INTR ODUCTION
The Office of the Ohio Secretary of State has prepared this manual to assist you in the
implementation of voter registration programs under the National Voter Registration Act of 1993
(NVRA) and Ohio law. It will aid persons who assist applicants in completing voter registration
forms. It also will (1) answer questions related to voter registration, and (2) outline the duties of
personnel in offices of the registrar and deputy registrars of the Ohio Bureau of Motor Vehicles to
provide voter registration and fulfill their duties under the NVRA.

The National Voter Registration Act of 1993 (NVRA), Pub. L. 103-31, May 20, 1993, 107 Stat. 77, 42
U.S.C. 1973gg — commonly referred to as the “motor voter law”—became effective on January 1,
1995. The purposes of this Act include:
• Establishing procedures to increase the number of eligible citizens who register to vote by
mandating that voter registration opportunities be provided at the state bureau of motor
vehicles (BMV) and certain designated agencies.
• Protecting the integrity of the electoral process by mandating procedures for the
maintenance and cleansing of voter registration rolls.
• Ensuring the maintenance of accurate and current voter registration rolls by reporting
certain statistical information to the U.S. Elections Assistance Commission (EAC).

Following NVRA’s passage, the Ohio General Assembly enacted Substitute Senate Bill No. 300 to
incorporate the requirements of the federal law into Ohio law, effective January 1, 1995. Ohio’s laws
governing voter registration have been amended occasionally since then. Currently, state law
requires certain offices and other public entities to provide, in each of its offices or locations, voter
registration applications and assistance in the registration of qualified persons, in accordance with
R.C. Chapter 3503 as follows:
• All bureau of motor vehicle locations, in accordance with R.C. 3503.11.
• All designated agencies, in accordance with R.C. 3503.10. “Designated agency” is defined in
R.C. 3501.01(X) to mean “an office or agency in the state that provides public assistance or
that provides state-funded programs primarily engaged in providing services to persons with
disabilities and that is required by the National Voter Registration Act of 1993 to implement a
program designed and administered by the Secretary of State for registering voters, or any
other public or government office or agency that implements a program designed and
administered by the Secretary of State for registering voters, including the department of job
and family services, the program administered under section 3701.132 of the Revised Code
by the department of health, the department of mental health, the department of mental
retardation and developmental disabilities, the rehabilitation services commission, and any
other agency the Secretary of State designates. ‘Designated agency’ does not include public
high schools and vocational schools, public libraries, or the office of a county treasurer.”
o Included in this definition of “designated agency” is each office of a state assisted
college or university that provides assistance to disabled students, the Women,
Infants, and Children (WIC) program of the Ohio Department of Health, the Ohio
Department of Mental Health, the Ohio Department of Developmental Disabilities,
Ohio’s Rehabilitation Services Commission, and the Ohio Department of Job & Family
Services including county offices.

• All public libraries, county treasurer offices, and public high schools and vocational schools
(which R.C. 3501.01(X) specifically exempts from the definition of “designated agency”), in
accordance with R.C. 3503.10.
• Voter registration services also are available to qualified individuals using the services of a
U. S. Armed Forces recruitment office.
HISTORICAL BACKGROUND
Ohio has offered voter registration services at the offices of the Bureau of Motor Vehicles registrar
and deputy registrars for more than 30 years. Consequently, Ohio was well prepared to comply with
the NVRA provision that became effective on January 1, 1995, requiring each state subject to the
NVRA to provide voter registration services to persons applying for certain driver licenses, permits,
endorsements and identification cards. (R.C. 3503.11, 4506.07, 4507.06 and 4507.51)
Am. Sub. S.B. 300, which became effective on January 1, 1995, to incorporate the federal provisions
into state law, set forth the procedures to be followed by the BMV registrar and deputy registrars
when offering voter registration in accordance with the NVRA and processing completed registration
forms. (R.C. 3503.11 and 3503.19)
R.C. 3501.05 as amended by Am. Sub. S.B. 300 required the Secretary of State to:
• “Prescribe a general program for registering voters or updating voter registration
information, such as name and residence changes, at ... the offices of deputy registrars
of motor vehicles, ... and prescribe a program of distribution of voter registration forms
through ... the offices of the registrar and deputy registrars of motor vehicles ...”
• “Adopt rules ... for the purpose of implementing the program for registering voters at
... the offices of the registrar and deputy registrars of motor vehicles.”
Additionally, Am. Sub. S.B. 300 enacted R.C. 4501.023 to require the BMV registrar to designate an
employee to be in charge of voter registration within the BMV; to provide, in cooperation with the
Secretary of State, voter registration training programs and materials; and to make periodic reports
to the Secretary of State regarding the results of implementation. R.C. 4501.023 also required each
deputy registrar to designate an employee to be in charge of voter registration within that deputy
registrar’s office.
Those statutory mandates led to the development of the procedures set forth in this manual and the
designation of the persons who would be in charge of, and responsible for, implementing the
registration program at their respective offices and reporting the implementation results: the BMV
Administrator (on behalf of the registrar of motor vehicles) and the deputy registrar office manager
(on behalf of each deputy registrar).

