Premises: 238 Main Street City/Town: Greenfield, MA 01301 Heard: January 11, 2007 DECSION This was a hearing concerning alleged violation of 204 CMR 2.05 (2) Permitting an illegality on the licensed premises, to wit: Ch.138 §34 - Sale or delivery of an alcoholic beverage to a person under twenty-one years of age. The licensee stipulated to the facts of the investigator’s field report which stated that an underage operative, working under the supervision of ABCC investigators, participated in an underage compliance check. The minor, whose date of birth is 9/4/86 age 20 purchased a Bud Light and was not asked for ID. Investigator Rose Bailey stated that the establishment has had a license since 1985 and has not had any previous violations with this Commission. Mark Donoghue of the licensed premises stated that the bartender who served the minor has been working there for 13 years. The bartender was fired to send a message to the rest of the staff and the community. All employees must attend monthly meetings and become T.I.P.S. trained. Based on the evidence, the Alcoholic Beverages Control Commission finds that the licensee violated 204 CMR 2.05 (2) Permitting an illegality on the licensed premises, to wit: Ch.138 §34 -Sale or delivery of an alcoholic beverage to a person under twenty-one years of age and, therefore, suspends the license for a period of 3 days of which 3 days will be suspended for a period of 2 years as long as no other violations of Ch.138 or Commission regulations are found within 1 year.
