Instead, this Article examines the disturbing state of confusion created by the Court's decision in Raich through the lens of RICO and the Nascimento decision. The Supreme Court should begin to remedy this confusion by clarifying that even after Raich, noneconomic, violent criminal behavior is never "commerce" for purposes of the Commerce Clause.