BM V A D MINIS T RATO R
The BMV’s Administrator for Deputy Registrar Services is responsible for overseeing all voter
registration activities for the BMV. The Administrator has the following duties:
• Liaison. The Administrator serves as the liaison between the BMV and the Secretary of
State.
• Training. In cooperation with the office of the Secretary of State, the Administrator
must develop a training program and provide training materials for deputy registrars
and their employees.
• Reporting. Semi-annually, the Administrator shall obtain from the deputy registrars
the following data: the number of applicants for licenses, and the number of new voter
registrations, and change of address and change of name forms completed by
customers who apply for a driver’s license, commercial driver’s license, a State of Ohio
identification card, or motorcycle operator’s license, or endorsement, renewal, or
duplicate of any of these. The Administrator must report this information to the
Secretary of State annually.
• Ordering supplies. The Administrator is responsible for ensuring that each deputy
registrar’s office has a sufficient supply of voter registration forms, transmittal forms,
posters, voter registration instructions brochures and other necessary materials.

DEPUTY REGISTRAR’S OFFICE MANAGER
Appointment
The Office Manager for each deputy registrar’s office shall be designated by the deputy registrar to
be in charge of, and responsible for, voter registration in that office, unless the deputy registrar
designates, in writing to the BMV Administrator, another individual to perform these duties.
Responsibilities
The Office Manager has the following duties:
• Liaison. The Office Manager serves as the liaison between the deputy registrar’s office
and the board of elections in the county in which the deputy registrar’s office is located.
• Site employee training. Each employee at a deputy registrar’s office should be
trained on the operations of the voter registration program. The Office Manager shall
provide training to current employees and to new employees upon their arrival. The
Office Manager is responsible for ensuring that all the office’s employees comply with
the requirements of the voter registration program.
• Ordering supplies and display of promotional materials. The Office Manager
must ensure the deputy registrar’s office has an adequate supply of the materials
necessary to conduct the voter registration services program.
• Reporting. Each Office Manager must report to the board of elections the total
number of voter registration forms transmitted from that office. This number includes
the office’s computer generated forms and any other voter registration forms
(prescribed state and county voter registration forms) received at the deputy registrar’s
office.
The Office Manager satisfies this reporting requirement by enclosing a properly completed voter
registration transmittal form (Exhibit B) with the voter registration forms that are submitted to the
board of elections in the county in which the deputy registrar’s agency is located. Each deputy
registrar’s office must submit the voter registration forms with the properly completed transmittal
form to the board of elections at least once every five (5) days.
The Office Manager shall record the number of applicants for licenses served in that office, and the
number of voter registrations, change of address and change of name notices completed in that
office by customers who apply for a driver’s license, commercial driver’s license, a State of Ohio
identification card, or motorcycle operator’s license, or endorsement, renewal, or duplicate of any of
these, and transmitted by the office to the board of elections. These numbers shall be reported to
the Administrator at least semi-annually. Upon request, any additional information required by the
Administrator shall be reported. For specific information and instruction on reporting, please see the
“Handling Completed Voter Registration Forms” sub-section of this manual.

VOTER REGISTRATION CHECKLIST
A successful voter registration services program depends on creating and implementing a simple
internal system that will run smoothly with little maintenance. The following checklist will help office
managers to determine if they have established a simple and effective program.
Checklist for Office Manager
• I am familiar with all aspects of the voter registration program and how the program works
at the deputy registrar’s office.
• I have made arrangements with the BMV Administrator for initial and on-going training of
agency personnel.
• I have established a system for program monitoring, reporting to the BMV Administrator,
and transmitting the completed forms to the board of elections.
Note: This is best accomplished by creating a written plan.
• I have an adequate supply of all materials I need to operate the voter registration program.
Note: This includes voter registration forms and informational materials that may
be provided to clients, as well as training materials for staff.

To implement and operate a voter registration program, each office shall have the following
supplies:
• Voter registration forms:
o The Secretary of State has prescribed the format of the computer-generated voter
registration form to be used by all BMV offices. (Exhibit A)
o Deputy Registrars also must have a supply of the standard state or county (non-
computer-generated) voter registration forms.
• Transmittal forms. The transmittal form that is enclosed with this manual should be used
by each Office Manager when submitting voter registration forms to the county board of
elections. It may be copied by the Office Manager as needed. (Exhibit B)
• Voter Registration Instructions brochure. This brochure is to be given to any person
who requests three or more voter registration forms from a BMV office.

Procedures for ordering supplies
The BMV is required to supply each deputy registrar with a sufficient number of voter registration
forms. The Secretary of State has given the BMV a formatted file of the voter registration form.
Each deputy registrar is required to maintain a sufficient supply of voter registration materials.
Therefore, it is critical for the BMV Administrator and a deputy registrar’s Office Manager to remain
in constant communication to ensure that an adequate supply of forms is maintained at all times.
The BMV Administrator is responsible for allocating supplies, but the Office Manager must be aware
of the level of supplies in each Deputy Registrar’s office and contact the Administrator promptly
when in need of additional supplies.
Note: A sufficient supply of forms is particularly critical during pre-election periods.
The timely ordering of supplies ensures the year-round voter registration program
will run smoothly.

