Maharashtra Pollution Control board invites sealed tenders from agencies which have valid recognition under NABL/ EP Act,1986 and educational institutes with necessary infrastructure, manpower & experience in the field, of noise level monitoring, as described in Schedule “A” and specifications given in Schedule “B”. 2. The Bidder should have executed similar works during the last 2 years. 3. Interested eligible bidders may collect further information and tender documents from PAMS Division, Head Office, M.P.C.Board, 3rd Floor, Kalpataru Point, Sion-Matunga Scheme Road No.8, Opp. Cine Planet, Sion (E), Mumbai-400022. 4. The complete set of bidding documents may be purchased or downloaded from MPCB web site at “http://mpcb.mah.nic.in” by eligible bidders for non refundable price of Rs.500/-. Request for Proposal (RFP) to monitor Ambient Noise Levels in Maharashtra during Ganesh Festival & Diwali Festival, 2008
Maharashtra Pollution Control Board (MPCB) seeks to monitor data pertaining to Ambient Noise Levels in Maharashtra during Ganesh Festival & Diwali Festival. The monitoring would pertain to noise level monitoring continuously for 6 hrs.(18.00 hrs. to 24.00 hrs.)at each location. The data would pertain to ambient noise levels as hourly L equivalent dB(A) and 6 hourly average L equivalent dB(A). The MPCB ‘ Request For Proposal’ (RFP) from Agencies and Educational Institutions, having experience in this field.

The RFP can be obtained from PAMS Division, Maharashtra Pollution Control Board, Kalptaru Point,2nd-4th floor Opp.Cine planet Cinema; Near Sion Circle, Sion (E), Mumbai-400 022 on payment of non-refundable fee of Rs.500/- in the form of Pay Order/ Demand Draft drawn on Nationalised Bank/ Scheduled Bank favouring “Maharashtra Pollution Control Board ” payable at Mumbai. 1. GENERAL TERMS AND CONDITIONS : 1.1 This document contains the following: I. II. III. IV. V. VI. VII. VIII. IX. Copy of the Tender Notice. General Terms and Conditions of Bid. Terms and Conditions for submission of Bid. Payment Terms Application Form Bid Form Undertaking Schedule “A” for description of monitoring locations. Schedule “B” for specifications of Noise meters.

1.2 The tender document is not transferable by the purchaser. Each sheet of the Bid is to be signed by the bidder. The Price Bid must be in the form provided herewith at Annexure-II and be submitted along with the undertaking at Annexure- III. The documentary evidence of the experience conformity to the bidding documents in the form of literature, drawings and data shall be furnished. A list giving full particulars including available Noise meters,, make, model, specifications etc. shall be given. Bidders having minimum 25 Noise Meters are only eligible to submit the Bid. Agencies which have valid recognition under NABL/ EP Act,1986 and educational institutes with necessary infrastructure, manpower & experience in the field of noise level monitoring are only eligible for submission of bids. Preference will be given to NABL accredited agencies. 1.3 The Board undertakes no responsibility for delay or non receipt of bid document sent by post either way and also reserves the right to accept or reject any or all the tenders in part or full, without assigning any reason thereof. 1.4 No tender document will be sold after last date of sale of Tender Document or between the extended period of opening day, if any. 1.5 The bidder is expected to examine all instructions, forms, terms and conditions and specifications mentioned in the tender document. Failure to furnish all information required by the tender documents or submission of a bid not substantially responsive to the tendering document in every respect will be at the bidder’s risk and may result in the rejection of tender. The bidder should have executed similar work during the last 2 years. 1.6 This call of bids does not bind the MPCB to place order. The bids submitted in response to this invitation may be rejected without assigning any reason. 1.7 The Board at its discretion may extend the last date of submission of bids and opening of bids. The authority for acceptance of a Bid will rest with the

Member, Secretary, Maharashtra Pollution control Board who does not bind himself to accept the lowest bid and is vested with authority to reject any or all of the bids received, without assigning any reason. 1.8 Documents, samples, etc. enclosed in the Bid shall become the property of the Maharashtra Pollution Control Board without any payment. 1.9 The validity of this contract is 36 months. 1.10 The Bidder should have the experience of executing similar Noise level monitoring surveys during the last 2 years. The technology of the instruments shall be current and shall continue to be operational for sufficient period, to be mentioned in the offer. During this period, the bidder shall give firm guarantee to keep the noise meters in working condition. The Bidder shall furnish an undertaking for uninterrupted, satisfactory operation of noise meters. 1.11 In case the date of opening of Bids is declared as Public Holiday, the Bid shall be opened on the next working day at the same time. 1.12 The bid shall contain no interlineations, erasures or overwriting of words except as necessary to correct errors made by the bidders, in which case such correction shall be initialed by the person or persons signing the bid. 1.13 Late and delayed bids shall not be accepted and would be returned unopened to the Bidder. 1.14 The bids may be dropped in the Bid Box kept at Maharashtra Pollution Control Board, 3rd floor, Kalpataru Point, Opp. Cine Planet, Sion Circle, Sion (E), Mumbai 400 022. However, the bidders may send the bids by Registered A.D. at his risk as the bids, not received within the day and time fixed, shall not be considered. In no case bid should be handed over to any employee of the Board. 1.15 Canvassing in any form will disqualify the bidder. 1.16 Request for Tender Document through Telex, Telephone, Money Order and Tele fax shall not be entertained. 1.17 The Tender Notice No. “Noise Level Monitoring 01/ 2008” must be invariably quoted in bids and further correspondence in this regard. 1.18 Noise Monitoring during Ganesh Festival shall be carried out for the last 5 days of the festival, from 18.00 hrs. to 24.00 hrs. Continuously for 6 hours for each location & the locations should comprise residential, commercial and silence zones. 1.19 Noise Monitoring during Diwali Festival shall be carried out for 3 days, from 18.00 hrs. to 24.00 hrs. Continuously for 6 hours for each location & the locations should comprise residential, commercial and silence zones. 1.20 Results should be reported as hourly L equivalent dB(A) and 6 hourly average L equivalent dB(A),as per the monitoring data sheet enclosed at

