                                                     Sample Contingency Plan

On the following pages is a sample written Contingency Plan with emergency
procedures. Under the Resource Conservation and Recovery Act (RCRA), the
Environmental Protection Agency (EPA) requires businesses that generate large
quantities of hazardous waste (as well as treatment, storage, and disposal facilities or
TSDFs) to implement a Contingency Plan with emergency procedures in case of a
spill or other emergency. This sample plan is designed to follow the EPA
requirements.

A business may also be required to develop contingency planning as part of a Risk
Management Plan (RMP). An RMP is required for any business that has listed toxic
and flammable substances above specified thresholds.

This sample plan includes:

• a list of who must be contacted in an emergency

• a list of the actions to be taken during an emergency

• spill control procedures

• an evacuation plan

• reporting and recordkeeping requirements

• form letters to inform the following of your Contingency Plan:
   -   local police
   -   fire department
   -   local hospital
   -   local planning committee

Employers Covered

All large quantity generators of hazardous waste, as well as those with excessive
amounts of extremely hazardous substances, are subject to the EPA’s Contingency
Planning regulations. States may have stricter requirements than the EPA, and some
also require small quantity generators to have contingency plans.

This Contingency Plan and emergency procedures describe the actions expected of
each employee in the event of fire or other emergency and are designed to ensure that

       Attachment A1 includes the names, home addresses, and both office and home