EMPLOYEE TRAINING
For BMV voter registration services program to be successful, all employees participating in the
program must be adequately trained. In many cases, deputy registrars will be providing customers
with assistance in completing voter registration forms. Training gives employees of a deputy
registrar’s office the skills and information needed to provide this assistance. Additionally,
arrangements to train new employees and orient existing employees to new or updated program
information should be included in the voter registration program.
Training should include the following:
• A program overview and explanation of the voter registration programs’ goals and
benefits.
• A discussion of the roles and responsibilities of employees.
• A review of all materials used in the program.
• An orientation to voter registration rules and regulations, including deadlines.
• A step-by-step guide to completing the voter registration form.
• A discussion of non-partisanship and how to handle questions regarding enrollment or
affiliation with a political party. Employees being trained to provide voter registration
services must be instructed that they are required to maintain political neutrality and to
refrain from demonstrating political preference or party allegiance.
• Instructions that the decision of a customer whether to register as an elector shall be
given no consideration in the decision of whether to issue the customer a license or a
renewal or duplicate.
• Instructions that the customer should not be required to fill out any information on the
BMV computer-generated voter registration form which duplicates information on the
application for a license, identification card, or endorsement.
• Instructions for program maintenance (ordering supplies, program monitoring and
reporting).

VOTER REGISTRATION PROCEDURES
Each deputy registrar employee shall:
Ask each customer who is applying for a:
• Driver’s license,
• Commercial driver’s license,
• State of Ohio identification card,
• Motorcycle operator’s license,
• Endorsement, renewal, or duplicate of any of these,
if the customer would like to register to vote or to update a current voter registration, based on
a change of address or name change.
If the customer desires either to register to vote or to update his or her current voter
registration:
• Print out the computer-generated voter registration form for the customer.
• Offer to assist the customer in filling out the additional information not automatically
printed on the form by the BMV computer.
• Instruct the customer that the form must be signed. (See detailed instructions in
Completing the Voter Registration Form section listed below).
• Inform the customer that he or she will receive an acknowledgement notice from the
county board of elections that will identify the precinct and polling place where the
customer will vote. Also inform the customer that, if the acknowledgement notice is not
received in a timely manner, the customer should contact the board of elections of the
county in which the customer resides.
• Offer to accept the customer’s completed and signed form for transmittal to the board
of elections.
C O M PL E T I N G T HE V O T E R R E G I S T R A T I O N F O R M
A. Using the computer-generated BMV form
Inform the customer that certain information from the license application has been pre-printed on
the voter registration form. The customer does not need to fill out any information already printed
on the form, but the employee should ask the customer to verify the information.

Review the form for missing information and advise the customer to fill in any missing information.
Please refer to the voter registration form (Exhibit A) in the back of this manual to become familiar
with the registration form requirements.
The following instructions will help the employee to answer questions and assist the applicant in
filling out the voter registration form:
Box 1 and 2: “Citizenship and Age:” Must be answered. If the applicant answers “No” to
either question, the person is not eligible to register to vote and may not complete the
form.
Box 7: “Additional rural or mailing address:” Enter any additional address information,
including a mailing address if different than residence address (e.g., a post office box, etc.).
Box 10: “Ohio driver’s license number or last four digits of Social Security number:”
If the applicant has a current Ohio’s driver’s license, that number must be entered in Box
10. If the applicant does not have an Ohio driver’s license, the last four digits of the
applicant’s Social Security number must be entered. If the applicant does not have either an
Ohio’s driver’s license number or Social Security number, the applicant must enter “None” in
Box 10.
Box 11: “Telephone number:” Applicant enters telephone number. This is voluntary
information, but is helpful to the county board of elections if it needs to contact the person
concerning his or her registration.
Box 12: “Previous address if updating current registration:” If this is a change of
address update, applicant must fill in previous voter registration address.
Box 13: “Change of Name Only:” If updating current registration record to reflect a name
change, applicant must provide both previous name and previous signature.
Box 14: “Signature:” Registration cannot be processed without the applicant’s signature. The
applicant must affix his or her signature or mark, taking care that it does not touch
surrounding lines of type. If the applicant’s signature is a mark, the person assisting the
applicant completing the registration form must also include his or her name and address.
Attorney in fact: If, by reason of disability, an applicant or elector is unable to physically
affix his or her signature or mark to the voter registration/change of name/change of
address form, the person whom the applicant or elector has appointed his or her attorney
in fact under R.C. 3501.382 may sign that form on behalf of the applicant, at the direction,
and in the presence, of the applicant or elector.
After the customer completes the voter registration form, the employee should review the form for
completeness and advise the customer of any missing information.

B. Using any other voter registration form (Prescribed by state or county)
Any deputy registrar or employee of a deputy registrar’s office who assists with the voter
registration services program must answer questions an applicant may have about the instructions
printed on a state or county prescribed voter registration form.
The following instructions will help the employee to answer questions and to assist the customer in
filling out the voter registration form:
Box 1 and 2: “Citizenship and Age:” Must be answered. If the applicant answers “No” to
either question, the person is not eligible to register to vote and may not complete the
form.
Box 3: “Last name, first name, middle name or initial, Jr., II, etc.:” Applicant must
enter his or her full name. If this is a change of name, the new name must be entered in
this space.
Box 4: “House number and street:” Applicant must enter his or her current street address,
including apartment or lot number, if applicable. A post office box or postal service address
cannot be used in place of a residence street address.
Box 5: “City or Post office:” Applicant must enter his or her city, village or post office
station.
Box 6: “Zip Code:” Applicant must enter ZIP code for his or her residence address.
Box 7: “Additional rural or mailing address:” Enter any additional address information,
including a mailing address if different than residence address (e.g., a post office box, etc.).
Box 8: “County where you live:” Applicant enters county of his or her residence.
Box 9: “Birth date:” Applicant must enter his or her date of birth.
Box 10: “Ohio driver’s license number or last four digits of Social Security number:”
If the applicant has a current Ohio’s driver’s license, that number must be entered in Box
10. If the applicant does not have an Ohio driver’s license, the last four digits of the
applicant’s Social Security number must be entered. If the applicant does not have either an
Ohio’s driver’s license number or Social Security number, the applicant must enter “None” in
Box 10.
Box 11: “Telephone number:” Applicant enters telephone number. This is voluntary
information, but is helpful to the county board of elections if it needs to contact the person

