									                         The General Dental Council
                (Dental Care Professionals Register) Rules 2006
The General Dental Council make the following Rules in exercise of their powers
conferred under sections 36B(4) and 36E of the Dentists Act 1984 a.

Citation, Commencement and Interpretation
1.      These Rules may be cited as the General Dental Council (Dental Care
Professionals Register) Rules 2006.

2.      These Rules shall come into force on 31st July 2006.

3.      In these Rules–

        “the Act” means the Dentists Act 1984;

        “primary qualification” means a qualification approved by the Council under
        section 36D(2) of the Actb (education and training for members of professions
        complementary to dentistry); and

        “restoration” means the restoration to the dental care professionals register of a
        name previously registered under a title or titles in that register.

Form and keeping of the register
4.      The dental care professionals register shall be kept by the registrar in such form
(including electronic) as the Council consider appropriate.

5.     The registrar shall keep the dental care professionals register up to date and shall
make, amend and erase entries in that register in accordance with these Rules and the
Act.

Applications
6.     Applications by the following persons shall be submitted to the registrar,
completed and signed, in a form to be determined and published from time to time by
the Council–
       (a)    a person seeking registration in the dental care professionals register
              under one or more of the titles specified in regulations made under
              section 36A of the Act c (professions complementary to dentistry),
              including a person already registered under a title or titles in that register;
              and
       (b)    a person seeking the restoration of their name to the dental care
              professionals register under a title or titles following the erasure of that
              name from registration under that title or those titles.

7.      The form of an application, as determined under rule 6, may be such that it
requires the person making the application to provide the following information -
        (a)     the person’s full name;

        (b)      the person’s date of birth;
        (c)      the title or titles under which that person is seeking to be registered;
        (d)      the address which that person wishes to be entered in the dental care
                 professionals register as his address;
        (e)      details of any previous registration with a competent authority outside the
                 United Kingdom;
        (f)      details of any criminal conviction, caution, penalty, order or
                 determination mentioned in section 36N(2)(d) to (g) of the Act d
                 (allegations) that he has or that has been made in respect of him, and
                 details of any pending investigation or proceedings that may lead to such
                 a conviction, caution, penalty, order or determination; and
        (g)      any other information or documents which the registrar may reasonably
                 require in order to determine the application, but nothing in this
                 paragraph shall be taken as requiring the submission of evidence that
                 prevents a person who, on the basis of the evidence that he has already
                 submitted, has an enforceable Community right from exercising that
                 right.

8.      A person of the type mentioned in rule 6(a) shall submit together with his
application–
        (a)    where relevant, one of the following –
               (i)     a certified copy of a primary qualification, or
               (ii)    sufficient evidence of a qualification granted outside the United
                       Kingdom which is relevant to the profession or class of members
                       of a profession to which the application relates; and
        (b)    where relevant, evidence of training or experience (or both) which
               demonstrates that he has the requisite knowledge and skill to practise
               using the title or titles to which the application relates,
but nothing in this rule shall be taken as requiring the submission of evidence that
prevents a person who, on the basis of the evidence that he has already submitted, has an
enforceable Community right from exercising that right.

9.      A person of the type mentioned in rule 6(a) who–
        (a)     is seeking to satisfy the registrar of matter C; but
        (b)     is not a person of the type mentioned in section 36C(3)(a) of the Acte
                (qualifications for registration),
shall submit, together with his application, a stamped and signed International English
Language Testing System test report form dated no earlier than two months prior to the
date of application.

10.     A person of the type mentioned in rule 6(b) shall submit together with his
application for restoration sufficient evidence that he satisfies any applicable training and
development requirements which are set out in rules under section 36Z2 of the Actf
(restoration of names to the dental care professionals register: professional training and
development).

