1. Based upon the periodic observations of the Architect done in accordance with customary standards of a prudent architect and, to the best of the Architect’s knowledge, the construction of the Project has been performed in substantial accordance with the Project plans and specifications, and the Project is complete (except for minor punch list items specifically described in this certificate with estimated costs) so that tenants may occupy and the Borrower may operate and use the Project for the purposes for which it was intended; 2. To the best of the Architect’s knowledge, the Project has all utility connections necessary for its intended use; 3. To the best of the Architect’s knowledge, all permits, licenses and governmental approvals necessary for occupancy, operation and use of the Project have been obtained; 4. The Architect is aware that the Project is one which has/will receive public financing and in preparation for the design of the Project has reviewed all laws, codes and regulations applicable in the design of a publicly-financed multifamily residential structure; 5. To the best of the Architect’s knowledge, adequate ingress and egress to and from the Project is available over public streets, rights of way and easements; 6. The Project is constructed, to the best of the Architect’s knowledge, in accordance with the customary standards of a prudent architect and, in accordance with the Project plans and specifications, complies with all applicable statutes, codes, zoning ordinances and regulations, including, but not limited to, handicapped accessibility standards, as mandated by federal, state and local law; and 7. The California Department of Housing and Community Development is entitled to rely on this certificate.