surrounding lines of type. If the applicant’s signature is a mark, the person assisting the
applicant completing the registration form must also include his or her name and address.
Attorney in fact: If, by reason of disability, an applicant or elector is unable to physically
affix his or her signature or mark to the voter registration/change of name/change of
address form, the person whom the applicant or elector has appointed his or her attorney in
fact under R.C. 3501.382 may sign that form on behalf of the applicant, at the direction, and
in the presence, of the applicant or elector.
PROCESSING COMPLETED VOTER REGISTRATION FORMS
When a voter registration form is returned, the deputy registrar or employee of the deputy
registrar’s office places it with all other voter registration forms that are to be transmitted, pursuant
to R.C. 3503.11, to the board of elections in the county in which the deputy registrar’s office is
located within five (5) days after accepting the form.
The Office Manager should process registration forms as follows:
• Date stamp each voter registration form that is not a computer-generated BMV form.
o The date stamp should not identify the deputy registrar’s location.
o The date stamp should be placed in a blank space on the form so as not to interfere
with reading the information on the form or scanning of the signature.
o If no date stamp is available, the date may be written on the form.
• Not later than five (5) days after receipt, batch together all the voter registration forms with
a properly completed voter registration transmittal form (Exhibit B):
o Insert the total number of voter registration forms received at the deputy registrar’s
office on the appropriate line of the transmittal form.
o Fill out the remaining information on the transmittal form (e.g., office name and
number, address, date, name of person completing the form, and phone number).
• Deliver in person or mail the packet containing the transmittal form and the voter
registration forms to the board of elections in the county in which the agency is located. The
method of transmittal must be mutually agreed upon by the agency site and the board of
elections.
Note: Establishing a regular routine of delivering or mailing the forms to the
board of elections on a given day of a week helps to provide consistency of
delivery to meet the five-day submission requirement.

• Every voter registration form must be transmitted to the board within five (5) days after the
deputy registrar’s office receives it.
• If a deputy registrar or employee of a deputy registrar’s office has any question as to
whether a voter registration form is completed properly, the voter registration form must be
submitted to the board of elections, as in the case of any completed voter registration form.
The board of elections will determine the validity of the application and, if necessary, contact
the person named in the registration form for any additional information. No deputy
registrar, Office Manager or employee shall destroy any voter registration form entrusted to
that deputy registrar’s office.
REGISTRATION FACTS
Following are some frequently asked questions regarding voter registration:
To vote in an election in Ohio, does a person have to be registered to vote?
Yes.
How does a person know whether he or she is qualified to register and to vote in Ohio?
A person is qualified to register to vote in Ohio if that person meets all the following
requirements:
• The person is a citizen of the United States.
• The person will be at least 18 years old on or before the day of the next general
election.
• The person will be a resident of Ohio for at least 30 days immediately before the
election in which the person wants to vote.
• The person is not incarcerated (in prison) for a felony conviction under the laws of this
state, another state or the United States.
• The person has not been declared incompetent for voting purposes by a probate court.
• The person has not been otherwise barred from voting in this state.
A person is eligible to vote in elections conducted in the person’s voting precinct more than 30
consecutive days after the person is properly registered to vote in this state.
Where can I register?

You may register in person at any of the public offices listed below:

• At the office of any registrar or deputy registrar of the Bureau of Motor Vehicles.
• State and local offices of designated agencies that provide public assistance or
disability programs, including: department of job and family services, department of
health, department of mental health, department of mental retardation and
developmental disabilities, rehabilitation services commission, or each office that
provides assistance to disabled students of a state-supported college or university.
(2) By mail:
You may request a registration form from a board of elections or the Secretary of State’s
office by mail, telephone, in person, or by having another person obtain it for you.
If you have access to the Internet, you may download a voter registration application from
the Secretary of State’s Web site at www.sos.state.oh.us.
You may return your completed registration application in person, by mail or via another
person to any of the locations previously listed except offices of the Bureau of Motor Vehicles
or its deputy registrars.
Note: If you complete your registration application in person at an office of the Bureau of
Motor Vehicles or one of its deputy registrars, you may return your application to an employee
of that office, at that time. However, if you choose to take the registration application with
you to complete and return at a later time, you must return it in person or by mail to any state
or local office of a designated agency, to a public high school or vocational school, to a public
library, to the office of a county treasurer, to the office of the Secretary of State, or to the
office of a board of elections.
What is the registration deadline?
A voter registration form must be received by a board of elections, a Bureau of Motor Vehicles
office, a designated agency, public library, public high school or vocational school, county
treasurer’s office or the Secretary of State’s office at least 30 days before an election for the
applicant to be eligible to vote in that election. Forms returned by mail must be postmarked not
later than the 30th day before the election.
Does an applicant declare his or her political party affiliation at the time of registration?
No. An elector declares his or her political party affiliation by voting in a party primary election.

