captioned Supreme Court Case move that the court grant me a thirty day extension of the deadline to file a brief and the excerpt of record. MEMO I believe an extension is appropriate because: A) I have filed a motion to consolidate Supreme Court Case S-12050 and this appeal of Judge Olsen's decision. I am awaiting the court's ruling so as to decide how to proceed. Until the court decides whether to keep these cases separate or not I should not be forced to expend more time and considerable money in an attempt to recover attorney fees and costs in a repetitious appeal of the above
captioned case. Judge Olsen's Memorandum Decision and Order addresses the 2002 apportionment, and this appeal only addresses the Motion And Memo For Extension Of Deadline For Filing Brief And Excerpt of Record. Braun V Denali Borough S-12359 Page 1 of 2
2002 plan. The 2002 apportionment is no longer in effect; boundaries were changed in 2004. The central issue in both the above captioned case and S-12050 is the violation of equal protection by vote dilution. I argue that the substantive difference between the 2002
apportionment and the 2004 apportionment is the unnecessary use of weighted voting to achieve vote dilution in the 2002 plan, as explained in the Motion for Consolidation filed in S-12050. B) My family and I were out of the state from July 31, 20 until August 28, 2006. I have a job, a family, and other obligations. I am preparing my home and family for winter weather, and I do not have time to prepare another excerpt of record and a brief at this time. I have spent more than four years and over $15,000.00 on this effort. The stresses on me and my family have been enormous. These cases should be decided on their merits, not by who reaches the limits of endurance first.
I beg the court to grant me a thirty day extension in which to file the brief and excerpt of record.
