                                          DECISION

      This was a hearing concerning alleged violation of 204 CMR 4.03 (2) advertising or
promoting a practice prohibited less than 204 CMR 4.03 (1 count).

        The licensee stipulated to the facts of the investigator’s report which stated that
ABCC investigators saw ads for an open bar for two hours on New Year’s Eve. These
promotions were on a web site for Jetsetevents.com and there were flyers at the
establishment.

        The attorney for the licensee stated that as soon as the investigators informed the
licensee that this practice was a violation the ad was removed on the web and the flyers were
removed from the establishment. Ivy restaurant did not have any open bar at all.

        Based on the evidence, the Alcoholic Beverages Control Commission finds that the
licensee violated 204 CMR 4.03 (2) advertising or promoting a practice prohibited under 204
CMR 4.03 (1 count) and, therefore, issues a warning.
