1. This addendum is issued to provide for modifications in the specifications and/or plans associated with RFP No. 5-06. Acknowledgment of this addendum shall be made in the Proposal Letter (see page 32 of the RFP document), which is required as a part of each Proposer’s submittal. Any lost or missing documents are the sole responsibility of the Proposer. 2. Amend RFP No 5-06, Part II, Instructions to Proposers, Section 201, Schedule of Key Events, page 8, as follows (Underline denotes addition and strikethrough denotes deletion): 201. The following questions and associated responses were submitted to the Contracting Officer by potential proposers after the above-referenced pre-proposal meeting, or are being offered by Expo staff to clarify the requirements set forth in the RFP package. Set No. 2 Q1. Can individual members of a joint venture or team submit specific elements of a proposal submission that it considers proprietary directly to Expo, instead of through its Joint Partner or a Prime Contractor? No. Members of a proposal team (e.g., partner, prime, subcontractor) that do not want to disclose proprietary information to another member of the team should stamp the material “confidential” and/or “proprietary”, and seal the information in an envelope for submission with the team proposal. Items submitted separately from a team proposal and/or after the proposal deadline will not be accepted. Through what process can interested parties request a copy of documents referenced in the RFP? Any party interested in reviewing a copy of documents referenced in the RFP package may submit a request for public records to Metro (for Metro documents) or Expo (for Expo documents). The contact person for public records requests at Expo is Gregory Moore, Procurement Manager. Gregory can be reached at (213) 243-5505. Why isn’t there a DBE goal associated with this project? Expo strongly encourages the use and participation of DBE firms; however, Federal regulations do no permit the setting of contract goals in DBE programs that rely entirely on race neutral means of participation. Based on guidance from the U.S. Department of Transportation and Caltrans, Expo can only apply race-neutral means to encourage participation in Expo projects, and race-based goals cannot be applied to specific project goals unless the Authority has empirical data demonstrating evidence of past discrimination. Expo does not have such data and is currently awaiting the results of a broad-based discrimination study undertaken by Metro in the local geographic area. In the interim, Expo has taken guidance from the federal regulations on how an agency implements race neutral goals (outreach, technical assistance, etc.) and “passed down” this information to the successful Proposer under the terms of RFP No. 5-06 (see Page 34).
