									Minutes of the Town of Qualicum Beach Regular Council Meeting held Monday, April
16, 2007 at 7:00 p.m. in the Council Chamber, Municipal Office, 660 Primrose Street,
Qualicum Beach, BC

PRESENT:     Council:      Mayor Teunis Westbroek
                           Councillor Barry Avis
                           Councillor Wendy Maurer
                           Councillor Mike Wansink
                           Councillor Jack Wilson

The Mayor called the meeting to order at 7:00 p.m.

ADOPTION OF THE AGENDA
Council adopted, by unanimous consent, the April 16, 2007 Regular Council meeting agenda
as circulated with Rene Kraft being added as a delegation to the agenda.

APPROVAL OF THE MINUTES
Council approved, by unanimous consent, the April 2, 2007 Special Council meeting
minutes.
Council approved, by unanimous consent, the April 2, 2007 Regular Council meeting
minutes.
Council approved, by unanimous consent, the April 4, 2007 Special Council meeting
minutes.

DELEGATIONS
  (1) Annette Tanner - Ms. Tanner appeared before Council to discuss the
      implementation of a strategy for the protection of sensitive ecosystems inventoried
      sites. Ms. Tanner would like to arrange a meeting with the Environment
      Committee and Town Council to work towards a strategy to protect the sensitive
      ecosystems.

   (2)    Renee Kraft - Ms. Kraft appeared before Council to express her desire to have
          outdoor burning banned within the Town of Qualicum Beach.

CORRESPONDENCE
  (1)  Neil Tranberg (April 12, 2007) – Grandfathering ‘Resort Condominium’

Councillor Wilson MOVED and Councillor Wansink SECONDED THAT the matter of
grandfathering ‘resort condominium’ definition in Bylaw 580.38 and the Development
Permit for the resort condominium project at 333 Garrett Road be deferred to a future
Council meeting.

COMMITTEE & LIAISON REPORTS
(1) General Government, Public Works, Seniors & Youth (Mayor Teunis Westbroek)
    Mayor Westbroek reported on the following:
      • Mayor Westbroek wished to complement staff on an excellent job done in
         hosting the AVICC meeting held on April 13th, 14th and 15th at the Qualicum
         Beach Civic Centre.

(2)    Planning, Water, Finance & Environment (Councillor Barry Avis)
       (a)   Advisory Planning Commission Minutes – April 4, 2007 Meeting – Received
             for information
       Councillor Avis reported on the following:
           • Councillor Avis presented Mayor Westbroek with a book from Nature Trust
             to be shared in the Council library

Councillor Avis MOVED and Mayor Westbroek SECONDED THAT first reading of the
burning bylaw be added to the May 7th agenda for review.
DEFEATED

Councillor Maurer MOVED and Mayor Westbroek SECONDED THAT first reading of
the burning bylaw be added to the regular meeting of Council on June 11th, 2007 for
review and consideration.

(3)    Community Development & Airport (Councillor Wendy Maurer)
       Councillor Maurer reported on the following:
         • Thanked the environment committee for including Communities In Bloom in
            this year’s celebration of Earth Day.

(4)    Protective Services, Arts & Culture (Councillor Mike Wansink)
       Councillor Wansink reported on the following:
         • Councillor Wansink noted that the Easter Long weekend saw a tremendous
             amount of vandalism in the Community Park
         • Arts and Culture – music on Sunday’s continues at TOSH and Milner
             Gardens is now open

(5)    Parks, Recreation & Transit (Councillor Jack Wilson)
       (a)    Recreation and Parks Commission Minutes – March 15, 2007 Meeting

Councillor Wilson MOVED and Councillor Avis SECONDED THAT staff be directed to
coordinate future infrastructure projects to permit trail development in the recreational
greenways if permitted.

             Councillor Wilson reported on the following:
               • Councillor Wilson wished to thank Town staff for the wonderful job done in
                  hosting the AVICC conference.
               • Noted that an announcement was made by Minister Ida Chong that $31,000
                  was awarded to the Town for construction of a new trail at Park Ridge through
                  the Local Motion Grant fund.

                (b) Heritage Forest Commission Minutes – March 29, 2007 Meeting –
                Received for information

      STAFF REPORTS
      (1)  Financial Administration (John Marsh, Financial Administrator)
           (a)   Biz Pal – report from staff

Councillor Wansink MOVED and Councillor Maurer SECONDED, THAT the consideration of
      implementing the Biz Pal program into the Town’s system be deferred to a later date in order
      to allow staff time to prepare a report which sets out the time needed to set the system up
      against the time saved.
      CARRIED

             (b)     Revenue and Expenditure Report to March 31, 2007 - Received for information

      Mr. Marsh reviewed the Revenue and Expenditure Reports as at March 31, 2007 with
      Council.

