Description: The Secretary of State must, under Section 18 of the Company Directors Disqualification Act 1986, keep a list of disqualified directors. However, it is no surprise that this responsibility was delegated to the Registrar of Companies. As things stand, it is not possible to obtain a copy of a disqualification order from Companies House, as courts do not submit copies of disqualification orders to them. Companies who employ disqualified directors not only need to be sure of the person's background, but if they knowingly choose to employ the disqualified director they need to define their role clearly and if in doubt seek legal advice in the wording of the contract of employment.
