REGULAR MEETING                                                    N O V E M B E R 6, 2 0 0 7

        BE IT REMEMBERED that the Mayor and Board of Aldermen of the City of Pass
Christian, Mississippi, met on the above date at 111 Hiern Avenue, Pass Christian, Mississippi,
at 6:00 p.m. same being the time and place for said Meeting.

PRESENT: Mayor Leo “Chipper” McDermott, Aldermen Joe Piernas, Lou Rizzardi, Anthony
Hall, Philip Wittmann and Huey Bang; John Dubuisson, Chief of Police; Malcolm Jones, City
Attorney; Cynthia Burkett, Comptroller and Vallerie Isabelle, City Clerk.

ABSENT:

       There being a quorum present to transact business of the City of Pass Christian; the
following proceedings were had and done:

      On motion of Alderman Wittmann, seconded by Alderman Rizzardi, carried
unanimously, the emergency was re-declared.

       On motion of Alderman Wittmann, seconded by Alderman Piernas, carried unanimously,
the Board amended the agenda.

        On motion of Alderman Wittmann, seconded by Alderman Piernas, carried unanimously,
the Board moved Item #1 – Hear from Mississippi Department of Archives and History about
projects on Davis Avenue.

       On motion of Alderman Piernas, seconded by Alderman Wittmann, carried unanimously,
the Board approved a $250.00 contribution to the Pass Christian Garden Club. This bringing
favorable notice to the resources and opportunities of the City. The budget is to be amended

       On motion of Alderman Piernas, seconded by Alderman Wittmann, carried unanimously,
the Board approved a $250.00 contribution to assist Ben Taylor in attending the Junior National
Young Leaders Conference in Washington, DC. This bringing favorable notice to the resources
and opportunities of the City. The budget is to be amended accordingly. Exhibit A-3

       On motion of Alderman Wittmann, seconded by Alderman Hall, carried unanimously, the
Board approved reimbursement to Mayor McDermott in the amount of $125.07 for hotel lodging
October 15, 2007 in Jackson, MS. Exhibit A-4

       On motion of Alderman Piernas, seconded by Alderman Hall, carried unanimously, the
Board granted variance to Flood Ordinance for the Pass Christian School District for a restroom
at McDonald Stadium. Exhibit A-5

       On motion of Alderman Hall, seconded by Alderman Rizzardi, carried unanimously, the
Board tabled Item #6 under Administrative – Consider appeal on behalf of Willsland Two, LLC
regarding the October 16, 2007 decision of the Pass Christian Zoning Board of Adjustments
approving a Special Exception requested by M. Square Properties, LLC for improvements at 765

        On motion of Alderman Hall, seconded by Alderman Piernas, carried unanimously, the
Board authorized the Mayor to file an application for Grant for Randolph School Renovation
Project through Lowe’s Charitable and Educational Foundation – Rosenwald Schools. Exhibit

        On motion of Alderman Piernas, seconded by Alderman Rizzardi, carried unanimously,
the Board adopted Resolution honoring John Dane, III for representing the City of Pass Christian
at the Sailing Olympics. Exhibit A-8

       On motion of Alderman Rizzardi, seconded by Alderman Wittmann, carried
unanimously, the Board approved pay application No. 2 for Double Aught Construction in the
amount of $33,588.90 for Pass Christian Harbor – Katrina Repairs Phase II, as recommended by
City Engineer. Exhibit A-9

       On motion of Alderman Hall, seconded by Alderman Wittmann, carried unanimously, the
Board approved pay application No. 1 For Onyx, Inc. in the amount of $288,728.23 for Water
and Sewer Replacement Phase II, as recommended by the City Engineer. Exhibit A-10

       On motion of Alderman Bang, seconded by Alderman Hall, carried unanimously, the
Board approved pay by application No. 4 for Necaise Brothers Construction
Company, Inc in the amount of $165,286.55 for Water, Sewer & Drainage Replacement Scenic
Drive/Highway 90, as recommended by City Engineer. Exhibit A-11

