BIOGRAPHICAL NOTE
Edward P. Kirby (EPK) was born in Whitman, Massachusetts, on January 10, 1928. He attended
the Whitman public schools and graduated from the College of the Holy Cross in 1949 and
Boston College Law School in 1952. He entered the United States Army during the Korean War
(1952-1955) and served as a Lieutenant in the Judge Advocate General‟s Corps.


EPK entered local politics in the late 1950s and served as Whitman Town Counsel from 1957 to
1962. In 1960 he was elected to the Massachusetts House of Representatives, representing the
5th Plymouth District for three terms between 1961 and 1966. During his first term he was the
youngest Republican in the House. Kirby became a Plymouth County Commissioner in 1968
and was elected to two terms, serving from 1968 to 1976. He represented the 2nd Plymouth
District in the Massachusetts Senate (1981-1989) and the Plymouth and Barnstable District
(1989-1992). During the years 1983-1988 and 1991-1992, Kirby was the Third Assistant
Minority Floor Leader in the Senate. Throughout his career, EPK was a strong social
conservative. He supported the reinstatement of the death penalty in Massachusetts and the
banning of legal abortion in the state and was opposed to most gay rights legislation. He was also
a controversial figure in Massachusetts politics because of his views on homosexuality and
AIDS.


During his time in office as a Senator, EPK was a member of several committees. He was
assigned to the Public Service, Ways and Means, Transportation, Criminal Justice, and
Transportation Committees. Other committees on which he served include Election Laws,
Public Safety, Energy, Justice, Judiciary, and Rules.


EPK‟s legislative priorities were tax reform, victims‟ rights, environmental issues related to
hazardous waste, budgetary issues, public safety, and elderly affairs. He was also concerned
with local aid to finance education and introducing industry he considered desirable to his
district. Throughout his years in the Senate, Kirby was involved in the successful restoration of
the Old Colony Commuter Rail, which brought railroad service from Boston to his district. He
also established the Special Joint Committee on the Investigation and Study of the Pilgrim
Station Nuclear Generating Facility at Plymouth, MA. Kirby was deeply invested in social issues
of the day including AIDS, gay rights, and abortion, and his papers reflect his activity in these
areas.


Outside of public office, Kirby participated in several organizations. He was a member of the
American Legion as well as the Whitman Kiwanis and the Whitman Council #347 Knights of
Columbus. In addition, he helped create the Plymouth Development Council.


Kirby‟s wife was Mary Alice Kirby, who participated actively in EPK‟s political career.


SCOPE AND CONTENT
This collection documents Edward Kirby‟s (EPK) years in the Massachusetts House (1961-1964)
and Senate (1981-1992). The papers reflect his legislative activities and priorities as well as
issues of concern in his district. The collection documents his career with notes, correspondence,
drafts of legislation, drafts of speeches, and research files on numerous topics. (See Series Scope
and Content Notes for more detailed descriptions.)
The most important distinction within the collection is that between legislative and subject files.
Both kinds of records may include background material, notes, correspondence and occasionally
speeches. Legislative papers were created as a result of EPK‟s lawmaking work. They regard
specific pieces of legislation or related groups of legislation. Subject files were created during
EPK‟s general work as a state senator. They often regard legislation but more often document
constituent matters, issues affecting his district, and sometimes larger social issues of the day.
There is significant overlap between the subject and legislative files. For instance, there are
multiple files under the “AIDS” heading in both the subject and legislative series. Researchers
should consult folder listings for both series when researching a specific topic or issue.
Researchers interested in EPK's district should also look to names of towns and regions in the
series V and VI. In the folder descriptions, “notes” means hand-written documents, usually
written by EPK, often including EPK‟s thoughts on the subject at hand, the events of meetings,
to-do lists and office memos.


ADMINISTRATIVE INFORMATION
System of Arrangement
To the extent possible, the arrangement of EPK‟s office filing system was maintained. EPK‟s
staff changed filing systems partway through his time in the Massachusetts Senate, switching
from a system in which legislative and subject documents were together (1981-1983) to one in
which they were separated (1983-1992). During processing of the collection, the decision was
made to adhere to the later filing system and to bring all files into agreement with it. Upon
acquisition by the Library, many files were poorly organized or not filed at all, and these were
placed into the overall arrangement by the processing archivists.


The papers are arranged in six series, which are further arranged in sub-series as follows:

Oversize material is located in the Special Collections Workroom. If there is oversized material
related to a folder, it will be noted in this finding aid and at the beginning of the folder.