Does an applicant ever have to re-register to vote?
Yes, if the voter moves, changes his or her name, or fails to respond to an official notice from the
board of elections and does not vote or update his or her voter registration at least once during a
period of four years, including two federal elections, after the board of elections mails the notice.
What if an applicant has moved or changed his or her name?
A voter must notify the board of elections if there are any changes to the voter’s registration
information. All that is needed is for the voter to fill out another voter registration form with the
changes in information and submit it in the same manner as an original voter registration
application.
Additionally, a person may change the voter’s registration information and vote a provisional
ballot by filing a notice of change of residence or name with the board of elections:
• At any time during office hours during the 28 days prior to a general, primary or special
election (or 25 days prior to a presidential primary election).
• Until noon on the Saturday before the election.
• On Monday, the day prior to the election, during its normal office hours.
• On Election Day, during the time that the polls are open. On Election Day, in addition to
the board office, you may chose to submit your change and vote a provisional ballot at
your new precinct or at a site designated by the board of elections.
Can a person register if he or she is illiterate?
Yes. If someone who is unable to read or write wishes to register or update an existing
registration, you can read the instructions to the person and help him or her complete the form.
If the client is unable to sign, then pursuant to R.C. 3503.14, the client is allowed to mark an “X”
in the signature box indicating his or her intent to register to vote or to update a current voter
registration. If the client registers in this manner, the employee helping must sign the client’s
name in the signature box, and then sign the employee’s own name in the space provided. If a
client is unable to make a mark, the client must indicate in some manner his or her desire to
register to vote or update a current registration. The employee shall sign the applicant’s name
and the employee’s own name and attest that the applicant desires to register or update his or
her current voter registration.
Attorney in fact: If, by reason of disability, an applicant or elector is unable to physically affix
his or her signature or mark to the voter registration/change of name/change of address form,
the person whom the applicant or elector has appointed his or her attorney in fact pursuant R.C.
3501.382 may sign that form on behalf of the applicant, at the direction, and in the presence, of
the applicant or elector.

Who is a United States citizen?
• Anyone born in the United States, except a child of a foreign diplomat, is a U.S. citizen. For
purposes of citizenship, being born in the United States includes the 50 states, District of
Columbia, Puerto Rico, U. S. Virgin Islands, Guam and America Samoa.
• Immigrants who are granted citizenship status by the United States Citizenship and
Immigration Services (USCIS), a bureau of the U.S. Department of Homeland Security.
There are certain circumstances when an individual automatically becomes a U.S. citizen, such as:
• Minor children who may acquire U.S. citizenship automatically when a parent is naturalized.
(The citizenship of such children may be overlooked, because they may never have been
documented as U.S. citizens.)
• Children born outside of the United States, whose parents were U.S. citizens at the time of
birth. Foreign-born children of U.S. citizens become citizens by the operation of laws passed
by Congress and are called “derivative or statutory citizens.”

Sec. 1973gg-5. – Sec. 7 Voter registration agencies
(a) Designation
(1) Each State shall designate agencies for the registration of voters in elections for Federal
office.
(2) Each State shall designate as voter registration agencies -
(A) all offices in the State that provide public assistance; and
(B) all offices in the State that provide State-funded programs primarily engaged in providing
services to persons with disabilities.
(3) (A) In addition to voter registration agencies designated under paragraph (2), each
State shall designate other offices within the State as voter registration agencies.
(B) Voter registration agencies designated under subparagraph (A) may include -
(i) State or local government offices such as public libraries, public schools, offices of city
and county clerks (including marriage license bureaus), fishing and hunting license
bureaus, government revenue offices, unemployment compensation offices, and
offices not described in paragraph (2)(B) that provide services to persons with
disabilities; and
(ii) Federal and nongovernmental offices, with the agreement of such offices.
(4) (A) At each voter registration agency, the following services shall be made available:
(i) Distribution of mail voter registration application forms in accordance with paragraph
(6).
(ii) Assistance to applicants in completing voter registration application forms, unless the
applicant refuses such assistance.
(iii) Acceptance of completed voter registration application forms for transmittal to the
appropriate State election official.
(B) If a voter registration agency designated under paragraph (2)(B) provides services to a
person with a disability at the person’s home, the agency shall provide the services
described in subparagraph (A) at the person’s home.
(5) A person who provides service described in paragraph (4) shall not -
(A) seek to influence an applicant’s political preference or party registration;
(B) display any such political preference or party allegiance;
(C) make any statement to an applicant or take any action the purpose or effect of which is
to discourage the applicant from registering to vote; or
(D) make any statement to an applicant or take any action the purpose or effect of which is
to lead the applicant to believe that a decision to register or not to register has any
bearing on the availability of services or benefits.
(6) A voter registration agency that is an office that provides service or assistance in addition to
conducting voter registration shall -
(A) distribute with each application for such service or assistance, and with each
recertification, renewal, or change of address form relating to such service or assistance -

