REQUEST FOR PROPOSAL 470 application number - 906910000639346 Notice is hereby given that the Midway Independent School District (MISD) will accept proposals from qualified vendors for local and long distance telecommunications services, computer equipment, internet hosting, internet service, cell phone service, network equipment, basic internal maintenance, and labor and materials for internal connections. Specifications and bid proposal documents may be obtained by mail, Internet document or in person from the MISD Technology Office, 800 Hewitt Drive, Hewitt, TX 76643 Proposals must be returned via fax, email or in a sealed envelope, identified by RFP number ERATE2008 and the proposal number indicated below, and addressed to or filed with the Technology Office on or before 10:00 AM, DECEMBER 19, 2007. All proposals will be opened on December 19th @ 2:00pm in the MISD Technology Office located at 800 Hewitt Drive, Hewitt, TX 76643. All work pursuant to this contract shall be contingent upon E-Rate funding, board acceptance, and project viability. Note: It is the total responsibility of the Vendor to return proposals to MISD by the required date, time, and place. The MISD Technology office is closed on weekends and holidays. Including 2 PRI and 50 POTS (Plain old telephone lines). Local and long distance charges should appear on a separate bill. Quantity of voice/fax instruments, number of buildings, number or rooms is estimated. Information is for reference only, and may not be complete. MISD requirements do not allow for a change in telephone numbers, or existing equipment. There must be "no cost" in any change of local or long distance service. The decision of the MISD shall be final. Any and all proposed changes in infrastructure or operations must be specified. In the absence of such information, the MISD is relying on the premise that no change will occur. 470-08-01 Sites Plain Old Telephone Service POTS PRI (2) Specifics: Service for all Midway ISD Sites (approximately 50 lines) Service for entire district TELECOMMUNICATION SERVICES – CELLULAR PHONE SERVICE – proposal number 470-08-02 The contract term for cellular phones and services will begin July 1, 2008 and end June 30, 2009. The cost of cellular phones and services that are added during the contract term will be charged according to the contracted rate. All cell phones and services will terminate June 30, 2009. This service must be utilized with existing district cellular services. Basic Maintenance Internal Connections – Smartnet Maintenance – proposal number 470-08-08 470-08-08 Qty 1 Description SmartNet Maintenance – (2) 6509 Switches & (4) 4506 Switches Internal Connections – Cisco Switches – proposal number 470-08-09 470-08-09 Qty 4 Description Cisco 4506E network switch with Supervisor 6-E, 2 PWR-C452800ACV power supplies for POE, 3 - WS-X4648-RJ45V-E blades, 2 – twin GB converter modules (description is for each switch) Appendix 1 The MISD employee below is responsible for various aspects of this proposal. Please refer requests for technical clarifications regarding the various 470 forms to the person responsible for the form in question. Before submitting a bid, each bidder is expected to thoroughly examine the actual conditions (if applicable), specifications, general conditions, and all other related contractual documents. Failure to do so will be at the bidders risk, and will not bar the bidder's obligation to perform if a contract is awarded pursuant to this Invitation to Bid. Each bidder must satisfy himself/herself by personal examination and by such other means as he/she may prefer as to the actual conditions and requirements under which the contract will be performed. It is the total responsibility of the bidder to return the bid to the place called for, by the deadline. No bid or modifications received after the time specified in this Invitation to Bid will be considered for award. The MISD is closed on weekends, holidays, and between 12:00 noon and 1:00 P.M. weekdays, and cannot receive bids during these times. Changes, additions, or any other modifications which are not specifically called for in the bid may cause the bid to be rejected as not being responsive to the Invitation to Bid. Unless otherwise requested by the MISD, all items supplied pursuant to this bid shall be new and unused. 2. 3. 