       On motion of Alderman Rizzardi, seconded by Alderman Wittmann, carried
unanimously, the Board approved consider Authorizing City Engineer to issue Revised “Will
Serve” Letter for the village Condo project to also serve Club House. Exhibit A-12

       On motion of Alderman Rizzardi, Seconded by Alderman Hall, carried unanimously, the
Board approved consider Aurthorizing Restoration repair work to be done at Kittiwake Baptist
Church temporary Fire Station Site. Exhibit A-13

       On motion of Alderman Piernas, seconded by Alderman Wittmann, carried unanimously,
the Board approved payment in the Amount of $12,791.75 to E .T. Services for pay application
No. 1 For Fire Station #1 Repairs as recommended by project manager. Exhibit A-14

       Alderman Wittmann made a motion, seconded by Alderman Rizzardi, to consided
Rebating Gospel Singers Of American in a (Check) for a Board approved utility adjustment of
$432.68.

consider request from Jimmy Gouras Urban Planning Consultants Inc. for invoice No. 5029 in
the amount of $ 31,500.00 and Invoice No. 5065 in the Amount of $ 4,714.72 and “ Request for
cash and summary support sheet No. 1 “ The amount of $ 36,214.72 for payment of the above

Consider request from Jimmy Gouras Urban Planning Consultants Inc. For invoice No.5010 in
the amount of $ 5,000.00 and invoice No. 5054 in the amount of $ 750.00 and request for cash
and summary support sheet No. 1 “ In the amount of $ 5,750.00 for payment of the above

consider awarding contract in the amount of $ 7,500.00 for replacement of Guardrail on Menge
Avenue to Atwood Fence Company, which is a sole source vender, as recommended by

consider reviewing extension of the forbearing period for two more years on the three SRF

carried unanimously request of Chief Marvil to Promote Firefighter
Dwight Gordon and firefighter Terry Lewis to the rank of Lieutenant.

carried unanimously recommendation of City Comptroller, Purchasing
Agent and Parks and Recreation Director to approve and grant Jack
Perrone Fence Co. of Long Beach, MS. The contract to put up the
galvanized fence at the North Fleitas ball park for the amount of
$10,500. (lowest bid) Exhibit R-1

     On motion of Alderman Piernas seconded by Rizzardi carried
unanimously request to refund $1081.00 to Mr. Jermemy Mccollister
charges against Mr. Mccollister were appealed and dismissed. Exhibit

      On motion of Alderman Wittmann seconded by Rizzardi carried
unanimously request of municipal court judge to replace vehicle of
capais officer/animal control officer with a vehicle that could be used to
transport prisoners and animals to the humane society.

     On motion of Alderman Piernas seconded by Alderman carried
unanimously Ratify request of Chief Dubbission to send Investigator
James Stewart to a five day interview and interrogation class held
November 5-9, 2007 at Jefferson County Sheriffs Academy,
Birmingham, Al for the amount of $530.25. Exhibit P-1

carried unanimously request of Chief Dubbisson to approve annual
contract with the Mississippi Bureau of Narcotics for investigator
Ricardo L. Dedeaux to continue to serve as a noncompensated special
contract agent. Exhibit P-2

carried unanimously ratify the grant agreement with the Mississippi
Office of Homeland Security. Exhibit P-3

unanimously recommendation of Chief Dubbisson to Hire James H.
Riley Jr. to fill on of the vacancies in Patrol. Hire date will be November
9,02007 with a beginning salary of $ 23,000.000. Exhibit P-4

carried unanimously approving list of vehicles to be added to the Pass

carried unanimously request to purchase a Kubota Tractor with bushhog
side cutter and front loader in the amount of $32,647.85 as
recommended by the city comptroller and public works supervisor

carried unanimously requesting to refund Laura Dedeaux $53.00 for a
plumbing permit that was pulled on April 24,2007 for 359 Courtenay
Avenue by the homeowner and then the contractor pulled permit for
