$7.6M jury award for wronged Atlantic City developer

Special to NJBIZ

An Atlantic City developer won a $7.6 million civil suit following a four-year walk through a federal court in Camden.

In June 2005, Atlantic City Associates, a division of The Cordish Cos., which developed The Walk in Atlantic

City, filed suit against Carter & Burgess Consultants Inc., an architectural engineering firm that’s part of Jacobs, a

California-based construction services firm.

Last week, a 10-person federal district jury unanimously agreed with ACA’s claim that C&B’s design and other

errors resulted in “hundreds” of changes to The Walk — an eight-block retail outlet center that runs between the

Atlantic City Convention Center and the resort city’s boardwalk — that delayed the center’s opening and cost ACA

millions of dollars.

“The case involved some very technical issues,” said Marlton resident Joe Battipaglia, a partner with the Phila-

delphia law firm Duane Morris LLP, who represented ACA. “Matters like this can be tricky, since you want to make

sure the jury understands all the issues.”

C&B’s lawyer, Timothy J. Bloh, of Fox Rothschild LLP’s Atlantic City office, did not return a reporter’s call seeking