Some material in the collection is being withheld from researchers for a limited time to preserve
the privacy of third parties mentioned in the material. Folders marked “RESTRICTED” are
closed to researchers until January 1, 2054. The Special Collections staff will remove restricted
folders from a box if it is called for use by a patron. See the Special Collections staff for more
details.

Custodial History


Immediate Source of Acquisition
Series III, IV, V, VI and portions of Series II were accessioned in 1999. Series I and the rest of
Series II were donated in 2002 and 2004. The collection was kept in EPK‟s house between his
time in office and accession by the State Library.


Appraisal, Destruction and Scheduling
The following items have been removed from the collection and destroyed:
      Publications: books, serials and published reports. In some cases, a photocopy of the
       cover and/or title page have been placed in the folder.
      Duplicate photocopies of material and duplicate copies of bills.
      Clippings without direct context in the collection and/or without annotations by EPK or
       staff.




Conservation Note
Preservation activities were performed on the collection as follows:
      Newspaper clippings, when they were retained, were isolated from the rest of folder
       contents in acid-free paper. Clippings with substantive annotations were photocopied, and
       the original has been destroyed.
      In many cases, staples were removed from material in the collection. When it was
       deemed necessary to maintain the original arrangement, a plastic paper clip or acid-free
       enclosure was used to keep the material together.
      Paper clips were removed from the collection wherever possible, and acid-free paper
       used to associate materials.
      Post-it notes were found throughout the collection. In cases where the note had no
       substantive content (i.e., reading, “for EPK”) the Post-it Note was removed and
       destroyed. Where the Post-it did include substantive information, the page and Post-it
       were photocopied together and the copy was placed in front of the base page in the
       folder, and the Post-it Note was destroyed.
      Other material: acidic papers found in the collection were enclosed or photocopied and
       destroyed. Thermal fax paper was photocopied and destroyed to protect them from ink
       fading.

Series I: House of Representatives, 1965-1966
Scope and Content
Records in Series I were created during Kirby‟s years as a State Representative. Sub-series B
includes correspondence relating to EPK‟s work in the Legislature, and particularly on behalf of
constituents.




Arrangement
The arrangement of sub-series in Series I loosely mimics the arrangement of Series II-VI. Sub-
Series A and B are arranged chronologically. Sub-Series C is arranged alphabetically

Series II: Administrative Files (Senate), 1980-1999


Scope and Content
This series includes files related to the daily functioning of EPK‟s Senate office. Sub-series B
includes daily schedules. It was the practice of EPK‟s staff to clip invitations to Kirby‟s daily
schedules. Kirby‟s staff consistently revised the schedules so there is much overlap in date
throughout these folders. Materials such as correspondence, notes, and newsletters accompany
some invitations and schedules. Sub-series D includes drafts of speeches as well as statements
EPK made for events such as at a U.S. Senate Committee on Labor and Human Resources
meeting and Boy Scout Eagle Award ceremonies. Sub-series F includes correspondence with
friends and colleagues and correspondence with constituents on general issues. Constituent
correspondence is also interfiled throughout the collection in campaign, legislative, and subject
files. The telephone message books in Sub-series G show constituent responses to Kirby‟s work
in the Senate and also document the daily work of his office. Much of Sub-series F and G were
moved from files marked “Miscellaneous” by EPK‟s staff, dating largely from 1982 to 1983.

Series III consists of files created during EPK‟s runs for State Senator. Many folders include
writings and correspondence of Mary Alice Kirby, EPK‟s wife. Sub-series A contains files
relating to multiple elections or elections and campaigning in general. Sub-series B contains
material relating to specific campaigns.


Arrangement
Sub-series A is arranged alphabetically by topic. Sub-series B is arranged by campaign year
(regardless of the date of material itself) and then alphabetically by topic.

Scope and Content
This series includes files relating to district issues, organizations, committee work, grants,
constituent case work, and special projects and comprises correspondence, newsletters, some
newspaper clippings, and pamphlets relating to EPK‟s district and the state at large. Sub-series A
also includes constituent material. A separate large subject file marked “AIDS” is incorporated
into this Sub-series A. Some files have been re-filed under “Gay rights,” and files relating to
specific legislation have been placed in Series III Sub-series A.


Arrangement
To aid researchers, Sub-series B and C were removed from the general subject files. Sub-series
A and C are arranged alphabetically by topic. Sub-series B begins with general information
arranged chronologically and continues with material arranged alphabetically by topic.