4. PRICES 1. All prices and notations must be typed or written in ink. Verify all prices before submission, since they may not be corrected after bids are opened. No oral or telegraphic modification will be considered. ADDENDA AND CHANGE ORDERS 1. If any bidder finds discrepancies in, or omissions from the bid documents, he/she may submit a written or faxed request for clarification or correction thereof. A copy of the request for clarification and the response thereto will be mailed or faxed to all bidders. The MISD fax number is 254-761-5777 Changes in the bid documents shall be made by addenda and processed through MISD Purchasing. The MISD will not be responsible for oral interpretations. All addenda issued during the time of bidding shall be incorporated into the bid. No changes in the bid documents will be made by MISD staff when notice of said change in bid documents is received by the MISD office less than two (2) business days before the formal close of bidding. 2. 3. MISD E-Rate 2008-2009 Page 5 of 8 RENEWAL OF ONGOING SERVICE 1. The MISD reserves the right to renew ongoing service for telecommunications, pagers, internet access and wireless service for up to two (2) years following the initial agreement. Such renewal shall be in writing, and subject to availability of funds in subsequent years. ACTUAL CONDITIONS 1. VENDOR shall be responsible for examining actual site(s) and certify all measurements, specifications, and conditions affecting the work to be performed at the site(s). By submitting a bid, VENDOR warrants that they have made such site examination(s) as they deem necessary as to the condition of the site(s), its accessibility for materials, workers, and utilities, and ability to protect existing surface or subsurface improvements. No claim for allowance of time or money will be allowed as to such matters for any other undiscovered conditions on the site(s). 2. 3. DELIVERY / RISK OF LOSS OR DAMAGE 1. Unless otherwise requested all items supplied to the MISD shall be bid F.O.B. destination (U.C.C. 2-319 (1). a.). The bidder is required to absorb all delivery costs. The MISD shall not be liable for any delivery, storage, demurrage, packing, or freight charges involved in the shipment of the item(s). The Vendor shall be responsible for all transportation, loading, and unloading of materials or equipment associated with the project. The Vendor agrees to assume all risk of loss or damage until the project is accepted by the MISD. LIABILITIES 2. 3. 1. The Vendor or Vendor shall save, defend, hold harmless, and indemnify the MISD against any and all liability, claims, and costs of whatsoever kind and nature for injury to or death of any person or persons, and for loss or damage to any property occurring in connection with or in any way incident to or arising out of the occupancy, use, service, operations, or performance of work or supply of material under the terms of this contract, resulting in whole or in part from the negligent acts or omissions of Vendor, and subcontractor, or any employee, agent, or representative of Vendor or subcontractor. 2. The Vendor or Vendor shall hold the MISD, its officers, agents, servants, and employees harmless from liability of any nature or kind, including the use of any copyrighted or uncopyrighted composition, secret process, patented or unpatented invention, articles, or appliances furnished or used under this bid. The Vendor agrees to defend, at his own MISD E-Rate 2008-2009 Page 6 of 8 expense, any and all actions brought against the MISD or himself because of unauthorized use of such articles. Insurance 1. The vendor agrees to maintain insurance adequate for protection from claims under Workers Compensatory Acts, and from claims for damages for personal injury, including death and damage to property, which may arise from operations under the contract. The VENDOR shall not allow any Subcontractor, employee or agent to commence work on this contract or any subcontract until the insurance required of the VENDOR, subcontractor, or agent has been obtained. 2. Any bidder may withdraw his or her bid personally or by written request at any time prior to the scheduled due date and time for receipt of bids. MISD E-Rate 2008-2009 Page 7 of 8 FELONY CONVICTION NOTICE FELONY CONVICTION NOTICE: All proposers must complete the following Felony Conviction Notification. Felony Conviction Notification State of Texas Legislative Senate Bill 1., Section 44.034, Notification of Criminal History, Subsection (a), states “a person or business entity that enters into a contract with a school district must give advance notice to the district if the person or an owner or operator of the business entity has been convicted of a felony. The notice must include a general description of the conduct resulting in the conviction of a felony.” Subsection (b) states “a school district may terminate a contract with a person or business entity if the district determines that the person or business entity failed to give notice as required by Subsection (a) or misrepresented the conduct resulting in the conviction. The district must compensate the person or business for services performed before the termination of the contract.” This Notice is not required of a publicly held corporation.
