WEST CHESTER AREA SCHOL DISTRICT RESOLUTION for RIGHT-TO-KNOW FEE SCHEDULE Background The Commonwealth has amended the Right-to-Know Law, 65 P.S. 67.101 et. seq. In order to comply with the new Right-to-Know Law, the West Chester Area School District has amended policy KBA, Public’s Right to Know and forms KBA-E, Request for Inspection And/Or Copies of Public Records of the West Chester Area School District, and KBA-E2, Response to a Request for Access to Public Records. In conjunction with the policy and form amendments, the District is required to set a fee schedule that complies with the fee schedule established by the Office of Open Records. Terms and Conditions AND NOW this _____ day of December, 2008, the Board of School Directors of the West Chester Area School District hereby adopts the Fee Schedule, attached hereto as Exhibit “A” and made a part hereof as if set forth in its entirety. The Fee Schedule shall replace all previous fee schedules pertaining to fees charged in conjunction with the Right-to-Know Law in their entirety. The Fee Schedule shall be effective January 1, 2009. Smith, President EXHIBIT “A” Fee Schedule Record Type Copies (A single side copy or one side of a double sided black and white copy of a standard 8.5” x 11” page) Fee*+ $0.25 per page Certification of a Record $1.00 per record (Note, charge is per record, not per page. Fee does not include notarization fees) Specialized documents (Includes, but is not limited to, blue prints, colored copies, and non-standard sized documents) Actual cost to the District Facsimile/Microfiche/Other Media Conversion to Paper Actual cost to the District If a record is only maintained electronically or in other non-paper media, duplication fees shall be limited to the lesser of the fee for duplication on paper or the fee for duplication in the original media unless the requester specifically requests for the record to be duplicated in the more expensive medium. Actual cost of mailing Actual cost to the District Postage Other fees (Costs the District incurs complying with the request. Specifically excluded from other fees are fees for District review of record, redaction fees, searching or retrieval fees, staff time or salary). * If a separate statute authorizes the District to charge a set amount for a certain type of record, the District may charge no more than the statutory amount. If a requestor wishes to inspect rather than receive a copy of a record and the record contains both public and nonpublic information that requires the District to redact the non-public information, the District may charge for the copies it must make of the redacted materials in order for the requester to view the public record. The above fees shall apply. If, after inspection, the requester chooses to obtain copies, no additional fee may be charged for the first redacted set. +
