The suspect child sexual abuse medical evaluation has some unique differences from
other suspected child abuse evaluations. These differences are noted in law, state
reporting forms, county program, and common sense.

SB 892, effective in 1985, added changes to the Health and Safety Code and Penal
Code that requires certain guidelines and a standard state form for use with the
medical examination of suspected sexual assault. The law states that hospitals are to
follow these guidelines or to refer to a hospital that have this capacity. Los Angeles
County should have at least nine centers to match the total population of nine million
people.

The Los Angeles County Interagency Council on Child Abuse and Neglect, ICAN has
endorsed the use of special centers, “Centers of Excellence”, that provide expertise on
this exam. Additional draft guidelines are under review by ICAN to provide “Standard
for Forensic and Emergency Child Abuse/ Neglect Medical Examinations”.

There are examinations that clearly require this expertise and protocols examination
which do not, and examination where judgement must be applied. The person doing
screening exam needs basic knowledge and skills. A medical examination for physical
abuse or neglect may consider possible sexual assault as a secondary possibility.

No child should be forcibly restrained in order to perform a child sexual abuse
examination. Efforts should be made to acquaint the child with the medical examiner
and the surroundings and give them the time to go at their pace. Exams should never
be forced on children in a way that creates the sense of an assault of their genitals.
The examination can even be a healing experience if the child is respected and given
time to participate at their own pace and if the child and caretakers can be reassured
about irrational fears. However, sedation protocol may be needed for unusual cases in
which there is a possible insertion of a foreign object and the child refuses the exam.
Consider this information when seeking or providing an examination for possible child
sexual abuse.