Annexure - A. 1.21 Final compiled report with photos, graphs and comparison with standards and with previous year’s results (50 copies) should be submitted with in one month, separately for Ganesh Festival & Diwali Festival. 1.22 Noise level meters used for monitoring should be of Type- I or Type- II. 1.23 All the correspondence related to bids including submissions of Bids should be addressed to: The Member Secretary, Maharashtra Pollution Control Board, 3rd & 4th Floor, Kalpataru Point,, Sion-Matunga Scheme Road No.8, Opp. . SUBMISSION OF BID: The Bid prepared by the bidder and all correspondence and documents relating to the tender exchanged by the bidder and MPCB shall be written in English language. Bid may be written in any another Indian language so long as it is accompanied by English, translation of its pertinent passage in such case, for purpose of interpretation of the bid, the English translation shall govern. The bid must accompany Annexure-I with Techno-commercial part of bid and Annexure-II along with Price part of the bid duly filled in and signed by the bidder along with the seal of the firm. The bidders are requested to quote the rates of Noise Level Monitoring continuously for 6 hours from 18.00 hrs to 24.00 hrs. per station per day. The Bidders shall quote the monitoring rate for all cities. Maharashtra Pollution Control Board reserves the right to accept the bid in full or in part for some limited cities. The Bid is to be submitted in Single stage- 2 envelopes system, i.e. the first sealed envelope will contain full information required to judge prequalification, complete details and specifications of the Noise meters to be used, including the make, model and list of credentials with documentary evidence such as noise level monitoring carried out during festivals etc. The second envelope will contain only rate quoted by the bidder for noise level monitoring continuously for six hours from 18.00 hours to 24.00 hours per station per day, in the form given in Annexure-II of this document and shall be clearly marked “Noise Level Monitoring 01/ 2008”. (NOT TO BE OPENED BEFORE 07.08.2008). 2.6 Technical and commercial part of the tender will be opened first on due date, i.e. 07/08/08 at 4.00 pm. in the office of the Maharashtra Pollution Control Board 2nd,3rd & 4th Floor, Kalpataru Point, Sion-Matunga Scheme Road No.8, Opp. Cine Planet, Sion (East), Mumbai – 400 022, in presence of the representative of the bidders who choose to be present. Sealed price part of the Techno-commercially accepted bids will be opened on the same day if possible or on a later date which will be communicated by the Board on the same day or on a later day by post/fax. The rates should be quoted both in words and figures. Bids not in proper sealed cover or received telegraphically will not be entertained. Conditional bids will be rejected without assigning any reason. The bid shall be typed or written in indelible ink and shall be signed by the bidder or a person or persons with due authorization should bear the signatures of only the authorized person of the firm. All pages of the bid, except for un-amended printed literature shall be initialed by the person or persons signing the bid. To assist in the examination, evaluation and comparison of bids the Board may, at its discretion, ask the bidder for a clarification of its bid. However, no change in the rate or substance of the bid shall be sought, offered, repermitted. The placement of Work Order will be according to Technical evaluation of the bid. The rates given in the bids are fixed rates, irrespective of rise in material prices and increase in taxes or any statutory increase etc. With the submission of this bid the bidder accepts the conditions of the tender. Each folio of the bid must be signed by the bidder. Bidder can quote the rates for noise level monitoring continuously for six hours from 18.00 hrs to 24.00 hrs per station per day, for all the cities/stations or some of the cities/stations. The Board further reserves the right to accept the bid for all the cities/stations or some of the cities/stations for which the bidder has quoted the bid. At any time prior to the deadline for submission of the bids the Board may for any reason whether at it’s own initiative or in response to a clarification

requested by a prospective bidder, modify the tender documents by an amendment. 2.18 The amendment if any, will be brought to the notice in writing or by fax or email to all concerned bidders, who have received the tender documents and will be binding on them. In order to afford prospective bidder reasonable time, in which to take the amendment into account in preparing their bids, the Board may at its discretion, extend the date for the submission of bids.

MOST IMPORTANT : PLEASE NOTE THAT ANNEXURE-I OF THIS DOCUMENT MUST BE ENCLOSED WITH THE FIRST PART OF BID i.e. “TECHNO-COMMERCIAL BID” AND ANNEXURE-II & III WILL BE KEPT IN THE SECOND PART OF BID i.e. “PRICE BID”. The payments will be made within 30 days as per the actual monitoring work done, after successful completion of the noise level monitoring surveys and after submission of the survey report with photos, graphs and comparison with standards and with previous year’s results (50 copies) along with the Bill in duplicate. Bills for Ganesh Festival and Diwali Festival shall be submitted separately.
4.0

Validity of the Contract: The rates quoted shall be valid for a period of 3 years. However, initially the work will be awarded for one year. Subsequently, based on the performance of the bidder/ contractor, further extension of work will be given by MPCB at its sole discretion. The bidder will not have right of refusal of extension.
JURISDICTION:

In case of any dispute, the Mumbai Court alone will have the jurisdiction to try the suit on contract.