      Councillor Wansink thanked Mr. Marsh for providing the summary of Capital Expenditure
      Detail to March 31, 2007.

      (2)    Planning (Paul Butler, Director of Planning)
             (a)   Proposed rezoning of “Resort Condominium” properties

Councillor Wilson MOVED and Councillor Wansink SECONDED, THAT Council directs staff to
      request comments from the owners of the properties located at:
      • 240 Higson Crescent (Higson Court) – Townhouse Development
      • 3350 Island Highway (previously the Ben Bow Inn) – Townhouse Development
      • 3156 Island Highway (Oceansands) – Apartments
      • 3132 Island Highway (Edgewater) – Apartments
      • 2734 Island Highway (Adjacent to Shell Gas) – Apartments
      in regard to a proposed amendment to the Town of Qualicum Beach Land Use and
      Subdivision Bylaw 580 that would allow permanent residential use of a portion or all of
      those existing ‘resort condominium’ buildings located in the tourist commercial zones
      where the majority of units are currently occupied year round.

             (a)   Decentralized UV Water Treatment
Councillor Avis MOVED and Councillor Maurer SECONDED, THAT Council of the Town of
      Qualicum Beach direct staff to implement decentralized UV disinfection at the wellheads of
      the River Well Field for a cost not to exceed $800,000.

      BYLAWS
      1.     Bylaw No. 528.14
Councillor Wilson MOVED and Councillor Avis SECONDED, THAT the bylaw entitled “Town of
      Qualicum Beach Tax Rates Bylaw No. 528.14, 2007” be given first reading.
      CARRIED

      2.     Bylaw No. 579.04
Councillor Wilson MOVED and Councillor Avis SECONDED, THAT the bylaw entitled “Town of
      Qualicum Beach Development Cost Charge Reserve Funds Expenditure Bylaw No. 579.04,
      2007” be adopted.
      CARRIED

      3.     Bylaw No. 580.45
Councillor Avis MOVED and Councillor Maurer SECONDED, THAT the bylaw entitled “Town of
      Qualicum Beach Land Use and Subdivision Bylaw No. 580, 1999, Amendment (Gutters in
      Setbacks) Bylaw No. 580.45, 2007” be given second reading.
      CARRIED

      4.     Bylaw No. 599 Minutes of Parcel Tax Review Panel April 4, 2007 Meeting For
      information
Councillor Wilson MOVED and Councillor Avis SECONDED, THAT the bylaw entitled “Town of
      Qualicum Beach Regional Parks & Trails Parcel Tax and Assessment and Roll Preparation
      Bylaw No. 599, 2007” be adopted.
      CARRIED

      5.    Bylaw No. 603
Councillor Wansink MOVED and Councillor Avis SECONDED, THAT the bylaw entitled “Town of
      Qualicum Beach Sewer Facilities Reserve Fund Expenditure (Sanitary Sewer Capital
      Improvements) Bylaw No. 603, 2007” be adopted.
      CARRIED

      COMMENTS FROM THE GALLERY (maximum 2 minutes each)

      Frank Horner – 400 First Avenue West - Outdoor burning bylaw – Mr. Horner expressed his
      concern for delaying further discussion pertaining to the Outdoor Burning bylaw to June and
      suggested that Council address the matter in a timely manner.

      Neil Horner – Mr. Horner questioned whether the UV system would eliminate the use of
      chlorine in the Town’s water system.

Scott Tanner – 563 Crescent Road West - Mr. Tanner questioned the motion pertaining to the
UV system and asked what would happen should the project exceed the $800,000 budget
amount.

Neil Tranberg – 400 Garrett - Mr. Tranberg wished to thank staff for the assistance to date
pertaining to his project on Garrett Road and asked what the possibility was to adopt a
bylaw to rezone his property for permanent residential use.

Pete Abley – 501 Eaglecrest Drive - Mr. Abley wished to thank Mr. Marsh for his report and
suggested that a further column could be added to his report to include DCC’s. Mr. Abley
also wished to confirm that a report on the Bluff’s staircase would be available at the May
Council meeting.

Hans Rysdyk - 720 Fern Road East – Mr. Rysdyk expressed his concern with the outdoor
burning bylaw and feels that burning is fair better than chipping which in turn has fossil fuel
entering the environment from the trucks coming in and the trucks chipping the materials.

Councillor Wilson MOVED and Councillor Wansink SECONDED, THAT Council adjourns
the meeting.
