					       KNOX COUNTY INTERGOVERNMENTAL COMMITTEE

              The Knox County Intergovernmental Committee met in
Regular Session on Tuesday, April 21, 2009 at 8:30 a.m. in the Main
Assembly Room of the City-County Building, Main Avenue. Those
members present were Commissioners Norman, McKenzie, Saunders,
Lambert, Armstrong, Broyles, Leuthold, Carringer and Brown. Also present
were Mr. Bill Lockett, Knox County Law Director, Mr. Joe Jarret, Knox
County Chief Deputy Law Director, Mr. Richard Walls, Knox County
Internal Auditor, Mr. Bruce Wuethrich, Director, Engineering and Public
Works, Mr. John Troyer, Director, Knox County Finance, Commissioner
Briggs, Ms. Ann Acuff, Knox County Accounting/Budget Director and news
media.
        Commissioner Norman, Chairman, presided.

donation of $1,000.00 to the free Medical Clinic on Chapman Highway from
the Mayor’s discretionary funds to assist in repairing their leaking roof.

Committee.
      Commissioner Leuthold moved to recommend approval to the full

REPAIRS AT MASCOT ROAD BRIDGE OVER HOLSTON RIVER:

existing contract) for bridge repairs at Mascot Road bridge over Holston
River was before the Intergovernmental Committee.

MEMORANDUM OF UNDERSTANDING WITH THE CITY OF
KNOXVILLE TO ALLOCATE THE 2009 RECOVERY ACT: JUSTICE
ASSISTANCE GRANT (JAG) PROGRAM AWARD: R-09-4-501:
       Consideration of a Resolution of the Commission of Knox County,
Tennessee approving a memorandum of understanding with the City of
Knoxville to allocate the 2009 Recovery Act: Justice Assistance Grant
(JAG) Program Award was before the Intergovernmental Committee.
       Commissioner Leuthold moved to recommend approval to the full
Commission R-09-4-501 - Consideration of a Resolution of the Commission
of Knox County, Tennessee approving a memorandum of understanding
with the City of Knoxville to allocate the 2009 Recovery Act: Justice
Assistance Grant (JAG) Program Award. Commissioner McKenzie

COMMISSION OF KNOX COUNTY, TENNESSEE APPROVING THE
2009-2010 ANNUAL ACTION PLAN (AAP) AS REQUIRED BY HUD
TO UPDATE THE 2005-2010 CONSOLIDATED PLAN: R-09-4-502:
       Consideration of a Resolution of the Commission of Knox County,
Tennessee approving the 2009-2010 Annual Action Plan (AAP) as required
by HUD to update the 2005-2010 Consolidated Plan was before the
Intergovernmental Committee.
       Commissioner Leuthold moved to recommend approval to the full
Commission R-09-4-502 - Consideration of a Resolution of the Commission
of Knox County, Tennessee approving the 2009-2010 Annual Action Plan
(AAP) as required by HUD to update the 2005-2010 Consolidated Plan.

       Consideration of a Resolution of the Commission of Knox County,

of Knox County, Tennessee approving a grant contract between the State of

Knox County Health Department, amount of 348,200.00 for the provision of

       Consideration of a Resolution of the Commission of Knox County,

       Consideration of a Resolution of the Commission of Knox County,
Tennessee approving a reimbursement check in the amount of $546.12 from
the East Tennessee Foundation for the Read With Me Program was before
the Intergovernmental Committee.
       Commissioner Leuthold moved to recommend approval to the full
Commission R-09-4-802 - Consideration of a Resolution of the Commission
of Knox County, Tennessee approving a reimbursement check in the amount
of $546.12 from the East Tennessee Foundation for the Read With Me
Program. Commissioner McKenzie seconded the motion and upon voice

CONTRACT WITH J. A. FIELDEN COMPANY, INC. TO PROVIDE
CONSTRUCTION MANAGER AT RISK SERVICES FOR THE
EXPANSION OF THE BECK CULTURAL EXCHANGE CENTER:

       Consideration of a Resolution of the Commission of Knox County,
Tennessee approving a contract with J. A. Fielden Company, Inc. to provide
Construction Manager at Risk Services for the expansion of the Beck
Cultural Exchange Center was before the Intergovernmental Committee.
       Commissioner Leuthold moved to recommend approval to the full
Commission R-09-4-803 - Consideration of a Resolution of the Commission
of Knox County, Tennessee approving a contract with J. A. Fielden
Company, Inc. to provide Construction Manager at Risk Services for the
expansion of the Beck Cultural Exchange Center. Commissioner McKenzie
seconded the motion and upon voice vote the motion carried 8-0-0-1.

       Consideration of a Resolution of the Commission of Knox County,
Tennessee, setting forth an orderly process for the appointment of Judicial
Commissioners was before the Intergovernmental Committee.

Commission R-09-4-804 - Consideration of a Resolution of the Commission
of Knox County, Tennessee, setting forth an orderly process for the

Tennessee approving the transfer of formula dislocated worker funds for use
in the formula adult program was before the Intergovernmental Committee.

       Consideration of a Resolution of the Commission of Knox County,
Tennessee directing PBA to negotiate a lease with the option to purchase the
State Street Parking Lot property with Clifford “Buzz” Goss was before the
Intergovernmental Committee.
       Mr. Clifford Goss, was present and spoke on the matter.
       Commissioner Leuthold moved to recommend sending without
recommendation from the Intergovernmental Committee R-09-4-909 -
Consideration of a Resolution of the Commission of Knox County,
Tennessee directing PBA to negotiate a lease with the option to purchase the
State Street Parking Lot property with Clifford “Buzz” Goss. Commissioner
Brown seconded the motion and upon voice vote the motion carried 9-0-0-0.