11.    Except in a case to which rule 12 applies, a person of the type mentioned in rule
6 must also provide–
       (a)      an identity and character reference signed by either–
                (i)     the head of that person’s dental training school or his or her
                        nominee,
                (ii)    the person responsible for the supervision of that person’s
                        training, or
                (iii)   another person of professional standing; and
       (b)      a health reference signed by a registered medical practitioner other than
                the person who signs the reference described in paragraph (a),
but any person who signs a reference under this rule must not be a member of that
person’s family.

12.     A person of the type mentioned in rule 6 who is seeking recognition of a
qualification granted in another EEA State and who, in working in the United Kingdom,
is or would be exercising an enforceable Community right, shall submit together with his
application–
        (a)     the identity and character reference mentioned in rule 11(a) or
                documentary evidence, dated no earlier than three months prior to the
                date of his application, attesting to his good character and standing which
                originates from or is authenticated by the appropriate authorities of
                another EEA State; and
        (b)     the health reference mentioned in rule 11(b) or a document, dated no
                earlier than three months prior to the date of his application, attesting to
                his physical or mental state which is required by the appropriate
                authorities of another EEA State which regulates dental care
                professionals of his type who are seeking to practise in that State.

13.     A person of the type mentioned in rule 6 must submit together with his
application the relevant fee prescribed by the General Dental Council (Professions
Complementary to Dentistry) (Fees) Regulations 2006.g

14.     The Registrar shall issue a certificate of registration to each person whose name is
registered in the dental care professionals register.

15.     A registered dental care professional shall notify the Council forthwith of any
changes to or errors in his registration details, and for these purposes “registration
details” includes–
        (a)     any information the registered dental care professional was required to
                provide as part of his application for registration; and
        (b)     any information that, if he were seeking registration in the dental care
                professionals register under the title or titles under which he is registered,
                he would be required to provide as part of his application for registration.

The register
16.      The registrar shall enter the following details in the dental care professionals
register in respect of each person registered in that register–
         (a)     the person’s full name;
         (b)     the registration number allocated to that person by the registrar;
         (c)     the title or titles under which that person is registered;

        (d)     the person’s gender;
        (e)     the qualification (including the date on which that qualification was
                awarded) which entitles that person to registration under that title or
                where applicable the details of any alternative basis for that person’s
                registration;
        (f)     any additional qualifications entered in the dental care professionals
                register in accordance with rule 17;
        (g)     the address which that person wishes to be entered in the dental care
                professionals register as his address;
        (h)     the date of first registration of that person’s name in the register; and
        (i)     details of any restrictions imposed on that person’s registration by the
                Council from time to time.

17.     The registrar shall enter in the dental care professionals register the details of any
additional qualification recognised by the Council as a registrable additional qualification
which is held by a registered dental care professional upon receipt from that person of–
        (a)     a completed application, which is in a form to be determined and
                published from time to time by the Council;
        (b)     such evidence of the qualification as the Council may require; and
        (c)     the relevant fee (if any) prescribed under the General Dental Council
                (Professions Complementary to Dentistry) (Fees) Regulations 2006.

18.     Subject to rule 19, the registrar shall delete a person’s name from registration
under a title or titles in the dental care professionals register only in accordance with the
various provisions for erasure under the Act or provision for erasure under any
regulations made under section 36F(2) of the Act (fees).

19.     The registrar may delete a person’s name from registration under a title or titles in
the dental care professionals register where that person makes an application to the
Council for the removal of his name from registration under a title or titles provided that
the registrar is satisfied that there are no–
        (a)       unresolved allegations that the person’s fitness to practice is impaired; or
        (b)       unresolved matters relating to whether that person’s entry in the register
                  is correct.

20.     Where the registrar–
        (a)     receives information that an entry in the dental care professionals register
                is incorrect;
        (b)     receives an application from a person for an entry in the dental care
                professionals register to be altered; or
        (c)     is informed that a person’s registration in the dental care professionals
                register has been suspended or made conditional by a Committee under
                the Act,
the registrar shall make any necessary alterations to that register if satisfied that it is
appropriate to do so.