(i) the mail voter registration application form described in section 1973gg-7(a)(2) of
this title, including a statement that -
(I) specifies each eligibility requirement (including citizenship);
(II) contains an attestation that the applicant meets each such
requirement; and
(III) requires the signature of the applicant, under penalty of perjury; or
(ii) the office’s own form if it is equivalent to the form described in section 1973gg-
7(a)(2) of this title,
unless the applicant, in writing, declines to register to vote;
(B) provide a form that includes -
(i) the question, “If you are not registered to vote where you live now, would you like to
apply to register to vote here today?’’;
(ii) if the agency provides public assistance, the statement, “Applying to register or
declining to register to vote will not affect the amount of assistance that you will be
provided by this agency.’’;
(iii) boxes for the applicant to check to indicate whether the applicant would like to
register or declines to register to vote (failure to check either box being deemed to
constitute a declination to register for purposes of subparagraph (C)), together with
the statement (in close proximity to the boxes and in prominent type), “IF YOU DO
NOT CHECK EITHER BOX, YOU WILL BE CONSIDERED TO HAVE DECIDED NOT TO
REGISTER TO VOTE AT THIS TIME.’’;
(iv) the statement, “If you would like help in filling out the voter registration application
form, we will help you. The decision whether to seek or accept help is yours. You
may fill out the application form in private.’’; and
(v) the statement, “If you believe that someone has interfered with your right to register
or to decline to register to vote, your right to privacy in deciding whether to register
or in applying to register to vote, or your right to choose your own political party or
other political preference, you may file a complaint with _ _ _ _ _.’’, the blank being
filled by the name, address, and telephone number of the appropriate official to
whom such a complaint should be addressed; and
(C) provide to each applicant who does not decline to register to vote the same degree of
assistance with regard to the completion of the registration application form as is
provided by the office with regard to the completion of its own forms, unless the
applicant refuses such assistance.
(7) No information relating to a declination to register to vote in connection with an application
made at an office described in paragraph (6) may be used for any purpose other than voter
registration.
(b) Federal Government and private sector cooperation.
All departments, agencies, and other entities of the executive branch of the Federal Government
shall, to the greatest extent practicable, cooperate with the States in carrying out subsection (a) of
this section, and all nongovernmental entities are encouraged to do so.

(c) Armed Forces recruitment offices
(1) Each State and the Secretary of Defense shall jointly develop and implement procedures for
persons to apply to register to vote at recruitment offices of the Armed Forces of the United
States.
(2) A recruitment office of the Armed Forces of the United States shall be considered to be a
voter registration agency designated under subsection (a)(2) of this section for all purposes
of this subchapter.
(d) Transmittal deadline
(1) Subject to paragraph (2), a completed registration application accepted at a voter
registration agency shall be transmitted to the appropriate State election official not later
than 10 days after the date of acceptance.
(2) If a registration application is accepted within 5 days before the last day for registration to
vote in an election, the application shall be transmitted to the appropriate State election
official not later than 5 days after the date of acceptance.

RE: Voter registration duties of registrar of motor vehicles and deputy registrars
(Elections Title)
R.C. 3503.11
When any person applies for a driver’s license, commercial driver’s license, a state of Ohio
identification card issued under section 4507.50 of the Revised Code, or motorcycle operator’s
license or endorsement, or the renewal or duplicate of any license or endorsement under Chapter
4506. or 4507. of the Revised Code, the registrar of motor vehicles or deputy registrar shall offer the
applicant the opportunity to register to vote or to update the applicant’s voter registration. The
registrar of motor vehicles or deputy registrar also shall make available to all other customers voter
registration applications and change of residence and change of name forms, but is not required to
offer assistance to these customers in completing a voter registration application or other form.
The registrar or deputy registrar shall send any completed registration application or any completed
change of residence or change of name form to the board of elections of the county in which the
office of the registrar or deputy registrar is located, within five days after accepting the application
or other form.
The registrar shall collect from each deputy registrar through the reports filed under division (J) of
section 4503.03 of the Revised Code and transmit to the secretary of state information on the
number of voter registration applications and change of residence or change of name forms
completed or declined, and any additional information required by the secretary of state to comply
with the National Voter Registration Act of 1993. No information relating to an applicant’s decision to
decline to register or update the applicant’s voter registration at the office of the registrar or deputy
registrar may be used for any purpose other than voter registration record-keeping required by the
secretary of state, and all such information shall be kept confidential.
The secretary of state shall prescribe voter registration applications and change of residence and
change of name forms for use by the bureau of motor vehicles. The bureau of motor vehicles shall
supply all of its deputy registrars with a sufficient number of voter registration applications and
change of residence and change of name forms.

