahlen   and   seconded   by
Commissioner   Fougner   to  increase   the   assessment   of
commercial property 2% to meet the 5% tolerance required by
the State Tax Department.       All voted “Yes”.       Motion
carried.

     Moved by Commissioner Bergquist and seconded by
Commissioner Loibl to approve the assessments of omitted
property reviewed at the July 7, 2009, meeting. All voted
“Yes”. Motion carried.

     Moved   by   Commissioner Dahlen   and  seconded   by
Commissioner Fougner to approve the 2009 Supplemental
Abstract of Assessments. All voted “Yes”. Motion carried.

     Moved by Commissioner Bergquist and seconded by
Commissioner Loibl to approve the City and Township
assessments. All voted “Yes”. Motion carried.

     The county equalization meeting was adjourned.

     Kristi Berdal presented the Family Nutrition Program
County Support Summary.

     Moved   by   Commissioner  Loibl   and   seconded   by
Commissioner Bergquist to sign the Family Nutrition Program
County Support Summary. All voted “Yes”. Motion carried.

     Doug Manbeck discussed a case that is pending.

     Sharon Young discussed an upcoming meeting on buyouts.

     Kelly Janke discussed a job offer that he has received
and submitted a salary proposal.

     Joe Fontaine, Michelle Linstad, Janet Edlund, Darrel
Leith, Terry Deehr, Jeff Anderson, Sharon Young, Bruce
Ellertson, Tom Stenvold, Bob Engen, Karen Retzlaff, Doug
Manbeck, Eric Braathen, Jackie Gray, Mary Fisk, Keith
Coleman, Kathlyn Kolberg, Margo Burthold, Bill Franzen, and
Jeffrey D. Anderson spoke in favor of a salary increase for
Kelly Janke.

     Travis Ellertson, Kevin Sundre, Ruth Stevens, Marcia
Guenther, Brent Borland, and Keith Olson were also present.

     It   was   stated   that   others   deserve   salary   increases
also.

     Several Commissioners commented on the improvement in
the Sheriff’s department.

     Moved by Commissioner Bergquist and seconded by
Commissioner Loibl to accept Kelly Janke’s salary proposal
of $46,747.50 per year from September 1, 2009, through
December 31, 2010. All voted “Yes”. Motion carried.

     Jerry Enstad, Paul Retzlaff, Roger Sateren, Norris
Messner, Joe Zahradka, Stacy Twete, the Commissioners, and
the Auditor signed the Community Military Covenant in
support of our service members and their families.

     Todd Erickson, from the Nelson County Pigs Coop.,
discussed the repair of County Road #22 from Highway 2 to
the hog farm.   There was an oral agreement to share the
cost of the repair of the road because of damage during
construction.

     Moved   by  Commissioner   Fougner  and   seconded  by
Commissioner Bergquist to bill the Nelson County Pigs Coop.
$1,000.00 to repair damage to County Road #22 during
construction of their facility.

     Rick Urvand discussed the repair of County Road #22
and County Road #23, the graveling of County Road #2 and
County Road #11, and FEMA funding.

     Moved   by  Commissioner  Dahlen  and   seconded  by
Commissioner Fougner to carry Dahlen and Sarnia Townships
for the graveling of County roads.      All voted “Yes”.
Motion carried.

    The meeting was recessed.

                       July 20, 2009
                         9:00 A.M.

     The meeting was reconvened with Commissioners Flaagan,
Fougner, Bergquist, Dahlen, and Loibl present.

     Nels Peterson updated the Board on the applications
for secretary and requested flexible hours.   The Board
agreed to it.

     Phil Sandford discussed the carp issue, a plugged
culvert, and the worn out pumps in regards to the Michigan
Spillway Project.

     Charles  Ryba  discussed   a     conflict   of  interest
regarding the Michigan Spillway      Project.     He has no
easements on his land where they     are looking at pumping
water. He threatened an injunction   to stop it.

     The Water Board requested a resolution supporting an
emergency pumping permit. The location of the pump has not
been determined at this time.

     Moved   by   Commissioner  Dahlen   and  seconded   by
Commissioner Fougner to approve a resolution of support for
an emergency pumping permit for the Michigan Spillway
Project. All voted “Yes”. Motion carried.

     Sharon Young discussed the         Alex Hager road and
presented   an  agenda   for the       upcoming  State Flood
Coordination Center meeting.
     Moved by Commissioner Bergquist and seconded by
Commissioner Loibl to sign the Lessee’s Authorization
Resolution for a 2009 Cat 140M Motor Grader – Serial Number
B9M00897. All voted “Yes”. Motion carried.