IN RE:         CONSIDERATION OF A RESOLUTION OF THE
COMMISSION OF KNOX COUNTY, TENNESSEE APPROVING A
POLICY TO CLARIFY THE USE OF TAKE HOME VEHICLES AND
OTHER POLICIES NOW CURRENTLY IN PLACE IN KNOX
COUNTY: R-09-4-911:
       Consideration of a Resolution of the Commission of Knox County,
Tennessee approving a policy to clarify the use of take home vehicles and
other policies now currently in place in Knox County was before the
Intergovernmental Committee.
       Commissioner Brown moved to recommend to the full Commission to
defer to the May Intergovernmental Committee R-09-4-911 -
Consideration of a Resolution of the Commission of Knox County,
Tennessee approving a policy to clarify the use of take home vehicles and
other policies now currently in place in Knox County. Commissioner
Saunders seconded the motion and upon voice vote the motion carried
9-0-0-0.

IN RE:         CONSIDERATION OF A RESOLUTION OF THE
COMMISSION OF KNOX COUNTY, TENNESSEE INSTRUCTING
THE LAW DIRECTOR TO TAKE ACTION TO RETRIEVE MONIES
ILLEGALLY OR INAPPROPRIATELY PAID TO EMPLOYEES OF
TRUSTEE’S OFFICE: R-09-4-912:
       Consideration of a Resolution of the Commission of Knox County,
Tennessee instructing the law director to take action to retrieve monies
illegally or inappropriately paid to employees of trustee’s office was before
the Intergovernmental Committee.
       Mr. Bill Lockett, Knox County Law Director, was present and spoke
on the matter.
       Commissioner Saunders moved to recommend approval to the full
Commission R-09-4-912 - Consideration of a Resolution of the Commission
of Knox County, Tennessee instructing the law director to take action to
retrieve monies illegally or inappropriately paid to employees of trustee’s
office with the following amendment: Include all county employees.
Commissioner McKenzie seconded the motion and upon voice vote the
motion carried 6-2-1-0. Commissioners Lambert and Brown voted no.
Commissioner Leuthold recused himself from the vote.

COMMISSION OF KNOX COUNTY, TENNESSEE APPROVING
STEPS TO BE TAKEN TO REDUCE VEHICLE COSTS AND TO
IMPROVE VEHICLE EFFICIENCY: R-09-4-914:
       Consideration of a Resolution of the Commission of Knox County,
Tennessee approving steps to be taken to reduce vehicle costs and to
improve vehicle efficiency was before the Intergovernmental Committee.
       Commissioner Saunders moved to recommend approval to the full
Commission R-09-4-914 - Consideration of a Resolution of the Commission
of Knox County, Tennessee approving steps to be taken to reduce vehicle
costs and to improve vehicle efficiency with the following amendment:
Reduce 28 vehicles in Sheriff’s Department and 28 vehicles under the
County Mayor. Commissioner Broyles seconded the motion.
       Commissioner Lambert moved as a substitute motion to recommend
sending without recommendation from the Intergovernmental Committee -
R-09-4-914 - Consideration of a Resolution of the Commission of Knox
County, Tennessee approving steps to be taken to reduce vehicle costs and to
improve vehicle efficiency. Commissioner Brown seconded the motion and
upon voice vote the motion carried 8-1-0-0. Commissioner Broyles voted
no.

COMPLIANCE WITH THE BUDGET AND OPERATING
REQUIREMENTS OF THE KNOX COUNTY CHARTER AND KNOX
COUNTY CODE BY CERTAIN COUNTY OFFICERS: R-09-4-915:
       Consideration of a Resolution of the Commission of Knox County,
Tennessee to ensure compliance with the budget and operating requirements
of the Knox County Charter and Knox County Code by certain County
Officers was before the Intergovernmental Committee.
       Mr. Bill Lockett, Knox County Law Director, was present and spoke
on the matter.
       Commissioner Saunders moved to recommend sending without
recommendation from the Intergovernmental Committee R-09-4-915 -
Consideration of a Resolution of the Commission of Knox County,
Tennessee to ensure compliance with the budget and operating requirements
of the Knox County Charter and Knox County Code by certain County

BEHAVIOR THAT INTIMIDATES, INSULTS OR THREATENS A
CITIZEN WHILE EXERCISING THEIR RIGHT TO APPEAR BEFORE
THE COUNTY COMMISSION: R-09-4-919:
       Consideration of a Resolution of the Commission of Knox County,
Tennessee declaring that the Commission will not tolerate any action or
behavior that intimidates, insults or threatens a citizen while exercising their
right to appear before the County Commission was before the
Intergovernmental Committee.
       Commissioner Leuthold moved to recommend approval to the full
Commission R-09-4-919 - Consideration of a Resolution of the Commission
of Knox County, Tennessee declaring that the Commission will not tolerate
any action or behavior that intimidates, insults or threatens a citizen while
exercising their right to appear before the County Commission with the
following amendment: to Include the Knox County Commission.
Commissioner Armstrong seconded the motion and upon voice vote the

IN RE:       AMENDMENT TO THE AGENDA:
       Without objection, Commissioner Norman heard from Mr. Mike
Arms, Chief of Staff, Knox County Mayor’s Office was present and stated
the Governor Phil Bredesen would be in Knoxville on April 30, 2009 at 6:00
p.m. at the History Center.
       Mr. Mike Arms, Chief of Staff, Knox County Mayor’s Office also
stated on April 30, 2009 at 3:00 p.m. the county would be reopening the
Farmer’s Market.