RE: Registration or updating registration
R.C. 3503.19
(A) Persons qualified to register or to change their registration because of a change of address or
change of name may register or change their registration in person at any state or local office of
a designated agency, at the office of the registrar or any deputy registrar of motor vehicles, at a
public high school or vocational school, at a public library, at the office of a county treasurer, or
at a branch office established by the board of elections, or in person, through another person, or
by mail at the office of the secretary of state or at the office of a board of elections. A registered
elector may also change the elector’s registration on election day at any polling place where the
elector is eligible to vote, in the manner provided under section 3503.16 of the Revised Code.
Any state or local office of a designated agency, the office of the registrar or any deputy
registrar of motor vehicles, a public high school or vocational school, a public library, or the
office of a county treasurer shall transmit any voter registration application or change of
registration form that it receives to the board of elections of the county in which the state or
local office is located, within five days after receiving the voter registration application or change
of registration form.
An otherwise valid voter registration application that is returned to the appropriate office other
than by mail must be received by a state or local office of a designated agency, the office of the
registrar or any deputy registrar of motor vehicles, a public high school or vocational school, a
public library, the office of a county treasurer, the office of the secretary of state, or the office of
a board of elections no later than the thirtieth day preceding a primary, special, or general
election for the person to qualify as an elector eligible to vote at that election. An otherwise valid
registration application received after that day entitles the elector to vote at all subsequent
elections.
Any state or local office of a designated agency, the office of the registrar or any deputy
registrar of motor vehicles, a public high school or vocational school, a public library, or the
office of a county treasurer shall date stamp a registration application or change of name or
change of address form it receives using a date stamp that does not disclose the identity of the
state or local office that receives the registration.
Voter registration applications, if otherwise valid, that are returned by mail to the office of the
secretary of state or to the office of a board of elections must be postmarked no later than the
thirtieth day preceding a primary, special, or general election in order for the person to qualify
as an elector eligible to vote at that election. If an otherwise valid voter registration application
that is returned by mail does not bear a postmark or a legible postmark, the registration shall be
valid for that election if received by the office of the secretary of state or the office of a board of
elections no later than twenty-five days preceding any special, primary, or general election.

(B)(1) Any person may apply in person, by telephone, by mail, or through another person for voter
registration forms to the office of the secretary of state or the office of a board of elections.
(2) (a) An applicant may return the applicant’s completed registration form in person or by mail
to any state or local office of a designated agency, to a public high school or vocational
school, to a public library, to the office of a county treasurer, to the office of the secretary
of state, or to the office of a board of elections.
*(b) Subject to division (B)(2)(c) of this section, an applicant may return the applicant’s
completed registration form through another person to any board of elections or the
office of the secretary of state.
*(c) A person who receives compensation for registering a voter shall return any registration
form entrusted to that person by an applicant to any board of elections or to the office of
the secretary of state.
(d) If a board of elections or the office of the secretary of state receives a registration form
under division (B)(2)(b) or (c) of this section before the thirtieth day before an election,
the board or the office of the secretary of state, as applicable, shall forward the
registration to the board of elections of the county in which the applicant is seeking to
register to vote within ten days after receiving the application. If a board of elections or
the office of the secretary of state receives a registration form under division (B)(2)(b) or
(c) of this section on or after the thirtieth day before an election, the board or the office
of the secretary of state, as applicable, shall forward the registration to the board of
elections of the county in which the applicant is seeking to register to vote within thirty
days after that election.
(C)(1) A board of elections that receives a voter registration application and is satisfied as to the
truth of the statements made in the registration form shall register the applicant not later
than twenty business days after receiving the application, unless that application is received
during the thirty days immediately preceding the day of an election. The board shall promptly
notify the applicant in writing of each of the following:
(a) The applicant’s registration;
(b) The precinct in which the applicant is to vote;
(c) In bold type as follows:
“Voters must bring identification to the polls in order to verify identity. Identification may
include a current and valid photo identification; a military identification, or a copy of a
current utility bill, bank statement, government check, paycheck, or other government
document, other than a notice of election or a voter registration notification sent by a
board of elections, that shows the voter’s name and current address. Voters who do not
provide one of these documents will still be able to vote by providing the last four digits
of the voter’s social security number and by casting a provisional ballot. Voters who do
not have any of these forms of identification, including a social security number, will still
be able to vote by signing an affirmation swearing to the voter’s identity under penalty of
election falsification and by casting a provisional ballot.”

The notification shall be by nonforwardable mail. If the mail is returned to the board, it shall
investigate and cause the notification to be delivered to the correct address.
(2) If, after investigating as required under division (C)(1) of this section, the board is unable to
verify the voter’s correct address, it shall cause the voter’s name in the official registration list
and in the poll list or signature pollbook to be marked to indicate that the voter’s notification
was returned to the board.
At the first election at which a voter whose name has been so marked appears to vote, the
voter shall be required to provide identification to the election officials and to vote by
provisional ballot under section 3505.181 of the Revised Code. If the provisional ballot is
counted pursuant to division (B)(3) of section 3505.183 of the Revised Code, the board shall
correct that voter’s registration, if needed, and shall remove the indication that the voter’s
notification was returned from that voter’s name on the official registration list and on the
poll list or signature pollbook. If the provisional ballot is not counted pursuant to division
(B)(4)(a)(i), (v), or (vi) of section 3505.183 of the Revised Code, the voter’s registration shall
be canceled. The board shall notify the voter by United States mail of the cancellation.
(3) If a notice of the disposition of an otherwise valid registration application is sent by
nonforwardable mail and is returned undelivered, the person shall be registered as provided
in division (C)(2) of this section and sent a confirmation notice by forwardable mail. If the
person fails to respond to the confirmation notice, update the person’s registration, or vote
by provisional ballot as provided in division (C)(2) of this section in any election during the
period of two federal elections subsequent to the mailing of the confirmation notice, the
person’s registration shall be canceled.

