DECISION ON MINIMUM WAGE FOR LABOUR IN ENTERPRISES WITH FOREIGN OWNED CAPITAL The Minister of Labour, Invalids and Social Affairs Pursuant to Decree No. 57/HDBT of the Council of Ministers dated 24 March 1987 stipulating the functions, duties and powers of the Ministry of Labour, Invalids and Social Affairs; Pursuant to article 39 of the Regulations on Labour for Enterprises with Foreign Owned Capital issued with Decree No. 233/HDBT of the Council of Ministers dated 22 June 1990; Having consulted with the Chairman of the State Committee for Co-operation and Investment and the relevant bodies: DECIDES Article 1 The minimum wage for employees carrying out simple work in normal working conditions in enterprises with foreign owned capital which are permitted to operate within the territory of the Socialist Republic of Vietnam is stipulated and must be applied as follows: 1. In the case of enterprises with foreign owned capital which are located in Hanoi and Ho Chi Minh City, the minimum wage shall not be less than thirty five (35) US dollars per month. 2. In the case of enterprises with foreign owned capital which are located in the remaining provinces, cities, towns or suburbs or are labour intensive enterprises where the work is simple and in the areas of: agriculture, forestry and marine farming, the minimum wage shall not be less than thirty (30) US dollars per month. Article 2 SOCIALIST REPUBLIC OF VIETNAM Independence-Freedom-Happiness This Decision shall apply to all labour contracts signed as of 1 May 1992 (including labour contracts signed before that date which have expired but have been renewed). Article 3 Chairmen of people's committees of provinces and cities under central authority, and enterprises with foreign owned capital shall implement this Decision.