RE: Distribution of Secretary of State’s voter registration information brochure
R.C. 3503.28
(A) The secretary of state shall develop an information brochure regarding voter registration. The
brochure shall include, but is not limited to, all of the following information:
(1) The applicable deadlines for registering to vote or for returning an applicant’s completed
registration form;
(2) The applicable deadline for returning an applicant’s completed registration form if the person
returning the form is being compensated for registering voters;

(3) The locations to which a person may return an applicant’s completed registration form;
*(4) The location to which a person who is compensated for registering voters may return an
applicant’s completed registration form;
*(5) The registration and affirmation requirements applicable to persons who are compensated
for registering voters under section 3503.29 of the Revised Code;
(6) A notice, which shall be written in bold type, stating as follows: “Voters must bring
identification to the polls in order to verify identity. Identification may include a current and
valid photo identification; a military identification, or a copy of a current utility bill, bank
statement, government check, paycheck, or other government document, other than a notice
of election or a voter registration notification sent by a board of elections, that shows the

(B) Except as otherwise provided in division (D) of this section, a board of elections, designated
agency, public high school, public vocational school, public library, office of a county treasurer,
or deputy registrar of motor vehicles shall distribute a copy of the brochure developed under
division (A) of this section to any person who requests more than two voter registration forms
at one time.
(C)(1) The secretary of state shall provide the information required to be included in the brochure
developed under division (A) of this section to any person who prints a voter registration
form that is made available on a web site of the office of the secretary of state.
(2) If a board of elections operates and maintains a web site, the board shall provide the
information required to be included in the brochure developed under division (A) of this
section to any person who prints a voter registration form that is made available on that web
site.
(D) A board of elections shall not be required to distribute a copy of a brochure under division (B) of
this section to any of the following officials or employees who are requesting more than two
voter registration forms at one time in the course of the official’s or employee’s normal duties:
(1) An election official;
(2) A county treasurer;
(3) A deputy registrar of motor vehicles;
(4) An employee of a designated agency;
(5) An employee of a public high school;
(6) An employee of a public vocational school;
(7) An employee of a public library;
(8) An employee of the office of a county treasurer;

R.C. 4501.023
(A) The registrar of motor vehicles shall designate an employee of the bureau of motor vehicles to
be in charge of and responsible for voter registration within the bureau. Each deputy registrar of
motor vehicles shall designate an employee in that deputy registrar’s office to be in charge of and
responsible for voter registration within that office.
(B) The registrar shall provide, in cooperation with the secretary of state, a training program and
materials for initial training in voter registration and for ongoing training for all deputy registrars and
their employees.
(C) The registrar shall report to the secretary of state at least once annually the number of
applicants for licenses served and the number of voter registration transactions completed and
transmitted to the board of elections by the registrar and all deputy registrars.

(A) The registrar of motor vehicles shall designate the deputy administrator for the deputy registrar
services section to be in charge of and responsible for voter registration within the bureau of motor
vehicles. The deputy administrator may designate other employees within the section to assist in
voter registration. The deputy administrator shall provide, in cooperation with the secretary of state,
a training program and materials for training in voter registration for deputy registrars and their
employees.
(B )The office manager appointed by each deputy registrar shall be in charge of and responsible for
voter registration within that agency unless the deputy registrar notifies the registrar in writing that
he has designated another individual to serve in that capacity.
(C) When any person applies for a driver’s license, commercial driver’s license, a state of Ohio
identification card, or motorcycle operator’s license or endorsement, or the renewal or duplicate of
any license or endorsement under Chapter 4506. or 4507. of the Revised Code, the employee of the
registrar or deputy registrar receiving the application shall offer the applicant the opportunity to
register to vote or update his voter registration if the applicant is eligible and wishes to do so, and
assistance in completing the voter registration form if so requested.
The applicant shall not be required to fill out any portion of the voter registration form that requests
information that duplicates information on the application for a license, identification card or
endorsement. Such information shall be printed on the form by the deputy registrar.
(D) The registrar or deputy registrar shall enter the date each registration application, change of
name notice, or change of address form is received. The date may be entered by use of a date
stamp or may be typed or printed upon the document. The date stamp or date entry shall not
disclose the identity of the office which entered it.
(E) The registrar or deputy registrar shall send any completed registration application, change of
residence notice, or change of name notice to the board of elections of the county in which the
office of the registrar or deputy registrar is located, within five days after accepting the application
or notice.
(F) Each deputy registrar shall record the number of applicants for licenses he has served, the
number of voter registrations, change of address notices and change of name notices he has
completed and transmitted to the board of elections, and the number of voter registration
applications declined and shall file a report with the registrar listing all those numbers. The report
shall be filed semi-annually or more frequently as prescribed by the registrar. Upon request of the
registrar, each deputy registrar shall report any additional information required by the secretary of
state to comply with the National Voter Registration Act of 1993, as amended.

(G) The registrar shall collect the reports from each deputy registrar and shall report and transmit to

(H) No information relating to an applicant’s decision to decline to register or update his voter
registration at the office of the registrar of deputy registrar may be used for any purpose other than
voter registration record keeping required by the secretary of state, and all such information shall be
kept confidential.
(I) The bureau of motor vehicles shall supply all of its deputy registrars with a sufficient number of
voter registration applications, change of residence notices, and change of name notices as
prescribed by the secretary of state.
(J) The decision of any applicant whether to register as an elector shall be given no consideration in
the decision whether to issue him a license, a state identification card, an endorsement, a renewal,
or a duplicate.
(K) In addition to other provisions set forth in this rule, each deputy registrar shall maintain a supply
of voter registration applications, change of address notices, and change of name notices and shall
provide them to any individual upon request. Each deputy shall display in a prominent place a notice
that voter registration applications and change of address or name notices are available at the
agency.
